I gave Justin Allot of money to fix up my MR2. He said he would do a job, and blames me for running out of money. The vehilcle has "supposedly" and questionably been worked on, but only body work. So the car is absolutely unfinished, I refuse to give him any more money, bhe never once called me with a progress relport. ecause so far he has been ripping me off, and the vehicle is worse than when I gave it to him. He never told me anything except lies to buy more time, untill I finally confronted him about it. He came up with all these numbers that may or may not be true about money he says I "owe" him, but he never called me even once with a progress report. He is trying to counter sue me for $900 for picking up the vehicle, and to tow another vehicle, which he never once said anything to me about. I find out he's basically lying through his teeth about what he's going to do to fix my vehicle up, and he says I owe him money! He promised allot, and I thought I was going to do more to the vehicle. He stopped working on the vehicle after I stopped paying for the job because money was low. He refuses to even get the vehicle even remotely close to a point where I can sell it. He has stopped all work on the vehicle, and is demanding more money.


I even gave this guy money as a gift because he told me he wasn't going to be able to pay rent on his shop. We never were friends, but he treated me like one, up untill the money ran out. I go to court on September 23rd in Campbell. And I hope to get my vehicle back. Jusins wanted to give me back the vehicle at one point as long as I lied and signed paperwork paperwork saying that I basically owed him money, so he could at least get something back from taxes. At one point I told him that if he wanted the vehicle so bad, then he could have it, I was tired of hearing him BS me. I can't even sale the car because he says it his untill I pay him for work that I never authorized. I thinks I was going to give him double what I did, but he only did about 1/4 of the work we had talked about. He never communicated with me about the vehicle, except through lying to me and then trying to counter sue me for money I a) don't have and b) shouldn't have to pay him becuase he is a liar and cheat and just plain UNTRUSWORTHY. He is either going to keep the vehicle becuase I really owe him the money, or he needs to give me back my vehicle, painted and in running order. I actually don't trust anything he says, and would like my vehicle back and some of the money he supposedly usied so that I can get the car finished.

Scam Artist

Justin took me for over little under $4000. He did do some work to the car but in the end left it in pieces / shambles. I was nothing but nice to the guy and paid him cash up front for all parts and (labor) and every time I turned around something else was wrong with the car. I am a guy who lives week to week and am not rich and did not have half of the money I gave him. I sold many possessions IE: Records, tools, etc ... to cover all repair cost. I now have nothing left and have a chunk of metal that sits in my relatives machine shop under a tarp. Justin had a so called nervous breakdown due to his girlfriend cheated on him and instead of being a responsible human being and businessman that he should have been, his cure to the problem was drowning himself with drugs and alcohol while customers like myself patiently waited for there cars to be finished. In the end I tricked him into coming down and opening his shop up and had a flat bed waiting to take my car. I guess you can call it an expensive life lesson.

Side note: I am not the only person that got ripped off

It has been a while since my last rebuttal. I made two attempts at giving a final rebuttal, and for some reason they wouldn't post. We'll see if this does. I am sending this final rebuttal to put this behind Justin and I. We have had a few conversations over the phone, and I think we are both ready for a truce. I have had no hard feelings towards Justin for some time now...some things just aren't worth it. As I explained to Justin the last time we spoke...I believe the answer to this dilemma is not a simple one, but there is a solution. I have chosen to forgive Justin for all and any decisions he has made towards me that have had catastrophic consequences as well. I cannot and will not continue to pursue this as long as I live. I justin decides to sue me for anything, I am willing to endure any consequences for my actions. I don't think it will be necessary, especially after what I have gathered after speaking with Justin via cell phone. I am willing to admit where I ahve been wrong for pursuing Justin and I am also willing to continue to do whatever is necessary to fix this problem. I am not worried about Justin retaliating or suing me for anything, however, my main concern is that his name is cleared off all wrong doing. I can only speak for myself, and after thinking it over for the last couple of weeks, I have decided that it just isn't worth it. Life is way too short. Justin is a really good person, and any mistakes that were made do not stem from unprofessionalism or from any lack of respect or anything like that. I truely beleive he is an honest person, who made a few mistakes. He is no more to blame for the way things turned out than I am. I don't know what else I can say or do to prove that I am for real, but I am willing to do whatever it takes to clear Justin's name and put some form of finality to this. I will check the website in the next 24 hours or so, to look for any rebuttle.

I have no idea who called Eric, nor told anyone to threaten him. If some one did threaten Eric it was not authorized by me and is hearsay. The only person that I know that has Eric's phone number is me, and the phone number that I have for Eric is his girlfriend's phone number, I dont even think Eric has a phone, as he has never gave it to me even when repairs were being done to his vehicle. As far as I am concerned I have been finished with this whole situation, but Eric is obviously not finished with this and wants to continue with his alligations that are now just hearsay on Ripp-Off report.com. I have not been served any court paperwork from Eric's court dates as mentioned. As far as I know he is making up these threats, and court dates. I talked to the local police moments ago and they said that Eric is slandering me again and that if he calls me or comes to my business he will be arrested.

A few days ago, I received a telephone call from a guy who says he knows Justin, I listened to him out of curiosity. and for some reason, he decided to involve himself in the situation. "I know all about the situation between you and Justin". I listened to him for only a few minutes, out of a mixture of curiosity and respect.  He decides threatened me by saying that he would _________ me! The next day, I receive another hostile phone call from ____ ________. This time he says to me even more threats, which is the reason I am now deciding to speak out against this.   I am intentionally leaving it blank so as to allow you to understand something. Anytime someone perceives a threat, it no longer matters what fills in the blank area. I was threatened, and I am prepared to use this situation as just another reason to settle this in another manner. I will not allow Justin or anyone that Justin knows to intimidate me, or threaten me in any way. _____ _____ really has no clue as to what kind of message this is going to send when this matter is finally resolved. Again, I intensionally left the name of the individual who threatened me blank, because nobody else needs to get caught up in this situation. I have chosen not to pursue the individual who threatened me, but am prepared if the individual decides to follow through with his threat to me. I am absolutely prepared to take this to another level. It is just a matter of time before this situation is resolved. To me resolved brings up a beautiful word: Justice. I believe I got the short end of the stick, and I am no going to go away. I am not going to be intimidated. I will have Justice. Another word that comes to mind is another great word, a derivative of Justice: Just. Just, means doing the right thing, and what is fair. Here are a couple of definitions in case you're still confused: *Honorable and fair in one's dealings and actions: *Consistent with what is morally right; righteous: a just cause. The truth about the situation is what is going to determine the outcome. I will not try to define the word truth for many reasons I will not go into. I am not attacking you Justin, I am trying to resolve this situation. You had so many chances to make this situation right. No matter how much you believe you are right, there is no reason to allow others to get involved in these kinds of situations who will hurt you more than help you. I have chosen so far as to involve only those who are necessary. I don't have to be specific because, you'll find out any day now, how serious I am. It's just a matter of time, and all I can say is: Get your info straight and make sure you stick to the story. I am prepared if necessary to allow people with more authority than I to fix this. Do I need to spell it out? I'll let you figure it out. If you thought I was going to go away, you're wrong.

Erics Actions

First and foremost Eric says I charged him for the brakes/tune-up/etc... they are on the invoice but they are zero'd in the amount charged column.

Eric called me last week telling me that he is unable to sell the car for what he wants for it so he was going to finish it, reading betwwen the lines he was asking if I would finish it, which I would not, I had already given Eric 6 months of free storage to get some more funds. He later told me that he was hopeing that things were ok between us, which I told him that no things are not ok between us because of his threats and to please remove the rip-off report because it is false in the sense that he is making it out as.

I have had to call my lawyer about this and according to my lawyer Eric is slandering my business and that I can sue Eric.

Eric is being very unresonable about this whole situation, I could have lien sale'd the vehicle and it would've been mine by now, I did not lien sale it because Eric asked me not too. Now Eric has his car and is un-happy and is blaming me for his own faults. I have helped him get his car back even though I took a $1000 loss on it and he thinks that he got ripped off.

I have video evidence on all recent transactions, and of Eric's outburst by throwing a lit cigarette at my customers face, The police, Bureau of Automotive Repair, and my attorney have been notified and Eric still continues to make threats to me. So I leave to Eric as he is doing this to himself

The truth is somewhere in the middle

 I paid $500 for an original vehicle (1985 Toyota MR2) in Moss

Beach and had it towed from Moss Beach, CA to Overkill Streetworks

 (Overkill Chop Shop) in Campbell, CA.  Justin towed my 87 MR2

without my consent. If I would've known Justin was going to charge 

me for researching on the Internet to buy the 85 MR2, I would've had a 

chance to make a decision of whether or not it was something I wanted.

Justin never had me sign off a work request. The 1985 Toyota 

MR2 was purchased for $850. Justin told me that we could make money 

by parting out the original vehicle. I later realized my 87 MR2 was 

missing, and I asked Justin about it. Justin explained the car was not 

worth keeping and that the owner of the property had asked him to 

remove it because it had been there for too long. Justin decided to tow 

my vehicle and have it scrapped. I didn't get a call, asking me to remove 

the vehicle, I never approved it, and now I'll never know if the vehicle 

was truly towed unless I can contact the tow company. Justin never 

had me sign paperwork for the tow. I would've decided that if he 

would've communicated the problem to me. It doesn't matter what 

condition it was in, he had no right to dispose of my property 

without telling me or having my consent. Justin Dis-assembled my 

85 MR2, and got it ready to be painted, but stopped right there. I did go 

to Justin's shop to sell the car. Justin agreed, and then changed his 

mind. I received a call from The Bureau of Automotive repair, and was 

informed that Justin was willing to return the vehicle. I agreed because

already had one vehicle towed by Justin before. My total losses 

are: $500 (1985 MR2), $3,500 (1987 MR2), $300 (Money given to 

Justin to help pay for rent on the shop),  Estimated total losses= $4,300

What I have to show for it= 1985 MR2 Dis-assembled, and unpainted.

Eric James dewitt

   In October of 2008 eric James DeWitts's mother was my neighbor in Los gatos, He heard about my shop and wanted a show car with a price range of $6500-$10,000 to be built out of 1987 Toyota MR2. Eric had the car towed to the shop, the car was rendered useless as the previous owner had attempted to build it into a show car then blew the motor. This vehicle had 2" thick of bondo (body filler) in some places and the rear side windows were closed off with plywood and bondo. There was also a hole on the side of the motor about 4" in diameter from were the piston went threw, the computer, fuel injectors, intake were also missing. I recommended finding a new car.

   Having spent many days contacting people selling the same kind of car and driving many miles checking out new possible vehicles, I finally found a 1985 Toyota MR2 with all service records and even the original window sticker from when the vehicle was first sold in 1985!

   So finally I was able to resume progress on building the proposed project, at this point Eric James DeWitt had given me $1500. It cost $397 to get the 1987 MR2 scrapped, no junk yard would even buy it, it was in very poor condition. The 1985 Toyota MR2 was purchased for $950.

   1 month later Eric James DeWitt gave another $2000  

 The 1985 Toyota MR2 had all the body panels removed and stripped down to bare metal and the body work started. It took 2 1/2 months just to to the bodywork to make it flawless, and it is perfectly straight (probably even better than new).

    We at Overkill Streetworks do not do body work at the shop so it was all subletted out to a few professional auto body men, and it is expensive to do it this way becuase of the need for it to be perfect for show purposes and for it to last for years to come.

   At this point Eric James deWitt was out of money and asked to Borrow money, all work stopped on the vehicle as the bill was at $4000. I told Eric that there was another check needed for further progress, to paint the car and re-assemble it with a new bodykit that was going to be installed as well as new wheels and various interior and sterio pieces.

   A few months pass and Eric James Dewitt calls and asks to borrow $400 to pay a ticket, all I had was $75 so he says thats better than nothing and for me to include this in the repairs for the vehicle. Eric James Dewitt shows up to the shop, gets the money and leaves comes back in ten minutes telling me and showing me the illegal substances he just bought. I kicked Eric out of the shop, and didnt communicate for atleast a month until I told him I need a progress check.

   At this point I think he was doing illegal things and was crazy. He kept saying that he gave me $10,000 and the car was not finished. By this point I knew that this was a failed project with new issues. I now knew that he was broke and into some kind of addiction.

   A few months pass and Eric shows up to the shop with some gang biker guy to bully me, thank goodness there was 4 people with me here at the shop, as I was nopt getting good vibes at all with this situation. At that point he threatened to take me to small claims court, and that was ok with me because Eric James DeWitt owed the shop money and i knew it wouldnt hold up in court. I made him an offer to sign a release form stating that he would accept the car as Un-Finished and the shop would take it as a loss. Eric James declined the offer.

   Another 4-6 weeks pass, Eric calls and tells me that he posted the car on craigslist to sell it because his SSI doesnt pay him enough, and that he needs to move out to San Francisco, and he needs any money from selling the car. Some people show up to the shop looking at the car and they said that they were going to buy the car, I told them that the owner still owed money before I release it. Eric james DeWitt shows up to the shop, I pulled to the side and told him I cant release the car, Eric James DeWitt got "INSANE" and yelled at my customers with SLANDER, then "ERIC THREW A CIGARETTE AT MY CUSTOMER WHICH I GOT ON CAMERA".

   I called the police about Eric's behavior they contacted Eric and told him not to show up to the shop without a check or he would be arrested.

   B.A.R. calls me and telling me about Eric's complaint, I told them the situation and they recommended I took it as a loss and have Eric sign the un-finished vehicle waiver, B.A.R. were helping out with the whole situation and were basically the mediators, Thank You B.A.R.

    Eric agreed with the B.A.R. representative to sign the document, and showed up that afternoon on 9/9/09 at 5:00pm having his Girlfriend get the paperwork from me rather than doing it himself, she parked her car at the end of the parking lot while she came back and forth from her car to the shop, Eric signed the waiver so all the body pieces that were in storage were put into the vehicle and the shop closed at 6:00 pm.

   The tow truck came at @ 6:20pm and the were gone by 6:30, I have everything on camera and saved from when the picked up the vehicle, and from the insatance he threw i cigaretee at my customers face.
