I'm Richard ****, Board of Directors President of The Manet Terrace HOA. I'm also a neighbor and friend of Betty Jones. I've known Ms. Jones for 16 years. She is a long retired public school teacher of third graders. She is a sweet, meek and quiet 72 year old lady who is easily intimidated and has a very difficult time saying "no" to anyone. Her home is severely cluttered and she has difficulty finding any particular item. Several years ago she was diagnosed with type 2 diabetes. Her eye sight, hearing and short term memory are impaired.
 
Sometime late Dec. 2011 Ms. Jones received a "cold call" from K-designers touting benefits of dual pane windows/doors and talked her into meeting a sales rep.
 
On Jan. 3, 2012 Ms. Jones met with Leo Senderovich. During his lengthy presentation, she expressed doubts about the extent of the proposed project and the cost. Mr. Senderovich convinced her that the "benefits" would far out weigh the cost and she signed an agreement to have all of her windows, sliding glass doors and garage door/opening motor replaced.
 
I became aware of the project Jan. 24, 2012, when our Property Mgr., Tanya Ruiz, sent me Ms. Jones architectural application for the work. Our HOA has "standard" window/sliding glass door replacements which specify Milgard or Simonton brands, only. When I talked with Ms. Jones the next day to determine the scope of the project, she told me she had met with a man who proposed the replacements and gave her an "estimate". I asked her if she had signed anything and she said she signed a piece of paper indicating that she had received the "estimate".

However, she could not find it. She also told me that she did not really want or need  new windows, sliding glass doors and garage door w/ motor and could not afford the project but felt extremely pressured to say yes. She was clearly stressed just talking about the situation. I asked Ms. Ruiz to contact Mr. Senderovich for a copy. When I saw it, it was, in fact, a "sales agreement". I told Ms. Jones to call the toll free number and tell the rep. she could not afford the replacements and needed to cancel the project.
 
Last night, Feb. 15, 2012, I received a call from Ms. Jones. She was very distraught, stressed and crying. I told her to calm down so she could tell me the problem. She told me that Mr. Senerovich was in her home and told her that if she didn't have the work completed, and pay for it, she would be receiving multiple calls, daily from a collection agency and a "lien" would be placed on her home. I went to Ms. Jones home and met Mr. Senderovich. He told me no one had contacted Ms. Jones since her "cancellation" call because he had been on vacation for 2+ weeks.

He was here to try to salvage all or part of the project. The last offer he had made to Ms. Jones, prior to my arrival, was to replace only one sliding glass door and the garage door w/motor at a cost of several thousand dollars. My question: What would be the noise suppression/insulating benefits, to Ms. Jones, of replacing only one glass door? Ms. Jones Townhouse is located in an extremely quiet neighborhood and would derive very little noise suppression benefit with new widows.

Her 1/2 h.p. garage door opener is only 8 years old and is in good working condition. We have all of our complexes garage doors inspected annually and Ms. Jones door will not require replacement for 4-5 years.  I asked Betty if she wanted that and she replied "no". I admonished Mr. Senderovich for his "high pressure" sales approach, told him I would be contacting his Manager and asked him to leave. In my opinion, Mr. Senerovich perpetrated "elder abuse". I cannot believe he was taught to apply this degree of pressure to vulnerable old ladies such as Ms. Jones.
 
Also, I did not and would not approve the architectural agreement because the sales agreement does not conform to our standards. The sales agreement would have to be cancelled and rewritten to include the installation on Milgard or Simonton brand, not "America's Dream Majestic S..." windows.
 
I thank you for your involvement and timely resolution to this unfortunate situation. I am hopeful no additional contact will be made with Ms. Jones by representatives of K-Designers.
