Agent, Kelly Mckenzie listed our home, Had a buyer that was supposed to be very ill. Agent asked if we would contribute 3% toward her closing, i said yes. Man knocked on my door and said he was the investor buying my lovely home, I was in shock. I called agent Kelly Mckenzie asked her who this person was , she said i thought you knew. I asked her how did we know it was a investor if you didnt tell us.
At that point I told her no deal on the 3% if buyer wanted the house he had to pay the 3%. We were supposed to close on the house 4 times, this so called investor is nothing but a used car salesman. He could not get his financing. So, i cancelled the whole contract.. In the mean time the agent kelly mckenzie gave the so called investor the keys to our house that we had all ready moved out of and he rented out the house and collected the money. We had to hire a lawyer and pay him 2,500 to get all of our documents the broker refused to give us that we had signed. The lawyer wants anothe $ 10,000. to take this case to court. Why should we have to go through this in order to get our expenses back. Oh, thats not all. The so called investor went in and painted the house, dropped paint all over the blue carpet and we have to have all of theis re done.
I listed the home with another broker that is very trustworthy in order to get the house sold.
where is my expenses, and damages??? Any idea>

What Ruth fails to mention is that she is the one who authorized our agent to give the keys to the buyer on behalf of his ill tennant. Per Ruth, "If she (the tennant) is sick then let her go ahead and move in early." We have a temporary lease agreement signed by Ruth allowing the buyer and tennant early access to the property. Furthermore, Ruth was aware that the buyer was indeed an investor from the very beginning.
Ruth is simply upset because she wasn't going to "net" what she originally thought because she had not paid her real estate taxes for 2 years (a point she failed to disclose to her agent). Once she saw her bottom line wasn't going to be as much as expected, she began looking for excuses not to close the transaction. I guess it is easier to point fingers and blame others than it is to look internally.
We tried to fax Ruth (who lives out of town) all of her paperwork on several occassions however her fax machine would never answer. Ruth's attorney turned down the case after speaking directly with me and reviewing all contracts and documentation.
We wish Ruth the best with her new agent.

There are a lot of people (used car salesmen included) purporting to be in real estate. First confirm the agent has an "active" liscence. As a former R.E agent it would seem that they conveyed the property to someone w/o you agreeing to that, see the possesion portion of your contract. The agent/broker likely violated any fiduciary responsibilty to the owner. GET EM!!!
