Kelly Services Termination without consent to work the next week Appleton Wisconsin
Kelly Services sent me to a company and I have worked there for three months as a temporary. One week they called me to go into work the next week, 1st or 2nd shift, & it didn't fit with my transportation schedule. The company we work/worked for is a swing shift place. Permanent workers, if they're scheduled to work a shift they don't want to, then they can trade shift with another permanent worker who works the shift you like and if you can't trade shifts at the end of the week, then you're stuck working on that shift for the week.
Kelly services did call and asked me what shift I was able to work the next week, but I told them that I'll probably call them in an hour to let them know which shift I was able to work. Instead I couldn't and didn't have the time to due to errands and also because I had to work overtime (1pm to 11pm. The shift starts at 3pm to 11pm). They then leave me a voicemail if I could work the next week so I can carpool with my boyfriend to get to work (he works at the same company). Unfortunatley, he wasn't able to switch shift and there was no schedule for any temporary workers to work 3rd shift otherwise I would sign up to work 3rd shift together with him so that I am able to get to work. They understood my transportation situation and for some reason it just became a problem to them.
I called them on the weekend and of course, the office is closed on the weekends, and I left them a message saying that I can't work the next week due to my boyfriend's schedule and he is my only transportation to get to work. She then tells me "You could get a ride from someone else to get to work." What the hell is that? She knew who was my only transportation to get there and if it didn't work out it didn't work out. She also told me "I have you scheduled to work 1st shift this week." WITHOUT MY CONSENT! When I left her a message, I told her that I couldn't work this week because my boyfriend could not switch shift to work 2nd or 3rd shift. He has school in the morning, so 1st shift is OFF LIMITS to work! She then tells me that I can NOT return to work at the company anymore because I didn't call in time and that she had me scheduled to work 1st shift WITHOUT MY CONSENT!
The voicemail she left me says exactly "If you could give me a call back, I would like to know what shift (name) works so I can schedule you to carpool with him." I listened to that message after work because inside work there is no service!
I don't know if it's wrongful termination or not, but she sure put me down on schedule to work without my consent/confirmation to work the next week! She has always asked me before "Can you work this/next week?" Whenever I said I couldn't work, it was never a problem because she could always find someone else to work for them. This time it was a problem to them, but it's more of a problem to me because I did not say that I can or can't work when we talked on the phone together. This is lack of communication.
I had another situation with Kelly Services before. I worked at the same company months before I started working there again and called every month to ask if they have any openings for the company because I haven't heard of a job opportunity from them in a long while and they finally tell me that I was not elegible to work there anymore due to bad performance. So I had my boyfriend talk to the HR and the HR told him that they were always accepting people and there was no problem with me, so the next day Kelly Services told me that I can work at the company the next week. Is this discrimination or something? Kelly Services is just pushing me around.
