On December 20, 2006, my daughter purchased a 2007 Ford Fusion from Ken Grody Ford, Buena Park, CA. She had gone down picked the car she wanted, went into the sales office making the deal. They told her with her credit and Ford Credit they get her 8.9 Financing and payments of $325 per month, with the down payment of $5000 of our 2000 Ford Excursion that was paid off, giving them our pink slip. So she then was taken to the finance office and also purchased the GAP Insurance and so her payments now were $338 per month. So she signed the contract and they gave her the keys to her new car.

Then we received a certified letter from Ken Grody Ford, Buena Park, CA, that she needs to return the vehicle as soon as possible with no explanation other than it had to be turned back to the dealer immediatley. So I called our salesman, and he said he would check into it, so he called me back and said it was taken care of, no problem that Ford Credit had called and was givin wrong information on her income, but it was taken care of.
Then on January 13, 2007, my daughter is driving on the freeway and her brand new 2007 Ford Fusion just turned off. For no unknown reason, it just turned off and would not stop. She was frighten because she was on the carpool with my other daughter in the car and two friends, and they were terrified of getting hit. Well a CHP came to there rescue and they got towed off the freeway and then she called roadside assistance and they towed the car to the dealer (Ken Grody, Beuna Park, CA). So then we call the next day and the service person says they dont know what's wrong with it or why it wont start, but now it has to go to the engine department so they can look at it, so call back on Friday. So we call on Friday, and they say that the engineer from the plant will be coming to look at it and so they gave us a rent a car for a few days. So then on Sunday, the salesman calls and says they are just going to give her another car, to come sign off on the contract and void it out and do another one and she can pick another one out. So we go down, and then the Manager "Joe" says, he is sorry about what happened to us about the car, and that they are going to be putting a rebuilt engine in that car and put it back on the lot and sell it to someone else who doesnt know anything about that car and it's problems, but for us to go to the office and sign off on the contract and void it out, and when gets a "USED" vehicle that fits her, he will call us and get her into it. WHAT?...I was fuming, my daughter started crying, I asked what was going on. Well then the salesman and manager said that it is because when Ford called to verify employment that they were told she made a small amount, then that she had only been employed for a few months. WHAT AN OUTRAGEOUS LIE!...we got a letter from her employer stating what her income is and years of employment, and the Manager said they cannot accept that and cannot resubmit it.
I cant believe this...They said everything was fine, and now the car is a "lemon" and they dont want to give her another one, and give her a cheap used car.
We left from the dealer that day and I will never buy a Ford Vehicle again! or recommend Ken Grody Ford, Buena Park, CA

Seller's Right To Cancel

AUTHOR: Natalie - (U.S.A.)

POSTED: Thursday, July 16, 2009

I am writing this rebuttal in response to the Rip off Report that was written about Ken Grody Ford in 2007. This rebuttal is merely to inform what the customer was told when she came to Ken Grody Ford to buy a car.

There are certain conditions that occur when someone requests a loan to buy a car. California is a spot delivery state. That means a customer can buy a car and drive home from the dealer that day with the vehicle before any loans are approved. Referring to the report the mother filed, the daughter had bought the vehicle, applied for financing, and had driven home with it that day. Unfortunately, soon thereafter the vehicle broke down, which is rare for brand new vehicles, but does occur. Upon returning the vehicle to our service department, we received the final outcome on her loan approval. She was not approved. She signed the contract in finance, and under California law, the final decision of loan approvals is with the bank, not the dealer. This occurrence is seen in only 2% of sales, and happens across the U.S. This is Seller's Right to Cancel, verbatim, that the daughter signed in finance:

Seller's Right to Cancel:
A. Seller agrees to deliver the vehicle to you in the date this contract is signed by Seller and you. You understand that it may take a few days for Seller to verify your credit and assign the contract. You agree that if Seller is unable to assign the contact to any one of the financial institutions with whom Seller regularly does business under an assignment acceptable to Seller, Seller may cancel the contract.
B. Seller shall give you written notice (or in any other manner in which actual notice is given to you) within 10 days of the date this contract is signed if Seller elects to cancel. Upon receipt of such notice, you must immediately return the vehicle to Seller in the same condition as when sold, reasonable wear and tear accepted. Seller must give back to you all consideration received by Seller, including any trade-in vehicle.
C. If you do not immediately return the vehicle, you shall be liable for all expenses incurred by Seller in taking the vehicle from you, including reasonable attorney's fees.
D. While the vehicle is in your possession, all terms of the contract, including those relating to use of the vehicle and insurance for this vehicle, shall be in full force and you shall assume all risk of loss or damage to the vehicle. You must pay all reasonable costs for the repair of any damage to the vehicle until the vehicle is returned to Seller.

After reviewing this mother's rip-off report, the owner of Ken Grody Ford feels that this report is not accurate. The customer was not ill informed. Upon signing the Seller's Right to Cancel, she was aware of the ramifications of not being approved for a car loan.
