I had paid down half on a truck. I've been paying $75.00 every friday to the car place for about 2 months now. I've been taking advantage of the grace period which is ten days. The general manager is the one who told me about it. The one time it went over ten days the system did charge the late fee, but if I went ten days the system didn't charge a late fee.

Well the car place repossess my truck in the middle of the grace period. Ken said there in no such thing as a grace period. That there allowed to take it. But I have my receipts where I have paid it in the middle of the grace period before and no problem. Like I said the manager is the one who told me about it, even though it's not in the contract. But still my receipts do reflect a grace period. So I just don't understand how they are able to do this. I thought a grace period is suppose to help you not hurt you. When I brought it up to him that I took advantage of the grace period before he said that maybe they just over looked me.

In the system they put that the last day I came in I told them I had no job and yet it's impossible because I been working for the last two weeks. They also put that I'm planning on skipping town and going to New York. All I did was ask them if I wanted to move to New Jersey could I pay every month instead of weekly. Which is no time soon because I don't even have money to move. It was a general question. So I could start making plans.

MY ACCOUNT SHOWS I'M CURRENT YET MY TRUCK IS REPOSSESSED. Because of the grace period I owe $125 but my account shows I'm current.

These guys felt sneaky and my gut told me not to do business with them. They offered me alchoholic beer at the time of the signing. So these guys are unproffessional.

Understanding Grace Periods

Ken was right, there is no such thing as a "Grace Period" when it comes to a Repo. The Grace Period refers to the late payment charge and not in having your car repossessed.

The company who holds the title on your car can Repo your car at ANY time. Until you pay off the loan it is their car and they have the legal right to repo it. So there is no RipOff here.

However, to make sure this does not turn into a RipOff you need to find out the specific laws for Repo's in your state. In most cases they need to give you an opportunity to get the car back by paying the Repo fees as well as the back amount or by paying off the loan. If they do auction if off and sell it for more than your loan balance was they are required to give you the difference back(minus any fees).
