I had trusted Kimberly Diaz with my paperworks in order for her to help me find a loan. She is nice, but that was what fooled me. This woman took all my sensitive information, some original tax returns and photocopies of my social security and ID #'s.  After 2 weeks of not hearing from her, she has been rejecting my calls and not returning my messages. She knew I had a house in escrow and I needed help. I ended up leaving her messages demanding that she return my personal documents, and she has not responded. 
  I am afraid she has sold or will sell my personal information to the black market. Although I have no proof(yet) I am filing a complaint with the FBI. I am about to lose the house I wanted, and the money I put down in the escrow.  I found out recently that she had victimized other people too, she takes all their personal information and vanishes.
   Stay away from her, I urge anyone else who has fallen victim to please report her to the FBI. [continued below]....
..... Kimberly is also a licensed Notary in California.

If you are looking for a loan, go to a credit union or a bank like Wells Fargo or One West.  I learned my lesson, please do not make the same mistake as I did.

You have it all wrong.

You have a loan approval and you still do. You were given it and told there are lender conditions. You and your husband just kept telling my associates that you sent in the conditions. I will admit, you did provide a lot of conditions prior to the loan being submitted, but once an approval was issued, the lender requested additional items. This is not uncommon and I understand you being upset. However, I personally asked the listing agent to provide an extension till the 28th of November. I never did get that, but I did submit the loan anyways. The reason as to the first approval being canceled was only because the broker no longer works with that lender. Please understand that is not in my control. I am NOT the broker. I don't control what lenders we may work with.

Thankfully I still requested that your loan be submitted to three lenders because I was asked to by your husband since you needed a larger loan amount. Escrow, your agent as well as you received a new approval. Should you have provided the quested conditions, you would have closed escrow about a week ago. It was even suggested you and your husband personally take the conditions to the underwriter at Penn Financial. Not one condition was received after the approval. I also never told you to release the funds, but I did say that it was reviewed by the processor and it meets all guidelines.

For the record, NO loan is 100%. I have even witnessed a loan fund then unfund. So, I personally know anything is possible in this industry. For me to personally tell you to go right ahead and release that amount of money is not something I would say.

I really am so sorry you are displeased. I truly am, but no lender will provide loan documents without the final conditions and your husband just kept arguing that documentation was submitted prior to submitting is not going to get anywhere.

As for me not calling you, your original broker sent me a formal email to never call you or contact you. I assumed you went back to her. I still wanted to help, but I was threatened with a lawsuit if I did. That is why my associates contacted you and attempt to still help you. Just because I didn't call you, does not mean I was ignoring you or stop working to help.

I would do anything to help my clients, but you knew I got your file nearly four weeks after you opened escrow. You also put $20,000 in escrow without being as much as pre-qualified, I was not given an extension and was not provided final items to close escrow. I'm sorry, I simply won't have a leg to stand on with these obstacles.

Should you feel that I have stolen you identity, feel free to contact me and I will personally have you speak to my attorney to assure you that I would never do such a thing. Identity theft was your chef complaint and now it's not closing escrow.

I hope I addressed all if your issues. Should you need anything else, please email me. I assure you, I won't ignore you. I will do all I can to help you personally.

Ridiculous, these previous responses are from Kimberly herself.  Something that I had left out, that is worth mentioning here : I had been informed by Kimberly to go ahead and release my funds of around $20,000 to the escrow company. She then presented the escrow company with a falsified bank letter stating that I was approved for the loan.   Few days later, the escrow was the one that notified me that they had contacted the bank and found out the letter was fraudulent.  I personally contacted the bank myself and they had no records of my name, nor Kimberly's.  That bank even informed me that this practice is a common ongoing crime, and that I have fell victim to it. 
   ATTN Kimberly; I am the person who was looking into getting the house by Venice/Fairfax.  You need to know the people you keep scamming because when it comes time to face the federal judge, you wont have a strong defense. 

   For others who are reading this, my situation has turned to the worse. I had lost the house, and now I am battling the escrow and their lawyers for my money.   Thank you Kimberly, you will soon get what you deserve once this is all over.

Please note that I, Kimberly Diaz never at anytime had a client by the name of Robin Rosecrans. I also have been going through all files to confirm I did not missed a displeased client by this name. I am at lost for words regarding this complaint and I'm kindly asking you to personally contact me should you have any concerns regarding a loan or your personal information you believe I have. 

In all these years in the industry, I have never at anytime been accused of what you are claiming I have done and as you stated, you are not a victim of identity fraud at this point. Your comments stated you are "afraid" I will steal your information with the intention of selling it. This allegation is absurd. I have never nor would ever do such a thing other than get my clients the loans they have requested me to do. 

Please also be assured that all clients information is kept confidential...indefinitely. At this point of my career, I relay on referrals and would never do anything to sabotage this. 

Once again, please contact me personally and should I have your information or should you like to resolve any other matters, I will do all I can to make sure you as well as all my other clients are satisfied and comfortable with my service.

I just saw this comment regarding Kimberly. I was Googling her number because I lost my phone and needed to refinance my property when I stumbled onto this. 

I have refinanced with Kimberly over seven times and in the process of doing it again. I have never at anytime had an issue regarding identity theft from Kimberly at anytime. In fact, after the second refinance, I no longer pay for my appraisals or credit reports. I saw that you are claiming she might sell your information on the "black market" which is a very strong accusation especially when you also claim that she has not or at least you don't have proof of anything like that being committed at this time. 

I assure you, Kimberly will not take your information and sell nor share it with anyone other than those involved in the loan (processors, broker, bank, etc.). I am truly sorry you are displeased with Kimberly and yes, at times she is hard to contact (try texting and emailing her as it's usually better).

I can't answer as to why Kimberly would not answer your calls, but from the accusations you have made, I don't blame her.  

I have honestly never had a problem and my mother just purchased a home from her as well. At first, I didn't think it was the same Kim, but when you blasted her pictures all over, I knew we were talking about the same person. 

If after a reasonable time your "identity" has not been stolen, it would be kind to correct your allegations. As for you losing your down payment. I am sorry. Keep in mind, she doesn't get paid till your loan closes so why would she not want to close it?? 

Your emotional and upset and are venting on this website. If you are still in escrow, email her and I'm sure she will help. I personally will be contacting her to inform her about your comments and concerns. You also stated you will be going to a CU or a bank (which you are not even sure about that) so how can you be so sure on the actions of others?? Don't ever assume peoples actions. You did say one thing correct. She is very nice and always on top of the files. There have been times she is simply too busy, but her team jumps in and helps. Good Luck on your home, I'm sure everything will turn out fine.
