 My boyfriend fathered a child with a  then-girlfriend; the relationship ended a few months after his child's birth. For seven years of the child's life, Jason paid his ex girlfriend thousands of dollars, most of which was gambled away at Chumash Casino by his ex, he had given her a credit card for child related expenses that he paid for until he learned that purchases such as hair and nail spa appointments and such were being purchased with the card; and Jason also purchased a truck for her that she, in turn totaled, so He gave her the ninsurance money so she could buy anoither car, but instead she gave the money to her then boyfriend to pay off his truck, who left her shortly thereafter. Two days after his son's 9th birthday, Jason's ex started an argument and decided that she would no longer allow him to see or speak to his son. His last words to his son were to tell him to "always remember Daddy loves you and I think about you every day." This was the most heartbreaking day of his life. His son was his world.
Jason's ex has never filed for and was never awarded child support relief money; she had applied for MediCal healthcare while living in Ventura County for their child because of a minor medical condition of the child that requires ongoing treatment. Shortly after the MediCal benefits were awarded, Jason's ex moved to Chico, in Butte County, CA, some 500 miles north. The county DA took it upon themselves without filing of paperwork to them by Jason's ex, to assign a judgement for Jason to pay child support payments. Jason made payments and cooperated and communicated with the Child Support Agency for  years. When his work decreased and he had trouble making payments, he kept the line of communication open with the child support agency in Butte County. He shortly thereafter had his driver's license suspended for non-payment of child support, but still he kept the line of communication with Butte County open. Then, he recieved a call from the Butte County DDA who proceeded to threaten Jason with "hunting him down", and demanding that Jason "turn himself in to the police" and was very verbally aggressive and threatening and demanded that Jason drive 8 hours to appear in Butte County court. Jason directly informed the DDA that the means for him to travel to Butte County did not exist but the DDA asserted that Jason was "making demands" and that he will either show up or be arrested and sent to jail. "I will make sure you do jail time" was a threat told to Jason by the DDA over the phone. Jason found this level of aggression toward himself very unacceptable and unprofessional.
In July 2011, Jason became injured accidentally at home and has not been able to work due to the injury (2 herniated discs) which also combined with a pre-existing condition of Terrette's Syndrome that causes him to twitch uncontrollably further aggrivating his back, a heart condition and a severe duodenal ulcer has rendered Jason disabled. He cannot stand for more than a few minutes without pain, he cannot walk more than 20 yards without pain, and he cannot sit up in one position for more than 45 minutes without pain. Basically, he lives each day in a great deal of pain, hence, gainful employment is an impossibility.
Jason never attempted to apply for a child support modification because he could not afford lawyer's fees that would be required to handle this for him and he had no means to travel north 8 hours to appear before the judge to explain himself, and coupled with the threats of an overly aggressive DDA who was seemingly "out to get" Jason, he had no desire to show up in court to be witch-hunted by a DDA with a hidden agenda, a chip on his shoulder and a personal vendetta against men whom he percieved as dead-beat fathers.
I have been supporting Jason as his significant other since his injury in July of 2011 and have been his caretaker, overseeing his medical care, and taking him to doctor appointments. Jason was arrested in July 2012 for traffic warrant and was extradited to Butte County on a $500 bond for failure to provide child support. He was assigned a useless public defender, Kristin Cobery. She bid for the job of public defender, yet she blocks calls from inmates from the jail, refuses to take or return calls from inmates' significant others and also refuses to return emails. Upon realizing that Jason's court appointment attorney had no intention of even pretending to properly represent him in court, I single-handedly negotiated Jason's release from Butte County Jail which was agreed to by Jack Schafer himself in July of 2012 with the agreement that $1000 be paid immediately and regular payments be re-established by Jason. I borrowed money from friends and paid the money immediatley owed and Jason was released from the jail 2 days later. He remained in Butte County, staying in a local motel that I paid for with borrowed money so that he could make a court appearance for his case. Upon arriving at the courthouse for his mandatory appearance, he located his court appointed attorney, who was very disinterested in helping Jason in any way; quite the contrary, she was more than willing to agree to anything the DDA requested and disregarded everything Jason told her about his case. Ms Cobery complained of lack of discovery on Jason's case. Jason then informed her that her phone number was blocked and he could not call her and I, his significant other had been attempting to contact her for weeks. She angrily retorted, "I dont take JAIL calls and I don't take GIRLFRIEND calls either!" When I asked "what about my 6th ammendment rights?" she became even more hostile toward Jason refusing even further to adequately represent him. Jason turned to the judge and asked for a different lawyer to be assigned his case due to an apparent personal problem that Ms Cobery obviously had with Jason that was going to obstruct her from representing his best interests. The request was instantaneously denied by the judge. Then in strolls the DDA, Jack Schafer, late and looking like a homeless drug addict with his hair tossed assunder, at least 3 days growth of facial har and wearing a completely wrinkled suit.   DDA Jack Schafer, who seemed extremely aggitated and hyper, was suggesting jail sentencing for Jason's charges, to which he rebutted that an agreement had already been made days earlier by DDA Jack Schafer himself. Jack Schafer stood in front of the judge and lied saying he had no idea what Jason was referring to and no money was received and no such agreement had been made. Then Mr Schafer turned toward Jason in an aggressive manner, leaned his face down to Jasons level and growled at him saying "And might I remind you, I don't work for Child Support Services; I work for the DA!" Jason turned to Kristin Cobery and attempted to gain some sort of advisement or reassurance from her, but she merely shoved her card in his hand and curtly told him, "I'll see you up her in 30 days"; then she quickly stormed off, refusing to speak with Jason any further. Feeling that he would not recieve proper and adequate representation, not being able to afford a private attorney, and Ms Cobery's continued blatent refusal to take or return his calls, Jason did not appear for that court date.
In January of 2013, after months of repeated and failed attempts to make contact with Ms Cobery via phone and emails, an attorney who had been handling an unrelated case for Jason offered to make a call the Ms Cobery to see if he would have any success. She did, in fact, return the lawyer's call rather quickly. The lawyer immediately called Jason and told him to call Ms Cobery immediately, that she would be expecting his call. Jason did as instructed ans actually was able to speak to Ms Cobery on the phone for the fisrt time. During their conversation, she informed Jason of a new court date for his case but told him not to worry about appearing in court due to the extent of his injuries and the hardship that traveling that far would cause, she would "take care of it". He had hope that she had, had a change of heart and was actually going to help him. As it turns out, she did not "take care of it" in the way that she had lead Jason to believe she would. About 3 weeks after the hearing date, Jason was again able to speak with Ms Cobery on the phone, but only after using the previously successful method of the seperate lawyer calling her first. During this conversation, Ms Cobery denied ever telling Jason that he would not have to appear in Butte court and very curtly informed him that he now has a $15,000 warrant for his arrest for failure to appear. She "took care of it" alright! The DDA is gunning for lengthy jail time and it seems as though the public defender who is assigned to his case is doing everything she can to sabbotage Jason's case so that the DDA can seemingly make an example of Jason. We need help and we dont know what to do. we will do everything you tell us to do if you are sure you can help Jason right this horrible injustice to himself and his son
