Have you ever gone to sleep knowing that your family was taken care of,the bills were payed, you had iinsurance, there was food in the fridge,money in the bank and there was even money in savings.

You had a job that you liked and felt good about doing and felt that if you could just keep healthy and in shape for a few more years that maybe in 6 to 8 years that you might be able to slow down just a little bit,and relax a little.Well thats how my husband and I went to sleep one night earlier this year and the next morning with one 5 min. phone call from someone that we did not know or had ever met are lives changed forever.

My husband and I worked for United Van Lines as owner\operators he has been driving for about 24 years and I havebeen in the business for about 14 years and had been his co-driver for the last two years.Anyway needless to say we both have had our share of random drug screens over the years and have really never had given much thought to them until that beautiful July afternoon,when everything as we knew it ended.It was July 15th 2002 about 1:30 in the afternoon and we had been home all day,my husband had,gotten called in on a random drug test on July 9th and like I said we were used to complying and you only have something to worry about if your breaking the rules Right? and we were not so it,s just another drug test and when your test is negative you seldom hear from anyone telling you so.

Well the phone rings and it,s our dispatcher telling my husband that he needs to call the medical review officer (MRO) something about his S.S. number not being correct on the CCF.custody control form.

So he took the number and called the MRO and she got on the phone and practically started yelling at him telling him that he had tested positve for methamphetimine and did he have any medical reasons for this.Iwas standing there and had come to the conclusion by the look on his face that this had nothing to do with his S.S. number being wrong.She would not let him get a word in edgewise and he had no idea why the test had come back positive and did not have his perscriptions ready to tell her what medicines he had been taking, and I don,t think that even had she given him the chance to get them that he could of told her, he was in total shock,and she was not helping the situation any.She was talking to him as if he had gone out and killed a bunch of people including children and the pets to.

It never once occurred to her that maybe if she would of handled the verification process like it was meant to be that maybe he would be able to calm down, enough so she could ask and he could answer the questions that were going to decide our future.Well she ran through her speach and at the very end instead of giving him the five days that she is aloud, to get his medical records togather and meet with his physician to figure out what had he been taking that would register positive for this drug,instead she told him that he had 72hrs.to request that bottle B be tested,and then the interview was over and she hung up.Needless to say my husband was in major shock and disbelief, and then he said she gave me 72hrs to request that the second bottle be tested,he was like what should I do?It really does not make much sense to me.

If the first bottle tested positive that the second probably would to,but being that the verification by the MRO. and the split specimen ( Bottle B) being tested to reconfirm for the drug metabolites found in the primary specimen.are what all these people that made all these rules for us to live by, call a safety net, this is believe it or not in thier minds giving the driver, pilot captian ect. the benefit of the doubt.YEAH RIGHT.Well it is January now not July and we no longer have our beautiful truck or our jobs my husband has been lucky to hang on to his CDL because that is the first thing that they do, is disqualify your commercial license unless you can come up with some proof that someone screwed up somewhere and it needs to be reviewed closer,the fact that his license has not been yanked yet is one of the only positive things that has happened, and that could change any minute.

There is not any recourse,everyone is in bed togather,it all sounds good in the federal motor carrier safety regulations but I can tell you from many hours of research that these rules are not to protect the innocent people from people in safety sensitive occupations that are or have been on drugs.It is very plain that this is Money making scam for all involved.

It is just such a shame that people involved in this are not any better than the people that they are destroying on a dailey basis and I am sure not even giving it a second thought This whoe situation is kind of comical just for the simple fact that the the industry that they are claiming to be saving us from is probably less corrupt then the one that they are all involved in These people have to answer to almost no one.

They have their little inspections and all that but I don,t see were any of those organazations involved in the accredidation process spanked labone for it,s bad behavior, and I am sorry but they screwed up quite a few peoples lives I bet that most still have not recovered from their extended nightmares.

FOR THOSE OF YOU THAT HAVE TO TEST, KNOW YOUR RIGHTS AND IF YOU HAVE TO GIVE A RANDOM,AS SOON AS YOU ARE FINISHED GO IMMEDIATELY TO ANOTHER HHS APPROVED COLLECTION SIGHT THAT USES A DIFFERENT LAB AND GIVE ANOTHER SAMPLE THAT IS TESTING FOR ALLTHE SAME DRUGS.

THIS IS ONE OF THE ONLY THINGS THAT YOU CAN DO TO PROTECT YOURSELF JUST A LITTLE BIT.

Also if at all possible if it were me I would try to stay away from testing at this lab LabOne Lenexa KS. Go to the delta airline sight A.L.P.A. and look in the news articles for 1999-2001 this lab should not even be allowed to do testing of anykind let alone the kind that can wreck a persons life.United Van Lines and every employer that uses third party services, it is their responsibility to keep track of their 3rd party contracters and be on top of who been cited or issued a Public Interest Exclusion.If a pie has been issued that company is negligent if they are still using them.But as you can see United Van Lines does not care, Delta airlines switched to quest labs after LabOne was suspected of falsifying records.there is a statement out there that states why.

Why, probably is because the fired a bunch of people due to LabOnes Sloopy work and documantation and judging by the 6 pcs. of paper that we got from them and the MRO at EMRO. they still don,t know what a full data package consist of and that the employee is supposed to have full access through the MRO to all data concerning their drug tests.

The employer is supposed to maintain copies of all these records to, but we only got 2 copies of the certificates that the MRO. made up instead of sending the CCFs Like we hadrequested after we made three written requests to the MRO for ALL DATA concerning my husbands drug test including the random he had in May,Quanitative levels,internal CCF shoes everyone that had anything to do with the urine and tests also my husband ordered taht the second bottle (B) be tested.it was ordered on the 15th of July and the lab 5 miles down the street did not receive it until the 8th of Aug. which made it so we did not get the results unilt the 14th of Aug. which had us waiting for one day shy of a month from the first results and we could not work until those results were back due to our safety sensitve position.

Not one time did the person Jack Montgomery contact my husband and see if there was anything that he could do Hell we could not even get him to return our calls.And I find this suprising seeing how my husband has 5 back to back safety awards which according to the letter that they send with the certificate he is in the top 5% of the drivers at United,But they can,t even call him back and give him a little respect for being the driver that just in Feb.they thought was great.

This is a guy that has worked for United for about 15 years, and has always had a good driving record and has never had a problem taking a drug test.Not only did he Jack disqualify my husband from driving for United he did not even have the common courtesy to write him a letter telling him so!!!!!!!not to mention he informed a number of people that they were not to discuss this situation with us.Which left us hung out to dry,waiting for the other results to come back.Remember Everyone, read your Federal motor carrier safety regs. make sure that it is the most current issue and if you do drive for someone remember that they can add their own rules and regulations also.
