We signed up with this tax law firm to help us in an Offer in Compromise with the IRS. We were told before signing up that we did qualify for the Offer in Compromise, that it should take about 8 months to settle and according to our assets and income, the IRS would settle for about $400.00.

On this information, we signed up on August 13, 2001. We paid them the full amount of $2250.00 two month earlier than was expected from them.

We submitted everything they asked us too and by the time they requested, but kept on requesting the same information as they had obviously lost our documents.
We were never able to speak to an Attorney, and everytime we got a letter from them, it was from a different person. We were never assigned to an attorney or at least we were never told who our attorney was.

We were never given any advice or instructions except requests for documents.

On 3 September, 2002 the IRS declined our Offer in Compromise due to not having submitted 1994 & 1995 tax returns and for not submitting quartely returns for the year 2002.

I contacted the attorney's office and sent them proof of us submitting the 94 & 95 tax returns, not only to the IRS but to their offices as well. And we found out from the IRS that it was not illegal for us not to submit quartely taxes, but the main concern to us was that as our legal council they should have told us that we had to or should have been submitting quartely. They never did.

Since I was able to prove to them that the decline of the IRS was not due to any fault of ours, they have tried everything to make us fire them as our representitives to the point of even asking us if we wanted to fire them. If we do fire them, they are not required to refund us our money and so we cannot fire them.

They have since sent us a letter indicating that we were not in compliance with the Tax Regulations as they had stipulated and that they would consider submitting an appeal as a "professional courtesy to us" on condition we submit our 2002 tax return by 5 February 2002. My husband is an independant contractor and we recieve 1099's with which we use to fill in our tax returns. The deadline for a company to send us the 1099's is Januruary 31, so that gives us 5 days to prepare the return, file it, pay any amounts owing and send them a copy. They also told me the deadline for companies to send us 1099's was December 31, which is a lie as we found out directly from the IRS that it was January 31. They also know that we will not be in a position to pay a tax liability by February 5 instead of when all returns are due in April.

I have found out from an ex-director of the company that they use certain methods to force clients to fire them as council in order to not represent them further while keeping their money.

They have been rude, misleading, unco-operative, have refused to take responsibility for not representing us as they should have which led to the decline from the IRS and if I had not kept records of everything we have done, they would have been able to resign as our council as I would not have had proof that they misrepresented us. But because I have proof, they are still insisting that the fault lies with us and are now making unreasonable requests to force us to fire them.

We are now in a position where we cannot comply with their request which will give them the excuse they need to resign as our attorney, leaving us with an unresolved tax problem and $2250.00 poorer.

I am a paraplegic with complictions and my medical costs alone come to $6000.00 a year. We are already stuggling financially and are classified as boarderline poverty. We cannot afford to be ripped off like this not to mention the gaustly treatement we are recieving from them.

They need to admit they did not represent us as they promised they would, were responsible for the IRS declining our Offer-in-Compromise, and take responsibilty by working with us to rectify this matter as they promised to do when they took our money.
