Can eBay Prohibit Users from Filing Class Action Lawsuits?

I read so many commenters that state that eBay has been breaking the law all along.What specific laws are they breaking?I doubt seriously if most sellers become even familiar with the laws of finance and business.They operate off of emotions rather fact.

I would think that eBay is totally fed up with the number of class actions that are frivolously filed.Not only is it expensive but it takes a toll of personnel time.Everything costs money.

If sellers took their business seriously rather than with a 'garage sale' attitude,more would be better able to function in a competitive world.Crack the books,take a few business classes at a local community or state college.Knowledge is power and ignorance reaps it's just rewards.Or another way of looking at it is that"Half measures availed us nothing".

"In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law."

Allow me to follow that up with another quote which seems rather appropriate here:

We all get your message that you are sure you are smarter than the rest of us.
The constituion clearly shows our rights when it comes to civil suits. What gives ebay the right to trump the Constituion? You have to give up thyat right br agreeing to their user agreement and policies. IT IS AS SIMPLE AS THAT. Ebay is giving you the right to opt out because it is unconstitutional if you do not agree. To protect your constitutional right to file a civil suit opt out of ebay's new policy. Class action?  Your better off going at it alone. My sales are down 50% for August so far. I am selling more and more elsewhere. I am getting fed up with ebay and I see the end is near for small sellers. FILE A COMPLAINT asap with anybody and everybody and ask congressman, senator and state attorey general if ebay is allowed to violate your rights. You can also find the state that the two attorney's for ebay who signed this policy change and file a ethics complete agaist them with that state's bar association. This nothing but unethical and sleazy. JAIL JD!!!

Contrary to the rest here - I DONT think you are smarter then everybody else nor are you more aware of how eBay operates.

Ive been in the electronics business since 1984 and have worked for MANY of the multi-million dollar companies that you have heard of here on the East Coast including but limited to 47th Street Photo, Sixth Ave Electronics, Datavision and others.

I now run my own business with the contacts I have and I do between 500K and 750K per year - I am NOT some part time garage seller.

I take it personally when YOU or eBay insult me or my company.

I was accused by eBays buddies - SKULLCANDY of selling counterfeit goods. eBay refused to be involved, refused to see the invoices FROM THIER OWN DISTRIBUTOR - and I had to spend out of pocket and threaten a lawsuit to get it dropped. NO appology of course from either company.

Ive been VERO'D more then a few times - based on laws that have been already decided - stone cold case law - and eBay looks the other way. If I could afford the $ and the time - I'd d**n well sue them in a heartbeat. AND - I'd go to France and testify on Vitton's behalf.

Threaten me or my familys future and I WILL take it to what ever level it needs to be (them not you).

eBay was asked BY SKULLCANDY to remove sellers that they didnt approve of - SKullcandy went as far as putting the illegal verbage on their website ''items purchased here can not be sold on eBay/Amazon''. It was taken down ''coincidentally'' after I and 3 other eBay sellers had attorneys write them letters. When enough sellers were chased away, eBay gave them an anchor store, front page viewing, deal of the day and MORE.

They did it for Sony as well, as well as Monstercable and others.

Its ALL about the FVF's.

I know it - as I'm involved in it!

Denon is using a UK law - which is NOT applicable to US sellers to keep US sellers from selling world wide - that too is a crime - and eBay says NOTHING.

Paypal holds? If you cant take the risk - stop processing cards. Paypals record on legallity, customer service, money holds and more boarder on criminality - and they have been caught many times.

I got my hold removed - I simply threatened a Class Action Law suit - asking them to PROVE why they have the rights to hold my money.

d**n straight - I take it personally.

I wont talk for anyone else here, most here are as smart or smarter then me (ric, annie etc) and dont need me to speak on thier behalf - but I guarentee you that they take thier business (in what ever capacity they are) seriously and arent one of the fly by night rip off sellers that eBay has problems with.

DONT treat us like children - dont ignore us when WE pay all the fees and have all the headaches - treat us as you want to be treated.

Now go back to what ever rock you crawled out from under!

I am the Larry Dickerson in question, and I can promise you that I have no idea what this is all about. Clearly this so-called "evidence" has been made up by a psychotically obsessed stalker, who should probably consider getting some serious mental help.

EVERYTHING that Geoff Holland says is a lie. He is a known liar all over the internet. NOTHING he says is true. Do a search here for all of the reports against Geoff Holland or Gbayemporium and you will see exactly what type of person he is. Geoff Holland has a grudge against Larry Dickerson and I can prove that Geoff Holland is a dangerous internet criminal. Judge for yourself once you see all of the reports and links.

This sad little man has nothing better to do with his waning years than spread hatred and create trouble. I've been told that he is an alcoholic, that he beat his wives, and that his refusal to give shelter to his daughter (possibly a step daughter) forced her to live on the streets where she eventually died from a drug overdose. Clearly the anger he has for himself is directed instead at anyone who dares to stand up to him and question his conduct. He hangs out mostly on the eBay blogs, where he is hated by many. He stalks people who cross him, he has used family members against each other only to get from one information that he then tries to embarrass the other with, and he makes disgusting and crude remarks that often are racist and definitely are sexist. He constantly accuses others of hacking his computer, or his accounts. It seems he only does this to try and make it seem that someone else has sent out the garbage that he constantly sends out. I have been informed that at least one person has filed a restraining order against him due to his internet stalking. One of his most odious comments is reprinted here.

"If you actually think I give a rip about 95%of you folk you are sadly mistaken.As in real life,I wouldn't have as thing to do with most of you ,so get over yourself and the self importence that you have placed upon your head.I take care of Larry and anybody of my choosing.I don't care and I am not willing to listen to a bunch of blog biddies that should be taking care of a home,children or working.Maybe better care of themselves.You can copy and paste this all over the blogs or anywhere else you choose.I watch the feedback scores and how little they raise.I even go to he feedback page to see the number of non measurable feedbacks.Ain't none of you doing that great for all the work you put into it."

Under his "troubadore9" ID, he was found to have posted a comment on a dating site indicating that he intentionally stirs up trouble on the eBay blogs because he gets bored. Surely one would think that a 67 year old man would have better things to do, but no, this is exactly the type of person he is.

This comment was made to him by his ex-blog wife, BJ. Seems she knows that his claims of sobriety are complete garbage, just like most others think.

"How many times i told you to get help?? How many times i told you i wont fight with you because you feed off it, then you threaten me telling me i made you start drinking again... how dare you, call that phone number or better yet i will have him call you.. You can tell him all the juicy details (which he knows cuz he was with me on several conversations you and i had.. so there.. get over it its done and thats my fianl answer.. Now hit the road jack..."

And this is his methodology for stalking people. Pretty sad/scary, isn't it? Essentially this person cannot be trusted. Everything they do has a motive, everything they say is probably a lie. Do not trust this person, do not do business with them, do not even say hello to them online if you ever come across them.
