I entered into a contract with leanlifepm.com on 12/5/05 when I signed up to receive a sample of the product for the price of $6.95. The contract clearly stated that if I did not notify them to cancel the auto-ship program after 14 days of being billed for the sample then they would automatically continue to ship the product to me for the price of $99.90.

In accordance with the contract I sent an e-mail to cancel my auto-shipments 12/7/05. However even after receiving the notice to discontinue auto-shipments they preceded to bill my card for the sum of $99.90 on 12/16/05.

While my first assumption was that this was a mistake that could easily be corrected, but I was soon proven I was wrong. Since that time I have made over 10 phone calls to the company and its various numbers to try to get answers, but they never bother to call back.

Although it did take about 20 days for me to return the product to the sender, due to my inability to access my university mailbox over the holiday, I did write return to sender and mailed the product back. I did not pay extra to provide proof of the return for two reasons.

First I did not think about it and I was instructed by my university post office as well as my bank, Bank of America, that it was not needed.

Second because I was no longer in contract with the company, assuming the contract ended with my notification of them to discontinue auto-shipments, the item could be considered a gift under which I would have no obligation to return it.

I have tried in good faith to correct the matter, but the company is quite apathetic. I am now under assumption that the charges are an act of fraud and in breach of contract.

I am currently considering back-charges though the bank, and will press legal action if my account is handed to collections.

Until this matter is settled I would like to reserve the right to peruse any and all legal actions both personal and criminal through both my home state, Texas, and Utah.

It is my hope that the company will quickly refund my money and discontinue to ship any products to me. I have documentation of all events and will be happy to provide it upon request.
