The following represents the facts regard my purchase of a SeaFox boat and Suzuki outboard motor from:

Legacy Fisherman, Incorporated
10 Bryan Road
Dania Beach, Florida 33004.

Hereinafter Legacy Fisherman, Incorporated with be referred to simply as Legacy

On February 14, 2009, while attending the Miami International Boat Show, I enter into an agreement with Legacy to purchase a SeaFox 216 center console boat and Suzuki 200 horsepower outboard motor. The purchase agreement specifically states that the Suzuki 200 horsepower outboard motor is to include a 6 year warranty.

The total sales price was paid by wire transfer with the final payment being made on March 18, 2009. I took delivery of the boat and motor in Florida on April 4, 2009. Again the Final Bill of Sale presented to me at the time of delivery, clearly states that the motor is to have a 6 year warranty.

Around the middle of May, having not received anything from either Suzuki or Legacy regarding the 6 year motor warranty, I contacted Suzuki Marine.

Suzuki Marine stated that, though my purchase was indeed eligible for the 6 year warranty, I had declined the warranty and elected to use the cash towards my purchase and I, therefore assign it to the dealer. Suzuki Marine produced the Gimme Six Promotion Form as proof of the above stated election.

This form was NEVER presented to me by Legacy. The signature of my name on this form is a forgery.

Apparently, Legacy uses a person (Melanie L. Whitney, North Carolina Notary Commission # DD717398 ) to process purchase documents. Ms. Whitney is located somewhere in North Carolina. It is my belief that without my permission she or someother Legacy employee forged my signature on the Gimme Six Promotion Form. This forgery allowed Legacy to receive a fraudulent monetary payment from Suzuki. In her email, of June 1, 2009, she admits that an error was made in processing and that I am clearly due the 6 year warranty. And on Legacy's behalf she requests 30 days to resolve this matter.

After 30 days, having no communication from either Legacy or Ms. Whitney, I tried to contact Ms. Whitney. She refused to respond to either my telephone calls or emails.

I did however speak to a Mr. Spano at Legacy who identified himself as the owner. Nicely put, he was disrespectful and discourteous. In his abrupt manner he simply said I will get the 6 year warranty when he gets it worked out.

I have been more than patient. As soon as possible, I will retain local council in Dania Beach. My intention is to file a civil proceeding immediately. Secondly, I will seek advise regarding the possibility and process of getting criminal charges of fraud and forgery in Florida and North Carolina. And finally, because this matter was handled between States and using the US Postal Service I will contact the US Attorney's Office responsible for Florida and North Carolina to seek federal criminal indictments.

Legacy Fisherman admitted to all fact in the report. They finally took the steps necessary to secure my 6 year warranty. The problem for them is that they have lost my trust and goodwill. Because of their behavior, I could never enter into any kind of agreement with them in the future. Even though they do offer good products at good prices, they cannot be trusted.
