Discriminatory Action of Lexus Financial/Toyota Motor Credit

To Whom It May Concern:

On the 6th of September 1999, l walked in to Lexus of Massapequa (Lexus Car Dealership) in Sunrise Highway Long Island, Nassau County.

I inquired about leasing new car for my business, I spoke to gentleman by the name Tony Vella (Salesperson) for the dealership (Lexus of Massapequa). I was told everything is okay that l will need $1000.00 deposit to reserve my car, l paid the $1000.00.

After a week, l was called by the business manager of the dealership (Lexus of Massapequa) and told me that he cannot get me approved based on my credit history, then said he(Business Manager Lexus of Massapequa) found a financial company by the name Lexus Financial Services will approved me with $3000.00 down and sales tax of $2639.00 upfront plus $500.00 deposit plus first month payment total of $7,328.26.

I agreed to pay all this amount, because l knew my credit is not as good then. After agreeing to this conditions, he(Business Manager Lexus of Massapequa) called me back and said Lexus Financial Services still require additional co-signer.

I told Cynthia Mont my girlfriend to co-sign for me, she said to me she only make $26-29000.00 dollars a year, she dont know if they (Lexus Financial Services) will approve her to co-sign for me.

We both went to Lexus of Massapequa (Lexus Car Dealership) in Sunrise Highway Long Island, Nassau County, and she co-sign for me and l was approved.

I took possession of the car on September 28, 1999, after six months into the payment, l checked my credit report to see if everything has been reported as promised by (Lexus Financial Services) but nothing.

When l called (Lexus Financial/Toyota Motor Credit) l spoke to customer service l was told my name was not included in the said account (# 02049272058). I faxed my contract to them, still l was told (Lexus Financial Services) never give me no credit, the credit was given to Cynthia Mont.

I hired a lawyer (Kelllie Gasink) to filed a suit or write them ((Lexus Financial/Toyota Motor Credit) to sort out this issues. It took almost a year to sort out the issues.

On January 5, 2001 (Lexus Financial Services) agreed to changed the contract to my name (see attached) (exhibit 1).

I decided not to pursue legal remedy, after one year l applied for loan, l was turned down, due to insufficient credit history, l called for my credit report from all the 3 major credit report agencies:- Experian, TransUnion and Equifax. There is nothing about the car lease on it.

I called (Lexus Financial Services) and filed complaint again, l was sent a letter January 4th 2002 (see attached) (exhibit 2) explaining that request has been sent out to three major credit asking them to record my history payment on my credit report.

After six months nothing was done, l called (Lexus Financial/Toyota Motor Credit) to filed complaint (see attached) (exhibit 3). On June 18th, 2002, Another letter sent to me by Lexus Financial Services explaining the same lies over and over again..

In October 5th 2002, l called (Lexus Financial Services) and threaten a law suit or file complaint with Attorney General Office, if nothing is done, a letter was sent by Lexus Financial/Toyota Motor Credit out again on October 22nd 2002, explaining the same lies over and over again (see attached) (exhibit 4).

My lease was over in December 29th 2002, l apply for loan with (Lexus Financial Services), l was denied loan, by this same company that previously told me that theyve sent letters directing credit report agencies to add the transactions l had with them to my credit report.

I believed Lexus Financial/Toyota Motor Credit has not acted sincerely about the whole deals from the beginning , theyve discriminatory acted unfit to be in car business, after unstained 39 months lease, they Lexus Financial Credit denied me credit for another lease, reason NO LEASING EXPERIENCE . (see attached) (exhibit 5).

I am hereby demanding that Lexus Financial/Toyota Motor Credit to refund me back all my initial deposit of $7,328.26, plus interest and to annulled the contract that I signed (see attached) (exhibit 6) with Ms. Cynthia Mont, thereby all payment made on this car should be returned, including the maintenance, insurance and miscellaneous expenses, because the said contract was not followed by (Lexus Financial Services), therefore the contract is not valid. My whole purpose has been defeated by this financial company.

I believed Lexus Financial / Toyota Motor Credit discriminated against me, because of my race and national origin.

Dear Fellow Consumers:

Without reservation, Lexus Financial Services, along with its sister Corporation, Toyota Motor Credit Corporation (TMCC) is involved in financial services activities that seek to maximize profit at the expense of consumer welfare.

When the Borrower from New York put down $8,000 as a down payment on a lease, that was her leverage to negotiate the best possible rates in a Lease Agreement.

The Lender not only got the large down payment, but asked for a co-signer, and all manner of other concessions from the Applicant. This was the first indicator that the company was operating to get as much financial benefit out of the consumer due to her financial ignorance.

Asking for a second co-signer was just a way to ensure another individual was responsible for repayment should the contract go into default.

I believe the Complainant is correct in her assessment that her color was a factor in her being taken to the cleaners. Her color and lack of knowledge about financial instruments was the green light to the lender to take advantage of an individual perceived to be vulnerable and unsophisticated in financial affairs.

I appreciate all the arguments made by all persons responding to this complaint. There is truth to all the variant explanations about whether race was or was not a factor.

I think that what supercedes all the arguments herein is the fact that these Lenders--those that operate outside the boundaries of ethics and care for the customer--will seek to exploit and maximize their returns when they see an unsophisticated patron walk through their doors. Essentially, they will look at you as a profit piece and an opportunity for personal gain.

Getting over on a consumer is what they are trained to do. To combat this, you need to learn about contracts, interest rates, consumer and personal finance, and personal empowerment.

The African-American gentlement who bought the used Lexus with a credit union loan was the one that made all the right moves. He did not pay top dollar for the vehicle. He got a loan from a credit union that he has a personal financial relationship. And, he got a luxury vehicle with no mechanical deficiencies. Read that story if you want to know how to conduct the purchase of your next vehicle.

Another point, large, multi-national corporations do not care as much about your color as they do about making a dollar off of you. The Corporations are clearly equal-opportunity abusers.

Toyota Motor Credit Corporation/Lexus Financial Services is a large-scale corporate abuser. Please read some of my other articles listed on this site, along with complaints filed against TMCC.

I have listed information on regulatory agencies on where to file your individual complaints if you have been treated unfairly by the corporation.

We surely, as a People, have many differences in our cultural background, our skin color, education, lifestyle, income, etc. These are complex social issues that are not going to be resolved in this medium.

However, the financial abuse, harassment, and exploitative business interests of corporations like TMCC is something that most of us have experienced as consumers. And, so, it is as consumers that we have to fight the fight together.

When we stand devided, we are easier to conqeur and rule over. When we stand together, we are a force that has to be reckoned with.

As consumers, we all face the same issues and struggles. Stand tall and stand together.

Our Constitution says that we have the rights to "life, liberty, and the pursuit of happiness."
Everyone has the responsibility to stand behind those ideals and keep the land free. Do not let the corporate interests rule your lives.

As an African-American, I am truly amazed at the number of people that seek to use race as an excuse

I applaud you for injecting common sense, logic and a reasonable legal explanation to this arguement. As an African-American, I am truly amazed at the number of people that seek to use race as an excuse. I have owned a Lexus and find their product to be excellent. I purchased my Lexus from the original owner and financed it through my credit union. I knew I could not afford a brand new Lexus from a dealer and refuse to lease (rent). The vehcile has been excellent and I am now seeking a Lexus LX470 from a private owner.

My advice to Tunde would be, not everything is racially motivated, especially in terms of finance, where the only important color is money. Lexus and Lexus Financial Services are in the business of making money and many will continue to buy their products regardless, but in doing so, always make a sound financial decision and you will often enjoy your purchase just that much more.

Racist, please, You were not discriminated based upon your race

Sir,

You were not discriminated based upon your race, ethnicity, etc. You were not selected as a favorable credit risk because you didn't pay your previous creditors in a timely fashion. The fact that you put $8000 down on a lease has no bearing on your complaint. Regardless of the amount of money placed as security on a lease you'd have nothing to show for it at the end of the terms. Lexus fulfilled their contract by allowing you use of a said vehicle for a specific duration. The fact that the credit building exercise was not documented on your credit is not unusual in a lease. You might be astounded to know that in a lease contract usually only the primary borrower (in this case not you) is reported and even then only the value of the lease is reported rather than the gross amount of the vehicle. In fact, it's likely that you were not even a documented owner of the vehicle because in a lease the owner of the vehicle is Lexus Financial Services. The personal property of the borrower is the piece of paper that is the actual contract, not the car.

So let's say a GS300 is about $43,000 a 60% residual lease, a standard money factor, you're paying about 39 payments of about $540, totaling $21,000 plus the other $8,000 for first month, security, cap reduction, dealer prep, shipping, luxury tax, sales and state taxes, tag and title. For all this for three years and four months you're rolling in a new GS300, and your expectation is that at the end you can turn in the car free and clear. So you've spent $30,000 on the rental of a car you don't own. You'd have been better off to purchase a car you could afford and own it, rather than blame your race on an extremely poor financial decision.

Stop judging, know the fact, read the gentleman statement properly before you respond, you live in arizona or whereever, you don't have a clue about what people of color going' thru in any major city in United States, why will somebody pay almost $8,000 upfront for a (Stupid Lexus GS300) and have nothing to show for it.

That man can never get credit if something like auto loan are not shown, may be this gentleman that responding do not know what it means for black and latino's to get credit, if you're black or latino's is hard to get credit even though your credit score is over 600 if you don't have anything like car loan or mortgage loan... pls stop judging without knowing what other people goin' thru.

I myself leased car from Lexus Financial, for 3 years was never shown on my credit report, when l went back for another lease, l was ask for substanial down payment and tier 4 credit rating, because of their misdeed..

Tired of the race card

I am so sick and tired of any one of any race other than caucasion pulling this race card bull s**t.

Do you really think that is why it's not on your credit report? Do you really think they care if they report to your credit? I think you're pathetic for pulling the race card!

It's people like you that make it worse for those people who are ACTUALLY discriminated against!

Yes, I'm white, and no, I've never been discriminated against with the exception of my age, but I can still express my concerns and opinions about those pathetic people out there who think their race has to do with it when they don't get what they want.

Also, why should they refund your money? You DID drive the car for 39 months. You did put wear and tear on the car for 39 months. Oh yeah, you're not caucasion, you shouldn't have to pay for it!
