Kwame Amuzu with liberty mutual is a con/scam artist. A liberty mutual insured struck our vehicle with his trailer being pulled behind a dump truck. Driver kept going, independant witness followed and got photo of vehicle. Police contacted driver, he came back and said he didn't know he did it. Long story short, officer put him at fault, independant witness wrote statement putting him at fault, my husband, the driver, put him at fault. Kwame Amuzu chose to say "he doesn't think he did it" and after an initial denial of claim, has claim under review and will not answer either way so we can move on and file suit against the driver so we can get our vehicle fixed. Not understanding how this is allowed under the law. Amuza is an arrogant individual who obviously takes pride in "creating" reasons to deny claims when all evidence proves his insured did what he is accused of doing. RUN AWAY FROM LIBERTY MUTUAL UNLESS YOU AREWILLING TO PERSONALLY ACCEPT LIABILITY

The law works both ways...

First off I am not going to say that this driver did not cause the accident, but I am also not saying that they did.  As this is just something to think about.

If you had 100 people stating you did something and you know you didn't do it, would you not be here screaming how could the law not let you "defend" yourself.  If you were being called a Con Artist when you honestly didn't think you hit anything, would you think that was fair?

With that, the police are not a court of law, independent witnesses are not a court of law, your husband is not a court of law. If the driver chooses to deny responsibility, or again just honestly didn't think they did it.  Then yes you have to follow the next legal steps and sue them.

This may be a shock for you but Insurance Companies are not going to give up any money unless they have to. So if they have their person who says they didn't think they did it, they are going to not approve the claim. Does this mean that in the end you won't get a settlement..NO. Does this mean it takes longer than you THINK it should..yes. But this is why there are courts and other processes to be able to make yourself whole.

The fact is that the Police Officer was not a witness to the accident and your husband could hardly be called "impartial".  So you are left with your independent witnesses to determine the fate of this driver.

If you don't like this then take it up with the Legislature of your State(as it is the State that regulates the Insurance Companies).  Tell them that they need to create a law that states if there are 2 or more Independent witnesses to an accident that put the fault on a person, then that legally and fully makes that person at fault where they must pay(or their insurance company must pay) for any and all damages and they have no legal recourse to defend themselves or right of appeal.  Because that is what you are asking to happen here.  

When you talk to your Officials let us know how that goes...
