Liberty Wireless - InPhonic, Inc Liberty Wireless took my money and deny they have it.. Washington, District of Columbia

On February 10, 2004, I ordered a cell phone from the Liberty wireless website. I got an email stating my debit card was not accepted by my bank and they needed an alternate payment method. I used my checking account information.

The money was taken from my checking account February 13, 2004. On February 18, 2004, I got another email stating my order was ready to ship, they just needed my account information.

I called the company to verify why they needed my account information when they already have my money. That's when I was told they have no record of receiving the money. The only thing they show is the debit card being denied.

To date I have called 8 times, sent 3 email and received only automated responses.I have written InPhonic's staff attorney, Eugene Kim because he is listed the customer complaint contactwith no response from him either.

Every time I call customer service I get a different response. When I ask the customer service rep to verfiy the documenation they have in their system from my previous call, it's a total fabrication from what was really said.

I have faxed them a copy of my bank statement, as they requested, I physically gone to my bank and signed a release of information so that they could give Liberty Wireless information regarding the withdrawal. I gave Liberty the fax number for my bank because they were going to fax them a verification form. They never faxed the form. My bank showed me a printout of all transactions surrounding the date of the withdrawal and my debit card was never declined for payment; it was never presented.

Liberty never faxed anything to my bank. Liberty suggested that my bank has a "hold" on the money that was taken from my account. My bank verified that the money was actually withdrawn on February 13, 2004 and there was never a "hold" on the money.

I have been told by the customer service reps that they did receive the fax of my bank account and yes they have the check number. But they insist they never received the money. I have been lied to by a supervisor and most of the customer service reps. I've been told wait for 48 hours, 3-4 business days and the latest is wait 7-10 business days.

At this point, I feel that I should be able to file criminal charges. In good faith, I gave them my checking account information in excahnge for goods and services. Not only have I not received anything but Liberty Wireless/Inphonic, deny having my money. They have $103.95 of my money and I want it back.
