This company uses the "fine print" scam to continue billing after initial order. They claim this is legal in Ohio ? They have had many complaints and continue to use this process.

There is no question that they know that their process is deceptive.

Had no problems at all..

AUTHOR: David - (U.S.A.)

POSTED: Monday, October 04, 2004

Hello all...
I have read all of the comments on here, and just thought I would tell you I tried the Free Trial also. My product was shipped promptly, and I knew that I was included in their recurrent billing program. I cancelled as soon as I received the Enzyte, and not only have I not been charged again, but they sent an offer that was for a set amount of Enzyte WITHOUT recurrent billing...

As for the effectiveness, lets say that my girlfriend is QUITE happy with the results.

I am not an employee of Berkely, or any other company affiliated with all of this mess...Just a customer who had a good experience!

I also got ripped-off.

AUTHOR: Douglas - (U.S.A.)

POSTED: Wednesday, August 25, 2004

My comments can be found earlier this year. It's identical to what everyone else has experienced. I got my money back by immediately filing a dispute with my credit card company AND filing a complaint with the Attorney General's Office in Ohio. The complaint form can be filled out via the internet. You can do that by locating the AG's web site using your search engine. Perhaps if each and everyone who has a complaint here would file a complaint with the State of Ohio AG's office, only then can these crooks be shut-down or mayby even spend some time in jail!

WHAT'S REALLY GOING ON... MY BOYFRIEND TOOK ENZYTE AND OGOPLEX FOR 3MONTHS AND NOTHING HAPPENED

AUTHOR: Star - (U.S.A.)

POSTED: Wednesday, August 25, 2004

I AM AN EX-EMPLOYEE OF BERKELEY ALSO KNOWN AS LIFEKEY. I WAS ONLY EMPLOYED THERE FOR SEVERAL MONTHS AND I JUST FELT THAT SOMETHING WAS NOT RIGHT WITHIN THE COMPANY. THE TRAINING WE GOT WAS HORRIBLE THEY PUT ALOT OF TIME IN TEACHING US HOW TO "SOFT SELL" MEANING TO TELL THE CUSTOMER ABOUT THE BERKELEY ADDED PROGRAM BEFORE READING THE DISCLAIMER.BUT AT THE SAME TIME WE WERE TOLD TO MAKE IT SOUND LIKE A GOOD THING SO THE CUSTOMER WOULD THINK IT IS CONVIENT FOR THEM.NOW WHY WOULD THEY TELL US TO PRETEND LIKE IT'S A GOOD THING IF IT ALREADY WAS A GOOD THING. THE PROBLEM WE HAD WAS TOO MANY PEOPLE WERE FINDING OUT ABOUT IT.SO TO MOTIVATE US TO SELL SAMPLES AND PACKAGES THEY WOULD PASS OUT MONEY ON THE SPOT WHEN EVER YOU GOT A SELL OR SAMPLE.

I WORKED IN THE SALES DEPARTMENT AND I WOULD STILL RECIEVE CALLS FROM SO MANY CUSTOMERS CALLING TO COMPLAINING ABOUT THE PRODUCT NOT EVEN BEING DELIVERED AND BY ME BEING IN SALES I COULD NOT TAKE THOSE CALLS BUT THE PEOPLE I SPOKE WITH WERE PISSED.ONE WOMAN TOLD ME SHE WAS ON AVLIMIL AND SHE SAID SHE COULD'VE GOTTEN A BETTER RESULT FROM AN M&M. I BELIEVE THAT THE PRODUCTS DON'T EVEN WORK I THINK IT IS ALL IN THE MIND.

MY BOYFRIEND TOOK ENZYTE AND OGOPLEX THEY ARE MALE ENHANCEMENTS THAT ARE SUPPOSE TO WORK SO WELL TOGETHER. HE WAS ON THEM FOR 3MONTHS AND NOTHING HAPPENED HE WAS STILL THE SAME. AND THEY SAY YOU SHOULD SEE THE BIG BENEFIT IN 3 MONTHS. SO I THINK THE PRODUCTS DON'T EVEN WORK. THEY HAVE 13 PRODUCTS NOW:
ENZYTE -FOR FIRMER,FULLER ERECTIONS
AVLIMIL-FOR FEMALE HORMONAL BALANCE
OGOPLEX-FOR LONGER LASTING ORGASIMS, FASTER RECOVERY TIME
SUVARIL-FOR WEIGHT MANAGEMENT(NOT WEIGHT LOSS)
ROGISEN-FOR VISION
RODUFIL-FOR PAIN MANAGEMENT,JOINT COMFORT
ROVICID-FOR HEART HEALTH
NUMOVIL-FOR MEMORY LOSS
NUPROXI-FOR BEAUTIFUL SKIN.HAIR AND NAILS
PINADOL-FOR STRESS
PRULATO-FOR PROSTATE HEALTH (MAY BE OFF MARKET)
ALTOVIS-FOR ENERGY
DROMIAS-FOR BETTER SLEEP

I HOPE SOMEONE STOPS THIS MADNESS NOT ONLY DO THEY MIS TREAT THEIR CUSTOMERS THEY DON'T GIVE CARE ABOUT THEIR EMPLOYEES. I WAS NOT FIRED BUT I CHOSE TO QUIT BECAUSE IT WAS TOO MUCH OF A HASSLE
AND THEY WOULD MESS YOUR MONEY UP THEY DIDN'T KEEP A GOOD TRACK OF YOUR COMMISION. YOU HAD TO TRACK IT YOURSELF. JUST IN CASE THEY MESS UP. SO BE MORE THAN WITH THIS COMPANY YOU KNOW IF THEY MESS UP OUR MONEY PEOPLE WHO THEY SEE EVERYDAY THEY DON'T CARE ABOUT YOURS.

Not only are they bad to their customers they are bad to their employees too!

AUTHOR: Tina - (U.S.A.)

POSTED: Thursday, July 22, 2004

We get new managers who have no idea what they are doing, new SCRIPTS to read to the customer that is full of lies they cut our pay but assure us that we can make BIG bucks in commission by selling and the people who are selling are supose to be CUSTOMER CARE (care being the opperative word)and the companies policies change quicker than some peoples underwear!!!

Oh by the way the Managed Care Direct can be cancled right after the sale, when orders are put into the system the Managed Care order shows up at the same time and it is just 1 click of the mouse to cancel it but the catch is you have to speak with someone in customer care and as of the last meeting on 7-20 they are no longer allowed to do that because 'they are taking the companies money and getting credit for the sale' and 'reps are supose to SELL people on the program' we make a whopping $.16 on a $4.50 sample not too many people are that hard pressed over $.16!!

Also the program is no longer called "Managed Care Direct" it is now called "Berkeley Value Added Program" If you thought ordering your product thru the mail was a fail safe way to get product without the Managed Care Direct/Value Added Program you are now WRONG!! Instead of billing a credit card they will just send a 2 month supply of product with a BILL!! And if you dont pay that bill because you never ordered the product, they will send that unpaid bill to a COLlECTION AGENCY and you will have to pay anyway plus collection fees!

If you call in to the Customer Care dept they can't do ANYTHING for you because the literature says all free offers enroll you into the program and all they will be able to do is offer you a $35 credit or more product!!!

How do you give someone a $35 credit on something they haven't paid for and how as a company do you justify doing this to your customers? As you saw I am an employee of the company and I am giving this info behind the company's back because I think you need to know. I DO NOT agree with these "new policies" and I am seeking employment elsewhere! And I'm taking people with me, who is hiring?

To The Employees Defending This Unscrupulous Company

AUTHOR: Larry - (U.S.A.)

POSTED: Thursday, February 05, 2004

I followed this thread and read what a couple of employees had to say in defense of this company. While it's true that the terms for receiving the "free" supply of Enzyte are included on the same page of the website as the order form, you have to "scroll down" to see them. If you simply fill out and submit your order for the free supply (as I did), you'll never see the part of the agreement that states your account will be automatically debited every two months. Shouldn't this information be provided BEFORE the consumer has submitted his order?

That being said, I, personally, accepted responsibility for not being more cautious before submitting my order. If I had to allow Lifekey to debit 350 more dollars from my account before I got my refund, I was willing to do that...as long as I got the full refund as promised both on the website and in the brochure. But they worked their way around that, and I'm still out $70, even though I made it perfectly clear I was going to do whatever was necessary to qualify for a full refund.

So if you want to contend that it is the consumer's fault for not reading the fine print, go ahead. But don't fool yourself into thinking this company is on the level. They know full well that their practices are deceptive, and they'll do anything they can to keep from having to refund any money. I'd be interested in knowing exactly how many people have actually received the full refund as advertised with no hassles. I'd be willing to bet the number is somewhere between 1 and -1.

IF IT SOUNDS TO GOOD TO BE TRUE IT PROBABLY IS

AUTHOR: Tierra - (U.S.A.)

POSTED: Thursday, February 05, 2004

That comment not only refers to the products that Berkely Nutraceuticals(aka Lifekey, aka Warner Healthcare) sells, but to the jobs the offer as well. I am an ex-employee, and not because I got fired like so many of my co-workers. I had the forethought to get out of there while the getting was good.

I was hired in January 2003, along with a large group of people. We were told that we would be marketing the biggest product to hit the market since Viagra. We were promised extensive training, a high quality product to sell, and most of all lots and lots of money. Instead we got sketchy training were scripts changed daily and lies were implemented into our sales strategy. Along with that there was the job instability where you did not know if you would make it through the day without someone from management coming and tapping you on the shoulder.

Everyone knew what it meant if that happened. There was also the paycuts and different payscales implemented each week. People had left long term jobs with the idea that this was going to be a stable place to work. That did not matter to management, when times got tight because of the company's deceptive business practices, they cut people like bad habits -for no good cause at all.

Luckily I wised up and quit before it was my turn on the chopping block and I'm glad I did. Having to lie to innocent people (the consumer) and risk their health by telling them that even though they may have certain medical conditions it was still safe for them to take the product was unacceptable for me and along with the stress of worrying about my job on a daily basis was too much to bear. So I found employement elsewhere and have been with that company ever since. However, I still know people that are employed there (they were hired after me) and from what I understand the same practices are still going on.

When I worked there the owner of the company put a message on the company intranet requesting that the employees stop selling marijuana on company property because quote "We have enough heat on us as it is." This company is bad news all the way around. They sell sexually related products and each and every one of them is a rip off. Here is a list of product they sell as of March of 2003:

Avlimil
Enzyte
How to Sexual Brochures

JOB INSTABILITY, AND FOR THOSE THAT WEREN'T FIRED WEEKLY PAY CUTS AND W

AUTHOR: Scott - (U.S.A.)

POSTED: Wednesday, January 28, 2004

Those idiots at Enzyte or Lifekey whatever they're called, billed me for a nonrefundable order of this crap 20 days into my 30 day free trial. Those guys are the quintissential business terrorists. I remembered to cancel my membership 10 days before my trial would end. 5 minutes later, I check my back account and I've been billed 69.95 from this jackass of a company in Cincinnati. So there you go. Lock these crooked people up.

If LifeKey is so honest why did they lie to the BBB of Cincinnati lady?

AUTHOR: Mrs. James - (U.S.A.)

POSTED: Tuesday, June 24, 2003

Oh, you should be in jail too for being an accessory to Steve Warshak's crimes of fraudulently charging consumers using that "Established Customer Program" as a crutch. On February 13, 2003 the Owner of LifeKey responded to the BBB's numerous complaints by informing them that he was going to "do away with the "ECP" because of the volume of dis-satisfied consumers." I later found out that an employee "Lisa" fessed up to being the one who reponded personally to the BBB's letter. Why didn't Mr. Steve Warshak repond to a letter of such importance, regarding his company's future, financal situation, and reputation himself, to a government agency? Why doesn't he save the drama for his mama and do away with the program that is going to cost him in the long run more than $59.95 (like he told the BBB he would?) I'm feeling the gentleman that mentioned "Longitude" having their assets seized and LifeKey is right behind them. So I suggest you pick up the CityBeat and find a better job where you don't spent 8 hours a day w/ irate customers.(that you contribute to ripping-off) That alone speaks for you and your decisions for a secure future for you and your family. If you're so sure of LifeKey, how sure of it's product are you? How come the drugs you sell aren't registered with the FDA? How come Enzyte is not listed with the National Library of Medicines? Last but not least, What research was done on this drug, where can I find it, and what are the long-term side effects for using these products? (since you AutoShip in two month increments and the 12th bottle is free?) If you have the answers I'd be amazed because your fellow co-workers don't even have a physical address where a certified disclaimer can be sent and signed for. I'll tell you: long term use of dietary supplements and plant extracts can cause internal and eternal damage. So, before you go defending your employer, know the facts! Who really intends to purchase a product that has a label that says "if you want to cancel the established customer program" leaves a price on the label, and gives a phone number?" That alone means that your company has TRUSTWORTHY ISSUES!
And quite frankly dirtbag...Lifekey's a SCAm and you are too Ms. Opiniated but Uneducated !

ATTN: Attorney General of Ohio!!!!

AUTHOR: Alan - (U.S.A.)

POSTED: Friday, June 06, 2003

I think you should take a page from the Attorney General's Office of Arizona that seized all the assets, both personal and business, of the C.P. Direct Co. that put out Longitude. For those of you that are interested, please refer to the story listed here: http://www.msnbc.com/news/921042.asp?0dm=C238T

Right now, they are busy trying to reimburse $35 million to customers taken in by their scam. I can't think of a more fitting punishment to Lifekey and the rest of their ilk.

Automatic recurrent billing = RIPOFF!!!

AUTHOR: Tim - (U.S.A.)

POSTED: Thursday, May 29, 2003

Why not ASK the consumer if they would like to be enrolled in this program? Why not give them the option of opting out of this program at the time they make their first purchase? I would imagine that the answer to both is that your product is of little or no real value and the only way to successfully market it is to deceptively ensure repeat business. There is a very good reason why you are on the phone with irate customers for eight hours a day - your company is ripping people off.

Unless the customer is notified of the recurrent bill situation in an open and forward manner at the time of purchase, given the option to opt out of the recurrent billing program, and EXPLICITLY agrees to be recurrently billed, you are ripping people off. Ask yourself this: how many of your customers do you honestly think would agree to a recurrent billing program, that they fully understood, for a questionable produt that they've never used before? I would imagine that the actual percentage would be quite low, yet you do it to 100% of your customers! Do you need further explanation of how you are ripping people off? I'd be happy to give it!

If you would only pay attention...

AUTHOR: Pamela - (U.S.A.)

POSTED: Wednesday, May 28, 2003

When people write, call, and get on the web site, they are apparently interested. We have our rules and regulations as well as any other company.

Yes we print fairly small with the information that is vital to the consumer. Yet it is printed every where. Why skip over it? How is it the companies fault that the customers dont the read the literature that is given to them. Why dont they just do what is asked, I deal with irate customers for eight hours monday thru friday. They dont understand what there reading, obviously...This company is trying to help people with there sexually frusterated lives. Money that is taken from these "poor people" is usually returned to them.

I currently work at this company, with every inital order we send out brochures with our policy on it, its on the internet, its on the bottle. If you have a problem with this, dont order it, dont visit the web site, and dont call cryin and whining, because you obviously wernt paying attention.

Quality products are not marketed deceptively.

AUTHOR: Tim - (U.S.A.)

POSTED: Wednesday, March 26, 2003

No, David, the problem is not illiteracy, the problem is that your company is using a practice widely known as deceptive to boost sales of a product that people would probably not normally repurchase.

Automatic recurrent billing was first widely used by internet pornography sites, the operators of which recognized that the sticker shock of extremely pricey memberships would drive away customers.

To rectify the situation, they began offering very cheap trial periods. After the trial period is up, bam! you get hit with the full membershp fee, which will automatically recur every month until you notice it on your credit card statement and put a stop to it. Sound familiar? Here's a little test to see if your company is acting ethically:

1) Is the customer offered, at the initial point of sale, the option to NOT automatically be enrolled in a recurrent billing situation? If not, then you are being deceptive.

2) Does an intitial purchase enroll the consumer in a recurrent bill situation without an explicit agreement on his part? If so, then you are being deceptive.

3) Absent an explicit agreement on the part of the consumer (and no, explicit agreement does not include the letter sent in the package), does the consumer need to take active steps to prevent future billing? If so then you are being deceptive.

I personally never do business with companies that operate this way. Not only because I choose not to give money to scam artists, but because products that can only be sold through deceptive practices are not good products.

If your company was marketing a viable product, people would reorder it of their own volition, or explicitly agree to automatically recieve more. Decieving people into buying it just shows that the very people that are marketing it don't have any faith in it.

Fine print not so fine

AUTHOR: David - (U.S.A.)

POSTED: Monday, March 17, 2003

I have been a lifekey health care employee now for almost a year. The "fine print" described in the rip-off report is actually a straightforward offer of free membership in a discount progam. There is a brochure sent with every order, and an entire page (normal size print) outlines the program. I quote "With your initial order, you recieved free membership in the established customer shipping program. All established customers are fully garunteed to automatically recieve a new supply of mioplex every 60 days. There is no obligation, and you can cancel your membership at anytime"

Certainly a responsible consumer would read any literature recieved with an ingestible tablet he recieved. Perhaps the probem outlined above has more to do with literacy(or lack there of).
