light in the box closed ticket without refund internet

I came across this website searching for a phone so i found one for a good price $204.94 for a phablet phone so I placed the order on november 5 2013 I recieved the package 5 days later to make a long story short the phone did not work so I sent it back for a refund and kept communication open with customer service but all I kept getting was light in the box say the process for my refund may take a while like 45 days im thinking not cool so I called the bank and they confirmed if I havnt recieved my refund in a hand full of days then this site is a scam so i go back to the website and what do i see ? My refund ticket case that was pending now is closed and still no refund now it is close to christmas and the gift I planned to have for my son is not here and i have been SCAM from LIGHT IN THE BOX
