There are two types of selective enforcement: 1) when an association acts arbitrarily by enforcing some covenants but fails to enforce others; and 2) when an association acts arbitrarily by enforcing the same covenant differently against one owner and another.

The Linwood Farms HOA did both to me.

The case on this issue is the association’s covenants vested its Board with the power to approve or disapprove landscaping plans based on purely on personal friends. If the HOA board was friends with a homeowner then that home owner could install landscaping or a fence etc without the permission of the Linwood Farms HOA. Home Owners that the Linwood Farms HOA did not like were forced to go through lengthy procedures much paper work to try to obtain approval they really hassle home owners that they do not like.

Also, there is a juvenile delinquency problem going on in the Linwood Farms sub-division. Children have hit and dented my front door with a baseball bat type of object late at night. Each time we called the Mooresville Police and reported it and we suspect someone of throwing salt on our lawn as there were small areas on our lawn that would not grow even with professional help.

We ended up having to sell our home for a $40,000.00 loss just to get away from harassment that we were enduring from both the HOA and the juvenile delinquents.

Yes we contacted lawyer but litigation would be too expensive and judges tend to take the side of the HOA. Yes we tried to find the juvenile delinquents but that was impossible.

Furthermore, the young teenagers sneak out in the wee hours of the morning and into each others rooms for sexual encounters. How do we know? We caught our grand daughter doing it. This is all on record at the Mooresville police department. We tried to prosecute the boy for statutory rape.

I do not recommend buying a house at Linwood Farms subdivision in Mooresville North Carolina 

This story is true and it is on record with the Linwood Farms HOA, the Mooresville Police, Turning Point juvenile family counseling, the North Carolina Attorney General and many State Senators and State Representatives in North Carolina. There was no help for us. We just had to move.

We were not the only ones that were hustled. The Linwood Farms HOA put a lien on my neighbor’s home. This is all on public record in both Mooresville and IredellCounty.

Seems like there is a lot more to this story and it may be time to take off your tin foil hat.

This band of "Juvenile Delinquents" that you describe is very interesting.  Are they just picking on you?  Are they the HOA's "enforcers" because you are complaining?  Because it seems that based on a few comments these "delinquents" are actually a bit closer to home than you are wanting to admit.  After all it takes "Two to Tango".

You say that you "think" people were thowing salt on your lawn.  Okay so why do you think that?  What did the "professional help" say when you had them come out and look at your lawn? 

Now, as for you having to move, and taking a 40K loss.  You have heard of things called video cameras..right?  You can pick up a simple night vision camera for around $40 and set it to record.  Hook it up to your computer and record everything.  So $40 or $40,000...ummm. Even if the "basic" camera doesn't work you can find entire full security systems with off site video storage for under $1000.  So one really wonders why you didn't do that.  Of course this is figuring that they are only attacking you, if you get other neighbors involved this roaming band of delinquents should have been easy to find..right?

You say that they put a lien on your neighbor.  But you convienently left off the reason why.
