You are right Robert from Buffalo, I haven't posted for along time.  There has been no need.  Yes I got my day in court and yes, I did win.  The judge threw the case out because Triad did not have any legal grounds.  I did settle with Triad and received a new vehicle paid for by Triad. (Hopefully it wasn't any victims that posted on here.)  As far as the class action went, I contacted the attorneys and provided them with all information and continued to advocate for all the Triad/Roadloans victims.  After about 8 months of non stop research and data collection, the lawyers office decided that the case was not for them and chose not to pursue.  I turned to the news media and was contacted by Fox news investigators wanting to meet with me and discuss my complaint.  I agreed but was never contacted for the interview.

There, mystery solved.  You can relax now Robert and give Pacer (who I am also a member of) a break.  All I can do is encourage all victims to continue to post and file complaints to all state officials, new medias, FTC etc... eventually the hammer will come down on these asses and they will be forced to change their business practices.

I had a loan with Triad. And thank God I was able to pay it off. I admit I was late with a few payments and Lord they did just about bugged me to death with phone calls at least 5 to 6 times a day until they reached me.

I fell behind and they repoed my car. I pissed them off by paying what I owed and went and reclaimed my car. I do believe I was not given the proper time frame to reclaim my car.

The people who took my car had already sent my car to auction within 3 days after taking it. I had to drive almost a hundred miles and take a day off work to go and get my car from the auction place.

They already had and auction number on the windshield and the license plate removed. And even after I paid what I owed the ignorant lady at Triad had the nerve to send me power of attorney papers for them.

And yes I have been called before 8am and on Saturdays and Sundays. I will never deal with this company again. They totally take advantage of people with damage credit with those ridiculous interest rates and terms. Interest rates as high as

24.99 percent over 6 years. This was a rate I was quoted with road loans. Triad had me with 14.99%. This is highway robbery at its finest I only did what I had to do because of my situation.

I want in on the lawsuit.  My loan was paid off over 3 years ago, and they're still claiming I owe them $6,000.  Even though they sent me the title, and a letter stating that the vehicle was paid off if full.  They have sent 4 different collection agencies after me.  All agencies stopped collections once i showed proof of payment.

Hi. My husband and I purchased a vehicle back in 2003, yes 2003. We have made our payments but were late a couple of times. The vehicle we purchased was for $12K and we have been making a $267 payment each month for a 48 month loan. You would think that our vehicle would of been paid off by now however when I called to see what the payoff amount was to my shock they told me $6900 and that we still had 26 more payments left. What the hell!!!! Are you kidding me??? So ~ if you add the numbers....we have almost paid double for a vehicle that is 6 years old!!! So ~ if there is anyway to get into a lawsuit to fight this and be done with this company. Thanks.

There is NO EVIDENCE that Angie from Minnesota ever filed a class action lawsuit against Triad.

I have a PACER account and I see no evidence of a filing against Triad Financial in District Court in Minnesota (Angie's state) or in California (state she claimed her class action attorney was in.) Further, there are only 23 cases listed in PACER and if anyone knows which one of these 23 is a class action brought against Triad on behalf of CONSUMERS, kindly post the case number.

Please note that Angie claims in a rebuttal in 2006 that she had her "day in court" when Triad sued HER and she was "happy." Well, this lawsuit must have been in State court or small claims because it isn't listed on PACER (federal court filings) which is where a class action lawsuit with plaintiffs from multiple states would need to be filed. This is also the place her case would end up if she COUNTERSUED and her countersuit was granted class action status (unless class action status was granted for plaintiffs in MINNESOTA ONLY-then a state superior court would be appropriate.)

As I've posted before, if you truly have a case against Triad you need to file a lawsuit against them individually or as the lead plaintiff (if class action status is granted) - THIS COSTS MONEY, and lots of it.

I wish all of you luck, but this nonsense of ""count me in on your class action lawsuit"" is just that-NONSENSE!. Angie hasn't responded to rebuttals of her ripoff report in quite some time-she has no class action lawsuit against them pending.

As I've posted before, if you truly have a case against Triad you need to file a lawsuit against them individually or as the lead plaintiff (if class action status is granted) - THIS COSTS MONEY, and lots of it.

I wish all of you luck, but this nonsense of ""count me in on your class action lawsuit"" is just that-NONSENSE!. Angie hasn't responded to rebuttals of her ripoff report in quite some time-she has no class action lawsuit against them pending.

Further, if her case was truly adjudicated in the lawsuit she claims Triad brought against HER, her matter is SETTLED and she has NO STANDING to initiate a lawsuit now.

In other words, Angie in Minnesota is DONE with this.

I want in on this suit. This company conspires to defraud people of money-- regardless of circumstances!

I lost my job in January of 2008. All year I struggled to make payments and then fell behind. I contacted the company in writing in an attempt to renegotiate the terms of the loan with no response. I contacted the telephone numbers listed on the bills and other numbers that I found on the internet; and for about three days of calling, I had no success in speaking with someone who could talk to me about the letter. I just kept getting scrambled from one department to another. When I tried to contact their corporate offices, they kept transferring me to customer service.

In September, my car was broken into and my school books and other things were stolen. My insurance company sent me a check for $1,700.00 to fix the scratches on my car and said that I could use the rest of the money to repurchase my books.

My car was repossessed October. I contacted the company, and again for about a week, got scrambled from department to department, but finally spoke to a person in the insurance department. This person said that the company had my power of attorney and would cash the check and apply it to the past due balance and I would owe about $300.00 to get my car back... so I sent them the check.

When I got my next unemployment payment, I called back to see where to wire the money. The repossession department said that I still owed the entire $2000.00 and further said that an Trying to work with them to get my car back, I sent them a no such agreement was made. My check for $1700.00, which they cashed was not credited as promised and I lost my car as it was sold at auction.

This company does not care about any of their customers! They conspire to defraud people in financial distress with the full knowledge of what they are doing!

I, too have had the misfortune of having to deal with Triad Financial for the last 4 years. I was quite disappointed when I initially got my car loan through them when I was told that I would not receive a payment book, but rather a monthly statement. All was fine for the first 18 months or so but starting in March of 2007, I stopped receiving monthly statements. I work full time + go to school, so sometimes I would forget about my payment as I was receiving nothing from Triad. Then the phone calls started 15 or 20 a day, hang up calls...no messages. I know it was them because of caller ID. I returned the calls. I made payment arrangements over the phone, which cost me $8. This has gone one almost monthly since then despite the fact I have NOT moved. I have NOT changed jobs...nothing. They swear they are sending me a statement every month. I get every other monthly statement EXCEPT Triad's.

On Oct 20, I get another call telling me I am past due because I haven't received a statement since July 21. The amount I was past due was 1 1/2 payments. I happened to be home sick and told the person on the phone as such. They asked if I could pay the whole amount "right now because your accoiunt is 57 days past due" My account was NOT 57 days past due for the full amount. I said I could not and asked if I could put the payment off until 11/1 as I had just had an unexpected medical expense. I was told "no, your account will go to collcetion, can you at least pay part?" I agreed to pay the half a payment on the 20th and the balance on Nov 1. They tried to give me a confirmation # over the phone. but I was very sick and didn't have a pen at hand. I was told I would get an email confirmation & they verified my email.

I'm feeling better today, so I checked my email...NO confirmation from Triad. I then checked my checking account on line to find out they took the entire amount. despite agreeing to the 2 split payments. This is going to cause me to bounce checks. I didn't tell them I couldn't pay the whole amount simply because I didn't feel like it. I will now have another payment taken from my account on Nov 1 which will put my payments ahead. This is not the first time this has happened. Late last year, I made payment arrangements for 3 months (I was behind 1 1/2) they took out 2 payments on the same day instead of the 3 different days we agreed upon, again causing me to become overdrafted.

In addition to this, when I have fallen behind & do make these payment arrangements, on 6 seperate occasions AFTER I have made arrangements and/or paid my account to current, I still get phone calls DAYS later. When asked why, I am told "Oh it takes approximately 24 hours for our system to update before we stop calling you." When I point out that payment was made on a Monday and I am still getting calls on Thursday or Friday, I am told "I must be mistaken about the day I made the payment."

I am sick and tired of Triad Financial. They do not do what they promise, they have called me a liar when I say I do not receive a statement from them. In the past 19 months, I think I have received a total of 5 statements. They have threatened me, called me other names, called my home and job 15 times or more per day without leaving messages...I am sick of it. I will now have to close my checking account so they don't post yet another payment. This company is a prime example of what is wrong with this country's banks and financial institutions.
Do NOT use Triad Financial. Run, do not walk away from them! Most importantly, if you are unfortunate enough to have to deal with them, do NOT give them any access to your banking information.

my husband and i had to buy a car 2 years ago and we could only get road loans to give us a loan. they sent us a check and no contract information. so i called them and they told me that it would be a 14.70 intrest at a fixed rate. so we went a got a car. about a year a go i relized that i was paying more intrest that was previosly told. so i called them up my intrest rate was around 17.43 i think. and they told me it was my fault that they didnt send out the contract(and i cashed the check so its my fault).

so i got another bill and my intrestrate was at 21% i didnt know what to do so i called them again and they told me the same thing, but that my intrest rate was around 17% and that i was lying. they have not charged me intrest on some months and then 2 months later the double charge me intrest. i have never been late and i also paid 200 dollars more than was required. we would almost have the car payed off if it wasnt for there intrest!!! we have paid 4000 on our car and about 8,000 on intrest. thank god for my parents the have offerd to pay it off for me and i can pay them back!!! help please i would love to have at least a little bit of that money back. we have 1 child and barely can make rent!! it sucks so bad. and i let them screw me for 2 years!!

Im new to this website and only found it because I did a google search for "Roadloans" to make a payment. This is great!! I thought I was the only one! I fought with this company several months back to get them to skip a payment. They said it had to go through a "review process" and they would make a determination on wether they would grant it or not. They wouldnt accept the truth or I broke my leg and was on state disability. I could provide documents and financial info. I ended up having to lie and tell them I had a death in the family and I needed to skip payment to buy a plane ticket. They wanted to know who the relative was. If I had a close relationship with the relative. How old the relative was. Where the funeral was being held at. The list goes on and on.

It's been 3 YEARS since Angie made this ROR. Where's the class action lawsuit? As best as I can tell searching PACER, there isn't one.

Class action lawsuits cost MONEY folks-REAL MONEY!

The first thing about any lawsuit is you have to have a CASE. There has to be a violation of federal or state statutes/regulations or a breach of the CONTRACT between the borrorwer and the lender.

The second thing is that it costs MONEY to proceed with a class action lawsuit and LOTS OF IT. During the class action lawsuit process, there are many things that have to be paid by the plaintiffs;

1. Filing/court fees. The case has to be filed with a competent court. Then the plaintiff has to REQUEST class action status- has to substantiate that there exists or there is reason to believe there exists many plaintiffs with the SAME set of circumstances. The court may or MAY NOT grant class action status-class action status is NOT AUTOMATIC. Any subsequent court processes, such as subpeonaeing defendant records and such must be PAID as well-usually by the lead plaintiffs.

2. Administrative fees. These can cost thousands of dollars. Customer records have to be subpeonaed, reproduced, distributed. Notices of the class action have to be reproduced and sent to EVERY potential plaintiff in the class - this can cost BIG BUCKS if there are thousands or millions of possible plaintiffs.

3. LEGAL FEES. Many lawfirms that take on a class action status will do so on a contingencie fee, but only up to a point. Many initial legal fees must be paid by the plaintiffs with the remaining total legal fees taken from the court award (if there is a court award.)

The payoff: The lead plaintiff or plaintiffs (the folks who actually FRONTED the cost of the class action lawsuit) normally get the lions share of any award for the plaintiffs. The remain class plaintiffs (who have not fronted any monies to bring the suit) usually are awarded a pittance-coupons, 10% off next purchase, that sort of thing. Naturally, the LAWYERS get their millions in legal fees.

If anyone crying out "count me in" and other such class action lawsuit nonsense has a provable case against the lender, he/she would be better off hiring an attorney and filing an individual lawsuit against the lender in district court or state supreme/superior court. Your payout should you win will be more in line with making you WHOLE, plus your legal fees-class action lawsuits do not make ALL the plaintiffs whole. Historically, plaintiffs (OTHER than the LEAD PLAINTIFFS) recieve a pitance of their actual damages.

It boils down to this: If you want to be made whole, file your own individual lawsuit against the lender OR FRONT THE MONEY to start a class action lawsuit so that if class action status is granted you a LEAD PLAINTIFF. All the other plaintiffs are riding on the coattails of the lead plantiffs-that's why they receive a pitance or "token" settlement while the attorneys and the lead plaintiffs get the big money.

Hi Angie,
I saw your posting and I'm interested in what you have to say about ex employees. My vehicle is financed through Triad and at the time I'm way behind on 2 of my payments due to my mom passing away and I had to pay all the funeral expenses, I only have 2 payments left and they were due for April and May of 2008, of course they've added a whole lot of addition late and interest charges. I also wanted to mention that I worked for Triad for almost 4 years from 1998-2008 in the financing department which basically I closed all the loans. Please let me know what you know about Triad and their employees. TRIAD SUCKS!!!!

HOW DO I GET INVOLVED IN THE CLASS ACTION LAWSUIT??!

I too have an auto loan with Triad Financial. I went through Lending Tree to find a company to finance me for a car back in 2005, and it returned Roadloans that was able to assist me. Since then I have received bills from Triad, and I can't seem to get my car paid down. I am so frustrated just like many others here, so I have nothing really new to bring to the table because I have experienced a lot of the same treatment with this company.

I don't understand why I always have a $35.00 late fee charge when I am not always late on my monthly obligation.
I also tried the auto payment withdraws, but that didn't work out to well because they were charging my account on days that were not agreed upon, and totally screwed me with over draft charges from my bank, and then Triad charged me more late fees.

I started using the Western Union Speedpay option, and things have been ok it seems, but I still cannot explain the consistant late fee.

I am over this company and want so bad to get rid of my Taurus, but I am upside down on my payments do to the insaine interest charges that my payments keep going toward. I can't figure out why my principle is not dropping. I was financed just under $11,000.00 in August of 2005, and for some reason I still owe almost $7,000.00. Something is Rotten in Denmark.

I would love to refinance with another company like HSBC or Capital One..etc. But, I don't think I can because I am upside down.

I signed on with Triad in Feb.08 and I just found out they sold my auto loan to a very shady company, they never notified me and both companies are saying it is the other companies responsibility. I don't see how this can be done, I signed a contract with one company and they can just willy nilly sell it to someone else without my knowledge. Also, after 4 payments my principal balance is down $15 dollars and they are telling me they have no information on my account so they can't tell me why after $1600 in payments my principal is only down $15.00

I also have had horrible experiences with Triad.

In February 2006 my fiance and I bought a car. A few weeks later we got a call that the finance company cancelled and they found, Triad who was willing to take us on. At the time my fiance was the borrower and I co-signed on his car. By time Triad started everything they turned me into the borrower.

I recently got a letter from them referring to a contract I signed with them in May of 2006. I never signed and when he signed it was February.

Not only can I not get an amortization schedule to explain their crazy interest but they refuse to explain their interest to me.

So other then large payment everything goes fine for awhile then they try to take excess money out of my checking account without authorization.

After a few months, my fianc lost his job so we had problems with making payments. We talked to very rude workers who started calling us at home and work over and over everyday. I had people calling my mother's husband's ex-wife, who I have never met in my life asking for information on me. They called and harassed my Mother and Grandmother and his parents.

After making all kinds of arrangements with them that they promised to help out and work with us the car was finally repo in June of 2008. We were given no notice of a repo, just happened to walk outside and see the car taken. When the repo driver was at my home, he refused to tell me what company he was with or even allow me to get my wallet and medicine out of the car. I called Triad and they would not tell me who had the car or how to get my belongings. I had to chase this tow-truck over 20 miles to find out the name of the company and then pay $50.00 to get my wallet and medicine and other belongings out of the car.

On Friday I received a letter telling me they auctioned the car for $7,000 and I now owed $13,800.00, but if I make a lump payment they will drop it to $13,675. He is still out of work and with the economy how it is, we have nowhere near this kind of money.

I called Triad today (July 29, 2008). The person I talked to was very rude and let me know I was a loser, a sum bag and trash because I could not pay. He then refused to put me on with a manager and hung up on me. I called back and he pretended to be a manager and went back into the name calling.

I have never been treated so poorly in my life. This company calls and harasses us over and over. Then I am verbally harassed and insulted. No one deserves this, even if late on a bill. I have much more I can share, but am still very rattled from my call this afternoon. I would like to be involved in a class action suit against Triad.

I have been a Triad customer since 2004 and have never had any major issues. I make my payments ontime (or nearly on time). I have never been 30 days late. As a military member they dropped my intersest rate under the service members relief act while I was deployed. If I am late, of course they call and harass me... Duh my payment is late. I catch up and am friendly and nice and they drop the late fees.

Triad/ Roadloans is a subprime lender. I used them because my credit sucked and really needed a car for my wife before I deployed. If you have a genuine complaint then complain. If you're complaining because you were 3 months late and they repo'ed your car and they wouldn't work with you, then drop it. And no I DO NOT WORK FOR THEM. I am a full time servicemember in South Dakota.

I have been paying on a car with Triad since 2002 and it will be paid off October 2008 (At least that's what the contract said). All of a sudden fees are starting to appear, I seem to owe more than before, Triad tells me I have ext that I never had and they tell me that my payments can't be found (I pay online and print all receipts).

This must be the biggest gimick going today! I have better credit now then I had when I got the car (109 pts. more) and Triad offers the same interest rate that I have now when I try to refinance.

I would love to join any suit agaibst Triad! Lawsuit, sweatsuit, leisure suit whatever kind of suit!

I was wondering if you have had any progress on your class action lawsuit or what

has happened thus far? My husband just got a loan from roadloans two months ago

so far everything is okay, but I was startled when I came across this information

when I googled triad financial to get a phone number. I'm hoping that we don't get

suckered by this company, which is why I want to know where you stand with the

lawsuit. Any information you can give me will be great, hopefully it's news that

things have started looking better for the victims of Triad/Roadloans.

I, too, have had many issues with Triad/Roadloans that started when my vehicle was totaled. My insurance paid off the totaled vehicle, but I ended up getting another loan with them to purchase a new vehicle. Everything was messed up from the beginning. They were trying to bill me for both vehicles, the payment amount on the new loan was not correct (according to what I had agreed to), the due date was wrong, and they were reporting deliquent payments to the credit bureaus while they were trying to resolve their errors.

I can't tell you how many countless hours I spent on the phone with management and writting emails/ certified letter to their shareholders. This was 2 years ago and none of this has even been resolved! I have just resorted to making the payments (of an incorrect amount on a day that is not condusive to my pay schedule), and I have had to fax and re-fax letters and documents to try to get the deliquent payments removed from my credit history. However, every time I call to see what the status is no one ever receives my complaint and they just ask me to fax it again. Please contact me if you are a lawyer or anyone attempting to file suit!

I live in Plano, Texas. I have a van through triad financial. They did extend a one month payment grace because I was runnin behind. Maintained everything for a year and ended up late one month...that did it and they tacked the grace payment back on with late fees. Although the agreement had been that I maintain good payments for 1 year, which I did. Bunch of liars....how can I get more information on this lawsuit?

Ford Motor Credit ?

Just a few little facts. I saw someone write that Triad was owned by Ford Motor Credit technically it was acquired from ford motor credit and the CEO of Triad is Gerald J Ford (hum name sound familiar). I am in the process of going over stock reports but I have a hunch that Ford Motor Company has controlling stocks in Triad (but as of yet this is unconfirmed). OK ready to be very confused ? Here goes Ford sold a big portion of it's plants to Visteon which is said to be a subsidy of Ford (rumor unconfirmed). OK so if this is true it means that Ford sold it's plants to itself. Now as Visteon they cut there employees salaries. On top of this they also changed contracts of retired employees so they will no longer receive health insurance which they were guaranteed in there original retirement contracts by the way they did not tell retired employees till after it was done. Now some of you say how can they just change a contract without both parties agreeing on the new contract aah this is where visteon comes in the contracts are now owned by Visteon which means that they do not have to abide by the original contract because they were not an agreeing party at the time of the original contract so therefore we were told that we should be happy that my dad was still receiving any retirement benefits. OK now I know I seem to be getting off the point but believe me it all ties together and I am very angry I actually feel worse than that but I am trying to hold my cool as to not offend anyone. Any questions yet? By the way there are a lot more thing which ford has done to there employees that if they were some mom and pop corner store would have went to prison for.

OK so my dad gets sick from an illness caused by the chemicals he worked around for 32 years while he was a foreman at Ford Motor Company. He ends up in a nursing home for two years. Which he does not have insurance to pay for and cannot get medicaid because of the pentsion the nice people at Ford/Visteon allowed him to keep. So my dad finally passed away in January of 2007 and my mother is stuck with hundreds of thousands of medical and nursing home bills. So my mother files Bankruptcy. End of story right WRONG!!!!! This is where Triad comes in .My mother was in need of a new car. And because of the bankruptcy Triad is the only Company that will finance her. Mind you this is a woman who since she has had credit it has been spotless up till now. So now she has a used car at outrageous rates which makes her car more expensive than a brand new car financed through a bank. And the kicker is there is nothing that can be done about any of this. Now call me a conspiracy theorist I don't care I can connect dots.

I was just contacted by family members who gave me a number of a collection call from Triad. I googled the number and it turns out to be a private investigator. I have been harassed for far to long and even though I am at fault, I do have rights and want them obeyed.

It is like when you are down and the bully kicks you again to get a good laugh. I am always stressed. As much as you try to work with them they ignore it. What good is it to call back to work with them if all they do is yell at you, do not listen, and continue with their actions. It just isn't right!

If you sent them a cease communication letter and they are still calling you then you need to provide proof you sent it and go after them for the violation. If you sent it certified then you have all the proof you need. If by chance you just sent them a letter (providing this is a third party collector and not Triad themselves) by regular mail they can just ignore it, and they probably did. Send another letter to them and also one to Triad telling them not to contact you at your home or work about the debt. Tell them in that letter you will accept communication in writing only! Demand from Triad a printout of ALL account activity and tell them they have thirty days to get that information to you. They are a very snakey company and will try anything. Be prepared to provide proof. Make sure you send these letters certified with return receipt. This way, if they continue to violate the request you can sue them for that violation. Keep in mind though if you do sue and win, that will not settle any debt that they claim you still owe them. I hope you kept good records for proof. Good luck to you. You may be a single mother working three jobs, but Triad and their vultures could care less. Pack some puch behind your demands and turn the tables on them!!!!!!

You can add me to the class-action lawsuit. This company charges huge amounts of interest which made my payment on a 7 year old car almost $400.00 monthly. After paying for a year and a half, I owed more than I borrowed. Yes, they were the only company I could get financing through at a time when I needed a car, but I would have been better off going through a tote-the-note. They ended up repossessing the car, and now have a finance company calling me and trying to collect over $10,000. If I could not afford the $400.00 per month, I don't know where they think I am going to get $10,000. They harassed me continuously at work, even though they were repeatedly told verbally, by email, by fax and by mail that they were not allowed to contact me there. I am a single mother, and now that my son is a teenager, I am working three jobs. Sometimes things just don't work out they way you think they are going to. But it does not help when companies like this take advantage of the down and out and the desperate.

I am not as bad as you think. People do love me and so does my family. Don't try to tell me how people think of me just because they think of you that way. I am not here to argue with you. I am strictly here to give my opinion on what I know/seen in the Auto Financing Industry.

Like I stated before, educate your followers. I never said everyone was in the wrong but there are those who are only after the money even though they are the ones at fault. Also I am not trying to hide my identity because I don't want you to know who I am but I can't display my identity due to my line of work. I'm sorry that you feel you are of a higher statue because you proudly display your name for all to see. That is good for you, for I am not the type of person who wants to always be at the center of attention.

What are you talking about "my followers" these people are victims one way or another. Do you think it is justified for people to be treated in the manner Triad treats people no matter what the situation is? Bad things happen to good people, not always is it something that a person could control. How dare you belittle any of the "followers" These people are victims not"groupies" following me around like a lost puppy. It sounds to me like you are the type of person that lays awake in bed at night figuring out ways to cause grief to someone else's life. Hell, you are so afraid someone will find out who you are, you sign your ridiculous posts anonymous. You are just like Triad;you hide behind the computer or phone, you threaten, degrade, assume, treat people with zero respect, and think you are the solution and not the problem and then you can't even sign your name to your destruction!!! I bet your family can't wait for the next family get together so they can see you.....or do they not want anything to do with your sucky attitude either?

You are pathetic, I feel sorry for you. You are so displeased with everything you even hate yourself. If that's the case, stay off the phones, stay off the computers, don't go outside, and become a hermit......I can guarantee people will like you a lot better.

read what your followers are saying... "i paid well for a few years.. then fell behind 3 - 4 payments.... they are such a bad company they ripped me off!" .. "i was late a few payments and when i checked how much i owed.. i owed more than i thought.. they are screwing me on interest and blah blah blah"... haha.. your followers need to get educated on how financing works... and most of them are at fault because they can't pay their car note on time.. you all expect the world to revolve around you or something.. you all act like filing bankruptcy is a good thing... YOU FILE BK BECAUSE YOU COULDN'T KEEP UP WITH YOUR BILLS PEOPLE!! and then you go out and buy a brand new car that is too much for you to handle?? omg... how ignorant can you be? it's depressing to know that there are people living out there that are sooo sooo dumb...

If you're so smart Angie... please educate your followers... don't just have everyone joint your no action law suit just because they are angry at Triad...

and you know what? Ok.. I'm sure there is no company that is perfect.. and YES I'm sure some people do get screwed by a company for no reason.. and those people.. Do you work for this company or are you just too ashamed to proudly display your name? I now know why Triad is they way they are. They have people that are the likes of you defending them. You know what?, I fought Triad and won on a personal level. I had my day in court. (Triad sued me) and guess what?, I won on my counter claim! The judge threw the case out Triad was trying to sue for, I won my counter claim. I had all my telephone recordings, I had all the paper information needed to prove Triad F***ed up, I had my bank statements, I had everything!!! Hell, I even got last laughs! Oh, there are still bottom feeding collection agencies that keep trying to collect, I let them. Eventually one of them will take on the Triad mannerisms and I can sue them and win.

Oh, just in case you work for Triad, I would like to say Thank You from the bottom of my heart for doing what you did, not only did I get enough money for a new car, I even got to take my family on a rented houseboat for a week on vacation, not only that, I remodeled my home, put hardwood floors in, new doors, etc..I think you get the picture.

So, wanna take me on again? Oh, come on I dare you! oooooh, are you scared? Triad sucks and that's all there is to that. Look at all of the victims they have left behind. I'm the one that got away..with a lot of Triads money; and I'm still enjoying it to this day. Keep pushing for justice people, You WILL prevail.

I have only one month left on my loan which is approx $500.00 and Triad says my payoff amount is over two thousand dollars. I have always paid over the amount requested. I sit here and read what some of you write about this company and it makes me wonder what kind of people you are..

Come on people, it's common sense (unless you all don't have any) that if you make late payments, you don't pay your bills etc.. you are going to get collection calls and your vehicle will eventually be repo'd.. First off, there must have been a reason you even did business with this company.. could it be because you haven't paid your bills on time in the past? If you have good credit and are responsible with paying your bills.. you wouldn't need to get a loan with Triad/Roadloans would you? Triad/Roadloans is a sub-prime lender.. for those who have no idea what that is.. that means they offer loans to people with bad credit.. I read people complaining about their vehicles getting repo'd, getting calls to make payments because you are LATE.. losing your job, or something unexpected happened to where you can't make payment and then you want sympathy from the company??? I'm sure they try to work with you but you have to remember that YOU are already a risk to the company because the reason you took a loan through them is because you have bad credit.

Would you loan out 25k dollars to someone and tell them.. "just pay whenever you can.. and if you can't pay anymore.. don't worry about it!" I highly doubt it.. The company needs to make money somehow.. and if you owe a debt.. you need to repay it. you are the ones who signed the contract. You agreed to pay it back.. if you do what you are supposed to do.. you would have no problems..

I have never recvd. any harassment calls from any company asking for payment ever in my life. You know why? I pay my bills on time!! I don't wait till the due date to pay at the last minute.. I pay ahead of time.. I don't buy a 30k dollar car if I can't afford to make the payments.. come one people.. you are responsible for your own actions.. quit trying to blame other people for your own mistakes.. I rest my case..

Road Loans supposedly approved me and gave me the okay to shop, but then created a reason to renege on the deal the next day, AFTER I had located and supposedly bought a new vehicle. They tried to say that my SSN was different on 3 different forms of info. Trouble was, one of those documents was intentionally scrambled for security reasons and another listed my Employee ID number, which a RoadLoans rep tried to say was supposed to be the same as my SSN.

I am really incensed that they chose to wait until the following day to say there was a problem, rather than approving everything first, only to scratch on the loan the day after. Now, I'm scrambling for alternative financing, or else I won't be driving any time soon. I only did this because I wanted to see what it would be like to negotiate with a check in hand. What a price to pay for that privilege.

Top all this off with me securing regular financing the next day and driving away with no hassles whatsoever.

I bought a car in April of 2001 for $20,000 and was placed with Triad for the note, a 66 month note that is @ $505.00 a month. All went well until I lost my job due to cut backs. Then I asked to defer a couple of payments. Then all was well again when I finally got them to do this.

In dealing with this company I learned very quickly to make payments over the phone. So on my second to last payment they (Triad) stated that your next payment is the last one and the loan is done Wow great feeling to have paid this off.

But wait, a couple of weeks after making that last payment they send me a bill for $1,200.00 So I call them and ask what it is for and they tell me it's for late payment interes. The payments that I had deferred were tallying interest all along with out me even knowing anything about this.

When I asked why I had not seen this any were on my statement or why I was told your next payment is the last one and the loan is done. they could not give me any other explanation other then This is a simple interest loan.

So we talked to at least 10 people there and they said that they would convert the Interest balanc to payment and invoice then to us. Something they never did and now the interest went up to $2,400 and they repod the car because they stated it was 152 days past due. On a loan that had matured. The only way I am going to get this car back is to pay this $2,400 all at one time.

When I call them to ask how much I would have to pay to get the car back I was place on hold with there Recovery department for 20 minutes. When they finally answered the phone the women was rude to me and said to me I do not feel like arguing today so I responded back with I guess that you would not as I was on hold for 20 minutes so you must be doing this kind of thing to allot of people. at that point she hung up on me. Must be nice to think that you could do this to your customers.

p.s.
I heard that there is a Class action suit against them. Can any body tell me how I would join that suit?

Hello..I am also a victim of Triad but was able to complete my payments, and have not hear from them (Thank God). I got a car in 2001, and made payments. I got injured at work and got behind, and got all the rude phone calls that every victim has gotten. I made several payments and guess what Triad lost the payments and I could not find the receipts due to a fire. Anyways here is a suggestion for those who keep getting money taken out from their accounts. I ended up closing my bank account and opening up another one, but I did not give the account number to Triad. They tried to push me to give them the account number but I refused. Instead, I made payments with Moneygram or Western Union, that way it is in the account with in 1-2 days, you can see it online, and they cant take money out of your accounts before the set date etc. This is suggestion to help.

I bought a car in April of 2001 for $20,000 and was placed with Triad for the note, a 66 month note that is @ $505.00 a month. All went well until I lost my job due to cut backs. Then I asked to defer a couple of payments. Then all was well again when I finally got them to do this.

Until

In dealing with this company I learned very quickly to make payments over the phone. So on my second to last payment they (Triad) stated that your next payment is the last one and the loan is done. Wow great feeling to have paid this off. But wait a couple of weeks after making that last payment they send me a bill for $1,200.00 So I call them and ask what it is for and they tell me it's for "late payment interest" The payments that I had deferred were tallying interest all along with out me even knowing anything about this. When I asked why I had not seen this any were on my statement or why I was told "your next payment is the last one and the loan is done" they could not give me any other explanation other then This is a simple interest loan.

So we talked to at least 10 people there and they said that they would convert the Interest balance to payment and invoice then to us. Something they never did and now the interest went up to $2,400 and they repo'd the car because they stated it was 152 days past due. On a loan that had matured. The only way I am going to get this car back is to pay this $2,400 all at one time.

When I call them to ask how much I would have to pay to get the car back I was place on hold with there Recovery department for 20 minutes. We are fighting not only with Triad but also with First Financial Asset Management. They are rude, calling my house all the times, threating to have me thrown in jail and take my kids away (my husband is in the Navy & out to sea on an 8 month deployment). Said they were going to contact my employeer and have my wages attached, (funny~ I run my own business, I am my employeer). The harrasment never stops & they keep pulling money out of my account without authorization or before dates it was set up to be withdrawn. We are willing to help any way we can!! I will also be filing a complaint with my attorney general as well as Californias.

The reason I'm asking is that I was a Triad/Roadloans customer, and although I'm out of my loan now, I've read my signed contract word for word....which includes an arbitration agreement.

If such an agreement was signed, which I feel many of you may not be aware of, you will not be included in such a "class action law suit." That is what an arbitration agreement is for to prohibit such law suits from taking place - no matter what has taken place. It would be a good idea to review you signed documents, you may not even be aware that you signed one.

I want to be included in the class action lawsuit. I payed my April payment and went to look on their website and still shows i owe for April. I called them and Jose told me in order for me to get my title i have to come up with nine hundred dollars now. I am twenty two days late. They get the figure from late charges and intrests. Since my maturity date was April 29 i have no more payments left.

I called my dad yet again to give me 1000.00 thru moneygram so i can send it to them. I sent them 1500.00 in April because my late charges was 900 and they took 633 and applied to the late and 367 went to princpial. I am now afraid that they will repo the car before i can get the money in. I need help on what to do

Here is the info on Skip Tracy you may have been looking for, I called the phone company (mci in this case) and found that the number they were calling me from was owned by skip tracy, LLC. in colorado.

I did a search on "skip tracy" colorado and found just 1 hit, and abscure report somewhere that told me Belles Camp Communications in eagle colorado owned the program called Skip Tracy. (go to the yellow pages to get there phone number for belles camp). I called belles camp and low and behold, the guy that answered was shocked that I found them, and when I told him what I wanted from him, he told me know one there could give me the information and hung up on me. basiclly I was trying to find out which collection agency was calling me and harrassing me so I could file a complaint.

My husband and I would like to join in the class action suit, as we have taken enoungh from this company. they got us the loan and then with out our knowledge, because the other company said they did not get the correct payoff, simply did another loan and did not tell us about it and we did not find out until we went to get a home loan and were denigned because of our crdit and because we had 2 loans. they have fixed it kind off but it still states that we owe them on the both and because of this, they had us as not paying for 3 months on the one and this dropped our scores from over 600 to 500.

I know from personal experience that these are a work in process, and honey I'm here to tell you it will be worth the wait. I read your complaint and took your advice. I filled out a complaint form on-line and sent that with supporting documents to my attorney general's office here in Illinois. I've also sent correspondence to the Federal Trade Comission and my attorney. Hopefully I will be able to get these people out of my life. Triad has taken steps to repossess my car and I owe them less than $2500.00.

I am Nancy in Forney AND have filed RIPOff Reports already. NONE OF OUR RIPOFF REPORTS SEEM TO DO ANY GOOD! What's with the lawsuit? And have any of the BBB, ATTY GENERAL complaints been answered? Give us CEO or president names of ROADLOANS, please.

I just had my 12-26-06 payment cashed after I made a replacement payment on 1-10-07! I have sent a letter to Carl Webb at the TX office. Is he really the president?

I had to scream and insist for the employee to give me his name -- she kept acting like a robot! "Please tell me why you need his name? I need to know what this is in reference to" I told her to just give me his name that I wanted to write him.

Is ANGIE in Minnesota actually going to get our real names for a lawsuit or are we left to our own devices to complain. I am going to probably refinance but doubt ROADLOANS will handle that correctly/they'll probably screw up the title transfer or payoff.

REFINANCE AND TELL AS MANY PEOPLE AS YOU CAN -- NEVER USE ROADLOANS/TRIAD FINANCIAL!!!!

I spoke to a Lawyer and based on what he told me, I think this will help:

1. Never call or speak to them! NEVER- everything must be in writing b/c once you get off that phone everything thta has been said dissapates. Make sure when mailing correspondence, send it certified or at least get a receipt confirmation

2. Every state has different statute of limitations on these things, find out how long it is b/c depending on how old some of these cases are, Triad is in violation of the Fair Credit Reporting Act, make sure to cite this in any correspondence you send them.

3. When you write them, make it on your terms! Give them 30 days to get back with you in WRITING listing their findings and the remedey/corrective actions they are going to take.

4. If you have the intent to do so, make sure they know that you are planning to sue them. Again, in writing

5. File complaints with the FTC!!!! They need to know there is a serious problem.

Angie, you said you had your day in court and walked away smiling, Good for you girl!! :-)

I completely understand where each of you are coming from. -- In the beginning of our Triad loan, we thought Triad was the best and opted to re-fi with them. We started our loan in October 2003 and have always been on time. I have deferred a couple of payments during rough times but paid all the fees in advance.

About 6 months ago, our baby was diagnosed with Rhuematoid Arthritis and the medical bills began to add up. The past two months we have been LESS than 30 days late. On day ONE (we're due on the 24th) after we're due, the calls begin. It's HORRIBLE. They start at 7:30 AM and don't stop until somewhere between 7:45 - 8:30 PM.

They call ALL DAY. Somedays it's about every 10-15-30 minutes. Try dealing with the stress of a baby who's in pain and just trying to take a nap, AND add the stress of your phone ringing ALL DAY. It's MADDENING and STRESSFUL. When you do take the chance and answer the phone, the CSRs are extremely RUDE and DEMANDING. "Where's your payment? You have to set up a date right now. Why haven't you paid? You are in default of your loan agreement."

I'm fed up. We are just trying to make ends meet. Try having our car payment - it's $490/mo! Add the intensity of medical bills from Stanford. Triad needs to have some compassion. I've been a good customer.

So yes, if there's a class action, I will happily add my two cents!

I am not late, but they really made a mess of things for me one month when they told me they never got a payment, then told me resending a check was not an option. I paid over the phone, asked the gentleman to be sure to note my check was to be returned/destroyed. THEY CASHED IT. I was unable to buy groceries for two weeks.

This was after 5 calls a day as late as 10 pm and being told that "My credit must suck"

Wish I had recorded it.

Let them take the vehicle. If one morning you wake up and it is gone, call te police, report it stolen, and tell them who you think has it. Then, take your signed contract to a good lawyer and go after them. Check the laws in Kentucky to find out if it is a cone party state for recording conversations. The recorders are inexpensive. Don't talk to them on the phone unless you are recording it. Anything else have it put in writing. If you send something to them, make sure it's certified with return receipt. If Kentucky is a one party state, you will not have to tell them you are recording the conversation.

If they are a two party state, you will have to tell them you are recording. Give them hell. Make them pay for the harassment, pain and suffering, and if applicable, damage to your credit report.

I had my arrangements in writing, and they took my vehicle. I had my day in court, and I left very happy. Keep us updated. I will add you to the list of victims.

I have a vehicle I just financed with Roadloans. The agreement says the first payment is due Feb 15, 2007, as they were doing a deferred payment promotion for new customers. It is now Dec 1 2006, and they call me telling me they are going to repo the vehicle, even though I have the contract in writing with the first payment due date. PLEASE HELP! If there is a class action being filed, I want in on it.

wow, i was in here about ameriquest and found these stories about triad. my family also had problems with triad we hated them so much we wanted them out of our life and we refid our home with ameriquest to paff off our triad loan.
BIG MISTAKE !!! we didnt know anything about ameriquest then BUT WE SURE KNOW NOW !!!

my story about triad isnt as bad as others on here and certainly not as bad as what ameriquest has done to me, but yeah triad did that cell phone trick on me too and was calling friends reletives... LIKE I WAS MISSING !!! got everyone upset and then proceeded to tell my friends and family im a dead beat.. it was horible.

i wont go as far to say they didnt apply payments , but it did seem the payoff was kinda high concidering id paid them for two in half years. i hated the collection people-where assholes called everyday of week holidays didnt matter.

good news was though in the end i refied the house and got ahold of someone at triad and they accepted like 7grand less than what THEY said i owed which i think was high, but i was just happy to get rid of them.

the bad news is i got involved with ameriquest which seems like now triad is saints compared to these guys and the mess im in now.

ive decided for now on if i cant pay cash or deal with a reputable BANK BANK with good terms...
ill go without.

yeah,ill join your class too if it happens im not going to go out of my way to hire an attorney, but ill tell what i experianced with them if asked.

Angie, Thank you for doing this. One guy says it wont hurt Triad by doing this due to their insurance, but i think it will. Who would want to insure someone with this reputation? Thus raising their premiums etc. Also another guy says they are owned by Ford, I dont know if that is true or not but I did by from Ford. I just finnished updating my report and I incourage you and all to read what they did. If all the law suit does is remove the repo status from my credit I'd be happy. And I too will contact the BBB in Fort Worth, TX.

Typical Scenerio of Triad. They have a reputation to live up to. They didn't obtain over 530 complaints in 36 month time to the California BBB, nor the handfull that can be added on top of that from the California State Attorney General's Office by just obeying the FDCA laws. They will continue to do this stuff until someone of authority grows some balls and takes the initiative to do something about it. Until then, we as victims are stuck having to take things into our own hands, and sue them via Class Action. Want to join?

I did infact mail my payments and in no way can I be in default. The rep told me that the only way this could be resolved is to provide my checking account information and she would draft the $$$ and when they find the payments if I did indeed truly mail them that they would be applied. I then checked ripoffreports.com and am amazed. I cant afford the bad credit I will get if I don't do what they are telling me but after checking into this sight I am scared to death that I will send the money again and they will still take my vehicle. I told her that I am tracking my payment now and payed with money orders as I always have and it will take about 14 days for the trace to complete - to come get the vehicle if need be but I will not give them access to my account.

I too had an experience with Triad. After four years of good payment history, I ended up falling behind for almost four months. I spoke with a man named Reuben, who did work with me for two months, but then my account was assigned to a Mr. Jackson in collections, who advised me that if I paid $229.00 by a certain date, I would be taken out of repossession stages and place back into collection.

I paid $240 and tried to report it, only to be placed on hold for 20 minutes at a time until (you guessed it!) the collections department had "closed for the evening." With no recourse, I simply hoped that my posted payment would show in collections and that common sense would take over. Forget that! This past Thursday morning I work to discover my car was gone.

I am not overly upset about the car being repossessed (it had a bad driver's seat anchoring and it recently threw a rod in the engine - good luck auctioning it off for anything other than parts!) What I am upset about is that Triad failed to live up to their "promise", though I am sure some legal eagle there will give me the old "you have a written contract, which supercedes everything else" line. But what I am MOST upset about is that Triad refuses to return my calls, and has yet to give me information about either reinstatement or recovery of my plate, which I paid for, not them!

Someone please give me some info as to how to join this lawsuit, or at least make their lives very difficult here in Florida.

BTW, anyone who goes to the Triad website will learn that Triad is NO LONGER owned by Ford Motor Company. Instead an investor consortium (probably one of these radio "gurus" you here commercials for constantly with "can't miss" retirement schemes) bought them out months ago... guess a customer-friendly culture has now been converted to "let's pad our own pockets and d**n the consumer!"

Why aren't you putting pressure on them - they don't want their reputation tainted. I was on the phone regarding my Uncle's death when they started calling my cell phone. I answered was told it was Ms Johnson - paused and she just sat there, so I told her don't know a Ms Johnson and went back to my call. She called my cell, my home and my office leaving threatening voicemails after the company was instructed never to call me that all correspondence had to be in writing. It was funny once I brought that letter up - while they claimed not to have the letter from 2004 they did stop calling because I told them I had filed complaints.

They told me I was getting a 3 month extension - lied and then with out any notice sent me a 2 month extenstion over a week later and after they harrassed me because it was not sent by their office. The Extension was promised on 9/18 but dated and actually sent on 9/25 - they were waiting on the September payment to post so they could deny the 3 month extension. I think it is time we contacted the press screw the court system....lets get the press on the ball! Lets put the preverbially screws to Ford!

You need to file so that when people check them out it shows an accurate history!

After reading all the reports I am astonish of how many people share the same feelings I do about this company. My story starts out as having filed a bankruptcy just before I bought this car. When I signed the contract I new that I was getting screwed with a 20% interest. I thought I had no choice at the time. I needed a car.

Well the first few years were rough and I had some four late payments not more than 30 days. Also when the car broke down I defered payment till the end so I could fix the car instead. I did that three times. The last couple years I have been doing better paying my bills on time. I havent paid Triad late for over two years.

I was feeling pretty good that my loan would be finished in Oct. (This counts the added on 3 defered payments). When I checked the pay off amount for the loan it had an extra $1200 added on to the loan. I called and tryed to get an explenation. When I did they told me that because I had late payments that they look more of the payments and put it more toward the interest of the loan. WOW!!! I thought I was getting screwed with the already high interest rate. Now they want more. I thought that if you have a fixed interest rate contract that they could only take the contracted interest and no more. As for the late payments they charged a late fee, and it was paid. That should be the end of it.

I was vulnerable at the beginning and got the high interest rate, but I think I am being ripped off in the end by them taking too much interest than they should be legally able to take.

Angie, please count me in. Can you send me any information that might help.

Diana, As I have stated on other posts, please file complaints with the California Attorney General, your State Attorney General, the FTC, and the California BBB. I say the BBB only because there are hundreds of complaints. Add yours also. It has got to be topping close to 600 complaints by now. That way if anyone checks, they will see them all and steer clear from them. It wouldn't hurt to call an attorney about the harassment. You may have a case on that alone. Good luck and let us know how things are going.

want in on the lawsuit!!! triad has screwed our credit so bad it's not even funny! let's just say my credit report states one amount yet my husband's states another totally different amount yet same account, go figure.

In 2001 we purchased a 2000 chev malibu and did well on our payments for 2 years but lost employment do to illness/disability but tried to make arrangements to keep the car and lower the payment or something. wouldn't coroperate for four months, got tired of the harrassments. They even called my foster parents harrassing them claiming that they were a friend of mine and needed to get ahold of me, and of course my parents know my friends and didn't give out any info but the call was disturbing because they called them at 12:30am not pm AM!!! now it's been since 2003 when they repo'd the car and still calls my old job, which I haven't worked there since 2003 harrassing them. They state that I don't work there anymore but insists to get info from them. this is wrong.

Oh and the amount of the loan was $31,000 and later found that the car wasn't even worth that much, we were played by them and the car dealership. The original sticker price was $13,000.

I have already submitted my report, and would like to be included on the class action against Triad.

I would also suggest that all their affiliates, dealerships, and towing companies also be included as they appear to be willing working in tandem with Triad.

I would suggest that these other entities have knowledge of the unethical practices of Triad, and so work with them as it benifits these entities in the way of car sales, and or other expenses that end up being incurred as a result either from the sales of cars, or from fees required to obtain pesonal belongings if not the vehicles itself in many situations when it is illegally towed.

Please include me on the class action.

I live in Kentucky and financed my car with Roadloans back in November of 2004. I don't have any horror stories since I have never been late on my payments, but check this out.... I borrowed $15,000, and have made payments for close to 2 years and my payoff is over $11,000. Now mind you at an initial interest rate of 22%, I put down $2,000 and refinanced after 9 payments. Triad lowered the interest rate to 20%.... now 9 on time payments later I go to refinance again and they only offered me 19%. Needless to say I did not refinance.

I wish my credit was good enough to get alternative financing.. and when I mean alternative I don't mean another Triad-type company. I feel like.... dammmm if you gonna f**k me, at least take me to dinner first. You would think that once you have established your on time payments with them, that they would cut you some slack, but they don't. I cannot wait to pay this car off and be done with them in their entirety.

I want to be part of the class action suit and I would really like to know how companies like this one are able to continue to rape people of their finances and GET AWAY WITH IT. Isn' there some type of usury law that prohibits how much finance and interest they can charge. Something needs to be done and be done right away. Good luck to all of you and it was heartbreaken to hear so many like stories.

I work for a repo company in Maryland. I unfortuntly was unaware of how bad Triad's name truly is. I can say with utter confidence, they are just as nasty and rude to us as they are to customers. We actually are in the process of dropping them for this reason alone. That being said, I would like to say I would like to join the class action suit you have going here. My vehicle was repossesed (beacuse of a half payment), and there was no notice of repossion before or after the car was recovered, which by state laws has to be done 10days before it may be out for repo.

I was never made aware that my car was being sold at auction, also state requirement, and my car was ILLEGALLY moved out of state. I had personal items in the car and went to pick the items up at L.A.B (the reposseion company),and all I got back was a single tag. I asked about the other items and was told they could not get access to the inside of my car, and it was all sent to PA to auction. Which was a mistake on her behalf, because MD law states a unit must be held in the state it was repo'd from for a min of 15 days, unless you cannot gain access to the car then it must stay for 30 days. My car stayed on lot 24 hours.


So saying it went to PA was a really bad thing for them.(Their lawsuit is in the works) My car was sold at auction before I was even notified. Then to top the cake the letter they sent me with the remaining balence does not include all the required info.

Triad is a dirty, evil company to everyone.

Roadloans (same company?) sold me an overpriced warranty that is absolutely complete garbage. I want in on this class action suit. I have an auto loan with triad, who in the beginning I thought was a decent company. I am an assistant teacher and do not get paid over the summer. I am, as of this email date, 10 days late on my auto loan. I have received calls EVERYDAY from this company when I have spoken to them and told them a date which the payment would be made. They advised me that they would still call everyday, or I could set up a payment plan over the phone. I refused said to document your files and do not call my house again, payment will be made on such and such date.

The calls have not stopped and the collection deptartment as of today was told again not to call my house and they started calling but when the phone is answered they do not say anything. Now it seems to me according to the FDCPA they should not be allowed to call after they have been told not to. I want in on this lawsuit. I have caller ID which will show the dates and times when they called and today alone they have called 4 times! Unreal. I'm going to look into refinance as a result of these kind of tactics. No loan from Triad

First, I want to state, I have no loan, nor have ever had one with Triad. I have purchased a car through a sub prime lender in the past and did experience problems, although this was years ago. I know how agressive they can be with collection of payments etc.

I can't help but notice a common theme in all the reports on Triad and in almost every post in this thread. Late payments. One, two or many.

If you finance through a sub prime lender and make a SINGLE payment late you are considered a collection account and your "risk" category is increased with the lender - until the loan is paid in full. From that point on, if you think they were treating you poorly before, be prepared because now in their eyes you are just another deadbeat who doesn't pay on time.

Another common theme is the "illegal repo" many posters related in this thread. In most cases as a buyer, those who posted this are ill informed. In most states the minute you default on a payment (i.e. one payment late) your vehicle is subject to repossession. In many states this can be done with no notice to you, in others they may have to notify you either verbally or by mail. But make no mistake - if you miss a payment date they almost always have the right of repossession in every case.

The class action lawsuit. I commend those who believe they were wronged for pursuing their problem through the legal system. Be aware, however, that most people who join a class action lawsuit find the final result is not quite as expected. If the suit is filed then classed by the court the only people who will make signifigant money out of the situation will be the attorneys. In most class action suits the victims who join the class find a token payment at best. It could be as simple as a $50.00 check or as ludicrous as a discount coupon on your next loan through Triad. The attorneys, however, will walk away with hundreds of thousands of dollars if not more.

If you feel wronged, feel your contractual rights were violated you are MUCH better off filing a private lawsuit. You will come out with a piece of the pie, rather than being given the crumbs from the crust.

Triad will simply not suffer in any class action lawsuit. Believe, that they have the financial resources to view this as a bothersome fly on a summer afternoon. In most cases businesses such as this are simply insured against such suits and don't pay a dime out of profit even if they lose.

I am currently battling with Triad and will need to contact a lawyer as well. If the class action suit is legit please provide me with the information as I would like to join. I purchased a vehicle that was financed through Triad in 2000. I came to the end of my contract in March 2006, which included about 3 deferrals. Triad stated that the deferred payments would just go to the end of my contract and extend the date by which the contract would end. What they failed to tell me was that they were going to keep charging me late fees and interest. Now my contract is over and they say I still owe $2,400 and it's now June 2006. They are sending my account into recovery and I'm not sure what to do. I've paid for this car for the last almost 6 years there's no way they are going to take it now.

My issue with them ended in a repo in '03, am I too late? I hope not. I want in, in the worst way.

All the same things that happened to people in this thread happened to me. Including an un-authorized repo. I had just made a payment arrangement with this guy over the phone, and while I was doing that, he had the orders out on {then} my car.

After, they took the car, and I called back irate, this same person made the excuse "your file got mixed up with another repo; sorry about that".

I didn't know better then that that was harrassement. It turned out to be one of the tactics they use to bully people into payments.

Please let me know all the details of the class action, and what the possible outcome can be.

I Want to Join the Class Action Suit

I, too, am a victim of Triad Financia (AKA Road Loans). I have composed a letter today that will go to Triad, the corporate office, the Attorney General's Office, and The Better Business Bureau.

When I first got the loan, I changed my payment due date so that I could balance my larger bills over a bi-monthly paycheck system. This year, my employer changed to a monthly system, and Triad refuses to change my due date. They state that they allow only one change. I am a single parent and cannot afford to make one payment ahead to keep me "on schedule." I've advised them of this payday change on several occasions, but the phone still rings as soon as my account is one day past due. On top of the high interest rate, I now must pay between $30-$50 in late fees.

I refuse to use their automatic deduction system. An account supervisor allowed me to make a payment "without a fee" a few months ago, but then charged a fee. Also, the payment was not deducted when I requested, and my bank account was overdrawn.

My complaint letter will go in the mail tomorrow, along with my two weeks overdue payment. My other creditors were more than willing to work with me when my employer changed my pay system; however, it is obvious that Triad is in the business of lending to people who need a helping hand in restoring their credit, but doing everything possible to bleed their customers dry.

If a class action suit is in progress, put my name on the list.

Kelley, I'm glad you filed all your complaints and retained an attorney. It's not over by far. I got papers from the court yesterday where I am being sued. I laughed my a*s off. With all the documentation I have not to mention the fax I received from my State Attorney General about the definition of harassment, the return receipt card I sent requesting verification, the recorded telephone calls, and much more, I'm looking forward to my day in court with these clowns. The law firm they have working this case, is just as law breaking as Triad themselves. Kelley, don't spend your overpayment all at once now. You may need that to pay Triad again upon their demand. What a bunch of s**+*. Keep us all informed as to your progress. I'll be printing off these rebuttals for the judge!!!!

Hello everyone , let me just say that if you are a victim of this SO CALLED company then PLEASE file your complaint with your state's attorney general AND California's attorney general AND the FTC. Just go to their websites and file a complaint online it is very easy. Please do it now , it certainly will speed things up in the matter of a class action lawsuit. I have filed my rip off report a couple times , I'm the one that had a clear title and proof that the lien was satisfied and they repoed our car AND I have proof of illegal withdrawls from our checking account THREE times. We now have officially retained a lawyer and he says I have an excellent case against these beasts. I've checked my credit report recently because I have read in the MANY posts on Triad that they like to dishonestly report to credit bureaus..and GUESS WHAT? Its says on there that WE STILL OWE MONEY!!!! Past due April 2006 $373!!!! Can you believe this?? Well I know you all can. After we just paid to get our car back and it still says we owe money WHAT IN THE HELL??? But that's not all of it. GUESS what comes in the mail today !!?? A CHECK FROM TRIAD FOR $375 saying right on there PAYOVER. I don't know what these people are trying to pull but I'm not having any of it. So this is to Triad's legal department: $375 IS NOT CUTTING IT AND WHEN I'M DONE WITH YOU I WILL HAVE 50 TIMES THAT AMOUNT!!!!!

My fears are realized

Well, it appears that Triad has done exactly as I feared. On May 6th, I traded my car in. I was getting close to being 30 days late on my loan, the payment or payoff needing to happen on the 15th. I wrote the check for my new vehicle, and drove off.

Now I know I am responsible for the loan and payment until their payoff is received. But I have no control over how long it takes the new loan to get funded and for the dealer to get the payoff to Triad. I got two calls today, May 17th. One this morning from Triad. The person I talked to was halfway decent to me and I explained that the dealer was waiting for the loan to fund so he could send the payoff out. She noted that in my account. This afternoon, I got a call from a "Kimberly" at Triad. This one was one of those knuckle busters who came out of the gate threatening me with going to the dealer and taking the car back from them, telling me how I am responsible for the note and payments, etc,etc.. She also said the I have already been reported 30 days late to the credit bureaus(nice of 'em, eh?)

She wanted me to give ther the name of my salesman so she could get me, her and him on a conference call, to try to intimidate him into doing something (what, I don't know as he is not in the loop anymore).

I told her if she wanted to call someone, to call the finance dept at the dealer. So, she did (after saying at the beginning of the call that Triad doesn't make calls like that).... I'm put on hold, and I come back on in the middle of the conversation with her and the finance guy who dod my deal. During the conversation about when the dealer would have the check to her, I jumped in and warned the finance guy to hide the vehicle as "Kimberly" was threatening me with going to the dealership and re-po'ing the car. (She did get the dealer name, address, etc... the kind of info one would need to give the re-po company)

"Kimblery" also said they were recinding the deferred payment I got back in November '05(a deferrment I paid a fee for, now)..... Looks like it boils down to this;

Either Triad is planning to snatch the car before the payoff gets there (she was told by the finance guy she should have it by next Wed. May 24th), or try to change the payoff amount to include that deferred payment (realize, now, that the payoff amount quoted to the dealer on May 11th includes any late fees, and also that deferred payment, in effect trying to get the payment twice).

This sounds wierd, I know, but I put nothing past Triad at this point, or trying to otherwise make the deal go bad, which means I would have to take back my new car and take my old car back, so Triad can piuck it up. (This make me appear paranoid, I know, but just remember who I am talking about).

Bottom line, Triad is trying to make this thing as difficult on me as possible, using their slime ball, bullying intimidation tactics on me. When all is said and done, I still have no control over how long it takes for the new loan to fund and for Triad to get their payoff. Many lessons learned for me, but Triad didn't have to be such assholes about this. Anyone else would have been much more flexible, and not acting like I was some kind of deadbeat slimebucket.


I know what a contract is, I know I am responsible for the payments. I am sorry that this process took longer than the 15th of May to get finished, but there is nothing I can do about it. But the way Triad treats people to me is criminal.

So, for anyone out there who wants to re-tort with one of your "it's your own d**n fault" posts, F YOU. And to Triad CSRs Marie and Jessica, Triad bucket carriers who respond to this and other Triad threads with your senseless blathering in defense of Triad, don't bother. Save your breath.

Angie, how can I get in touch with you in a way that can be posted here without the Editor deleting contact information? I want to be part of any class action that gets started on these beasts.

David from Texas, I am with you and I feel the same way. Triad will go down if it is the last thing I do. I have a new hobby and it is to make sure this sham of a company goes down for all it has done to people and make sure they do not do it to anyone else.

I am in the process of contacting the media and soon the public will know exactly what Triad does to its customers and the people that are 'too stupid' to organize against them will soon have our day.

I want to now tell EVERY VICTIM of Triad to file a report online with your attorney general's office AND California's attorney general, it is very easy. If everyone does this and keeps reporting Triad for its illegal activities it will only help Triad go down. I have PROOF of unauthorized withdrawls and a case that will hang Triad because they repossessed a car that was not LEGALLY theirs.

So I say this to every victim. Triad 's day is coming soon.

Triad is the most cut-throat company I ever dealt with. THEY STOP AT NOTHING IN PURSUIT OF THE ALMIGHTY $. The class action is going forward. Please don't think you are being ignored. It took Triad years to build up to their reputation, and it is going to take some time to get resolution. You will not be forgotten. About the time we decide we are going to file, more people come forward. With your case, I think you would have a great case just in itself, Find a lawyer that will take your case on a contigency basis and have that attorney sue them for everything. That does not mean you will be omitted from the class action.

I know this is not happening fast enough for any of us, but in order to hang them good, we need to gather everything, and that includes as many victims as possible. Please try (I know it's frustrating)to be patient and just keep us posted if your situation changes at all. Don't be surprised if you get a rebuttal(if you haven't already) from their legal department wanting you to contact them so they can "investigate" or "look into the matter". Don't give them the time of day. They know what they are going to be facing with their victims, so they are going to do anything they can to make themselves smell good. Hang in there, it will happen. Oh, just a little tid-bit for you so you understand the volume of victims, Triad has had in the last 36 months, more than 530 complaints filed against them. Surprise Surprise...... NOT!!!!!!

I am ready to be counted in. My wife has had two surgeries since March 23, one for a potentially life-threatening condition. Consequently, I got behind on payments to everyone, including mortgage, credit cards, Americredit(ack), and of course, Triad. My wife has since gone back to work(surgeries worked out ok)and we finally got what little short term disability she was eligible for, and I re-projected my budget. Thank god I was able to keep anything from getting more than 30 days behind(triad will be close this month).

Everyone has worked with me to get back on an even keel, but Triad, after giving me an extension last November, is using that extension agreement as a weapon against me now. I paid the fee for that extension, but they are still threatening me with being in default if my May payment isn't in by May 30(It's due on the 15th)They set up an auto payment for my April payment on May 12(three days shy of 30 days late)....They warn that if my May payment isn't in by May 30, they will consider me in default of the extension agreement, and will re-instate my November payment. I fear that what they will do is show that Nov. payment as 6 months late, to give them a reason to re-po the car. This would fit Triads' M.O. perfectly. I am working on a plan to get their payments in by the due date for May and June; meanwhile, I will try to trad the car on something else, just to get away from Triad. Triad is made up of low life knee cap busters who will openly threaten people instead of working with them. Life circumstances are irrelevant with them. Their attitude is, "too F'ing bad pal." "Pay up on OUR terms or we'll be coming after you".


My problem, I know(for all you self-righteous a**hol** out there who like to retort for the sole purpose of running people down, but no one deserves to be treated with the kind of disrespect and disdain that Triad imparts on their customers, regardless of past credit history. Human respect is for everyone, not just those with a credit score of 700 or higher.

Typical Scenerio of Triad. They have a reputation to live up to. They didn't obtain over 530 complaints in 36 month time to the California BBB, nor the handfull that can be added on top of that from the California State Attorney General's Office by just obeying the FDCA laws. They will continue to do this stuff until someone of authority grows some balls and takes the initiative to do something about it. Until then, we as victims are stuck having to take things into our own hands, and sue them via Class Action. Want to join?

My husband has a loan with this so called company and they are in my oppion are worthless, rude and very inconciderite. We have been behind in some of our payments but keep up the best we can There is just one major thing that bothers me more then ever, we never gave them out new home phone number they just have the one when my husband first got his truck.

Now all they do is call for the payment on the same day it is due. And will now not speak to me even though I am allowed to speak on the account I just belive that they are scandls and deserve to be punushed by the law.

I would love to be a part of your actio.I agree with everyone on Triad Financial. I am a single mom of 3 kids. My ex-husband bought a truck prior to our divorce. Guess who got stuck with the truck? Me. I don't work. Late on payments.I barely make house payments due to low child support.Triad calls everyday three or more times daily. I tried to trade-in my truck to get a car with smaller payments can't even do that. My truck should have been paid off by next year. The truck was purchase 2003 for 22,365.68 made my monthly payments(sometimes late). Currently my Pay off amount is $18,582.01. How is this possible? I figured that my pay off amount should be $5,276.58. I can't even get rid of the truck because I'm upside down. Today I recieved 5 calls within 2 hours.Like everyone else those calls start here at 7 am.Ahhhh.

I feel like I might have been ripped of too. A car dealer told me that he was almost positive that the truck had been refinanced.But when I contacted Triad they told me No. Help me.

I have a hard time understanding your insite and what you are trying to say. I'm taking it as if they don't do what you want them to do, then you'll blow their company wide open. Is that what you are trying to say? In the mean time if you get what you want then you'll just go away and take your "information" that would sink their ship with you? You claim they cover their tacks well and it will be hard to prove any wrong doing on them; well, we as victims are not stupid, ignorant people as Triad my have brainwashed you to believe. Any help is welcome, but many, many people have tape recordings, mail, emails, and most important other victims to prove a pattern of their business tactics. If you have so much information on this company, then do as so many others have done, and are still doing....File a complaint with the FTC and your State. They will be more than happy to get this "information".

As far as Triad themselves, what makes you think they will treat an ex employee any diffrent that the way they treat their own customers? We as victims have plenty of evidence to pursue them. Call us greedy if you will, but there are a h**l of a lot more victims out there than just what is known from this web site. I plan to find each and every one of them. I'm in no hurry. The more time I have to work on this, the better I will feel knowing I have helped as many people as possible.

Good luck to you getting what you want from your former employer. But if you were truely sorry for what you did to Triad customers, it wouldn't matter whether or not they are jerking you around. What do you think they do on a daily basis? Why would you as an ex employee with information on their illegal business practices have any effect on getting what you want? Hell, what I have gathered so far; I could own Triad, and I don't even have inside information.....yet. Good Luck

I want to join the law suit. I have been in contact with Triad via email, so I have all of the emails that I have sent or received from Triad. They lost 2 payments, which I ended up paying, plus I paid off my vehicle, just received a Title Holder Release, but no Title/pink which is somewhere in one of their safes by DMV. Oh no....I was told in email that they sent the Title to a residental address. I told them P.O. Box only due to mail theft.....I want to be in the law suit.

Triad financed our vehicle despite the fact there another finace company had a lien on it. We couldn't get the vehicle registered, therfore could not legally operate the motor vehicle in the state of texas. When we took steps to get the title ourselves, ( because Triad refused to assist us) Triad repoed the vehicle.

I've had nothing but problems with Triad for the past year. I am behind on my payments and while I understand that it needs to be paid, it's the way they go about doing things. They've called my home as early as early as 7:15 & 7:30 in the morning. They were calling my job and I sent out a letter to stop calling my employer in November 05. They've called my job five times since the letter went out. Isn't that a violation?

There have been other violations with them as well - too many to list here. I'd like to be part of the class action suit, but not sure where I am suppose to respond.

We had a loan with Triad and after we realized the financing and payment was not what we were told, we contacted then and after many phone calls and the rude people that work for them, nothing was done. We advised them that the payments that they expected us to make would not be possible. They called our home constantly.

We told them that we will turn the vehicle in. Instead they gave our phone number to their repo man, who called our house late at night and early morning wanting to come get the vehicle. We advised him that we would not do that, and that we will voluntarily bring it. We did, and then we got a bill from Triad for the repo. Now they have sent us to 3 different collections and we are still holding our ground.

Janine, Sorry it took so long to get back to you. Yes, at first Sergio was out to help, then he got overwhelmed by other discussed victims of Triad, he had to deal with them, so he turned me over to a wonderful liar by the name of Fred, he accepted the payment agreement, and the day my next payment was due, I didn't have time to make it. The vehicle was repo'd. When I called him about it, he tried to be this big wig legal department guy that wouldn't know his a*s from a hole in the ground. I emailed him a few times after my call from the investigator, and once he found out my intentions, he quit emailing me. (AHHHH, so sad) So instead, I decided to get an attorney to file a class action like I promised Sergio I would do. So yeah, I do retract my previous statement. He is a joke, as well as his sidekick Fred.

I am currently behind in my current month payment because I had to spend my car payment and another $300 to pay for a repair that this bogus Platinum Warranty refused to pay. I had to eat that repair PLUS the $250+ in rental fees due to this bogus warranty that Road Loaons sold me. They noted in my account that my payment would get there by the 26th of August. I half expect to get my vehicle repoed before then. The collections agent was a b***h to me, and told me that mailing my payment was NOT an option. I told her that it WOULD be an option when they open the leter and cash my check. I'll keep you posted.

I too have been ripped off by these scum bags!! I have been paying on my 1999 Plymouth Breeze for 5 years. I have been late on some of my payments because My son was almost killed in a horrific Crime. I was left responsible for almost 11,000. dollars in Hospital bills.

Anyway I worked out a payment plan with one of the many operators that they have. I made two consecutive payments for the month of June to try and catch up. In July I was to make another payment on the 15th. Well on July 14th, they came to my house and repossessed the vehicle.I was so mad. I had two payments left until it was payed off!!! I immediatley called and was told to talk to Amanda. I spoke to her and she said there was nothing they could do!! I needed to pay the two payments and then the repo fee of 450. dollars. She told me that one of my payments was returned. My bank said that it was indeed payed. Amanda said she could open an investigation but by the time they got results the car would be sold...REALLY SUCKS...

They got my car and I got a free Repossetion charge on my credit report..NICE PEOPLE!! I would love info on the class action law suit...

I see people from 6 or more different states victimized by Triad's fraudulent, deceptive, unlawful business practices. I urge you all to file an online complaint with your Attorney General. It's simple to do and takes just a couple of minutes. Sergio Padilla, Triad's Legal Management Supervisor, lied in writing to my Attorney General stating I was "welcomed to redeem my vehicle and Triad would wave the late fees out of good faith". What he didn't say was that my vehicle was already auctioned off for $3300. Sergio also stated "the Notice of Intent was sent to complainant pursuant to civil procedure", which was also a lie. Yesterday, Sergio told my Attorney General Rep. Ken Houghton Triad would wave the recent Deficiency Notice of $8.508.58. Traid is scare of the Attorney General's office and they have good reason to be. I paid 36 payments of over $14,000 for a vehicle Traid illegally repossed. Make your demand to you Attorney General for full compensation for the violations of your rights and State and Federal laws by Triad and demand that Traid's business license be revoked to protect the good citizens of your state. Also demand online that Calif. Attorney General revoke Triad's business license.

we were one month behind, with no calls no contact they came and repoed my vehicle because I declared BK 3 years prior. And now I just checked my account (the reason I came here to complain) becuase they only showed a $45 payment when a $420 posted to my checking account last week. I called and a man answered and said it shows. I asked politely at first to change the computer then and he said he can't and he was ordering me a pay history. I asked again and he said no. I then asked to speak to a manager he said and I quote "I ordered you a history" and hung up on me. I tried calling back for 2 hours and no one will answer now. I left a message for a Higher up manager to return my call, nothing so far. I have had it.

It appears that my payments do not get properly posted, my cell was not given as contact, however, the calls continued until a whistle was blown in the ear stating this was no a good number. I posted my new account information over the 4th of July weekend. A very rude representative stated it was posted by my bank of the 4th and returned on the 8th. As my bank replied ????. There were not attempts made to deducted from my account. I talked to another rep who very nice, he stated the account information was written down incorrectly (?), how can that be when it was done on the phone system and confirmed correct. The original rep did not want to take my information, the 2nd rep took the information again and wanted to charge me for their mistake. Then he responded and said oh I will waive that fee. There are many more stories. I heard that there was report done on Triad by one of the big News shows. What are the details of the lawsuit?

Changing My EFT Authorization Dates

I just recently setup a payment via Check by Phone. I confirmed and have a letter that states that the withdrawal is not authorized until July 2, 2005. Low and behold.. the money was withdrawn on July 1st. A nice kid on the phone told me that the phone record of the call that set this up was dated July 2nd while their internal records date it on June 30th.

I'm sure there is something illegal about this.

Triad Financial failed to post payments and then called bellsouth and cingular wireless, claiming they were me, and retrieved recently dialed numbers using my personal information. Then, within seconds, my clients received calls from triad asking for information about me. Bellsouth and Cingular provided me with info on the incoming calls. It is a federal violation (FTC and FDCPA) and I will be pressing charges.
