On 11/17/2012 our car was repossessed after our check did not go through due to an overage. We had no notifcation from them that our check did not clear and they show up and took car.We had called them when our bank notified us of the problem on 11/08/12 and customer service said it had gone through, we told her lets just  western union the money and she said no. It has been a week and I can not get how much I owe to get car back and they refuse to give me the pay off amount unless I supply them with 3 phone numbers other then what they have on file. They wont let me make good on what is passed due unless they have these numbers. I have recieved no letters or call backs from them. They leave me on hold for 20 minutes at a time and with a newborn baby it is hard to do this. I just want my car back and they wont let me get it!Please help

Temporary Restraining Order to Stop LOBELs Unlawful Harassment

Another consumer that was being harassed by LOBEL had a Temporary Restraining Order filed against LOBEL in Orange County Superior Court (Case No. 2012-00567479) to stop violations of the Fair Debt Collections Practices Act. Plaintiffs attorney was Joseph R. Manning.

Temporary Restraining Order to Stop LOBELs Unlawful Harassment

Plaintiff seeks an order of this Court to stop the harassing, threatening, and abusive conduct in the course of collecting on a consumer debt as discussed more fully below.

Plaintiff brings this action to enjoin Defendants, Lobel Financial Corporation, Gary Dean Lobel, Harvey Lobel, Murray Lobel, Alan Lobel and David Lobel (collectively "Defendants'*) from continuing with their campaign of deceptive and unlawful business practices and to recover for damages caused by Defendants' harassing, threatening, and abusive conduct in the course of collecting on a consumer debt.

Defendants' abusive collection practices are so pervasive and substantial that they drew the attention of the California Attorney General in 2009. In that enforcement action, some of the allegations against Lobel included:

a.          Calling its customers repeatedly and allowing the phone to ring continuously;
b.          Calling a customer's employer and family members; and
c.           Using a false name when calling.

Rather than litigating the action filed by the Attorney General, Lobel stipulated to an entry of Final
Judgment and a Permanent Injunction. Under the stipulation, Lobel was permanently enjoined from engaging in the following practices:

d.         Violating the provisions of the Fair Debt Collection Practices Act as set forth in California Civil Code section 1788 et seq.
e.         Violating California Civil Code section 1788.11 (b) by placing calls without disclosure of the caller's identity.
f.          Violating California Civil Code section 1788.11 (d) by causing a telephone to ring repeatedly or continuously to annoy the person called.

Lobel is a SUBPRIME lender.  You were PLACED with Lobel because of a reputation for NOT paying your bills on time.  Otherwise, you'd be with a bank with lower APR.  You pay them with a bad check which violates the contract YOU signed.  Whether or not they accept a wired payment or any payment from you, is up to them.  However, I would just about bet you've had late payments to them as well.  The only reason they want references is to try to find you when you fail to make payments on time.  Unless you plan on being late again, then what's the problem?  You mentioned "our check".  If there's another adult in the household either a real husband or a shack up honey, then why not get some part time work to make ends meet?  Also, you will never, ever have OVERDRAFTS if you keep a written check register instead of doing what lazy people do, "check the balance on line".
