Working with Joann Hunter Dalziel has been by far the worst renting experience ever. I rented a unit that was managed by Joann under Lotus International Realty. Throughout most of the lease I was constantly being harassed and threatened by Joann and her husband Max (the broker).

The owner abruptly, and without notice decided to sell. Joann constantly demanded access to the unit with no consideration of my time or schedule. Though I was under no obligation to show the unit Joann always threatened legal action if I was unavailable at a certain time, taking complete advantage of the situation.

After months of maltreatment a mutual lease termination was agreed upon. After leaving the unit immaculate, the walkthrough was signed off on Joann attempted to alter the documents as well as withhold the deposit and the remanding rent that was agreed to be returned. Till this day I haven’t received the amount owed nor will Joann answer my emails.

I have experienced many unethical and unprofessional encounters with Joann and her company and wouldn’t wish their bad business on anyone else.

Alexander Wesley Clarke lies

Everything Alexander Wesley Clarke wrote in this complaint is completely FALSE. It is despicable and reprehensible that he has the audacity to call us racist, because we insisted that he pay his bills/rent, and honor the lease that he sign like every one else. If we were so hateful and racist we would have evicted him ruining his credit, instead we tried to help him. Alexander Wesley Clarke was rude, ungrateful and completely dishonest when dealing with us.

His statement "After months of maltreatment a mutual lease termaination was agreed upon" is another one of his lies. He was ask to leave or be evicted because of his behavior. At no time was he ever mistreated by the landlord or anyone else for that matter. It was the total opposite we tried to help him. What Alexander fail to acknowledge is that we had to post several 3 day notice on his door for late rent payment. One month he was 31 days late paying his rent. 

Here are the facts: Four months after moving into the condo, on July 24th 2015 I received an email from the landlord informing me that he had not paid the rent for July. Alexanders's rent was due on the 2nd for every month. I contacted him via email and he informed us that things was slow at his job and he was thinking of re-enlisting in the military and ask if he could break his lease. We thanked him for his service, the landlord initially told him that he still had to honor his lease. She quickly however changed her mind and agreed to the early lease termination and agreed to let him break his lease as long as he provide us with a copy of his re-enlistment orders. He became very upset with us for asking him for a copy of the order and refused to sign the early termination agreement that he requested. We felt that he was looking for a way to break his lease without any consequences. Someone who was truly going to re-enlist in the military would have gladly given us a copy of his/her orders to get out of their lease.  

Even after Alexander refused to give us a copy of his re-enlistment order we STILL tried to work with him and agree to an early termination agreement we sent him the agreement for his signature but then he disappeared and refused to sign the agreement.

The landlord was considering selling the condo but after all of the issues with Alexander/Wesley not paying his rent etc., she decide to put the condo up for sale sooner rather than later. The day the decision was made to put the condo on the market we informed him of the decision. We informed him that we would give him 24hrs notice prior to each showing. We requested a showing for an investor who was very interested in the unit. The price was right, it was on a high floor, and the view was spectacular. Everything she wanted. We give him 3 days notice for the showing. I showed up with the investor and her real estate agent, Alex/Wesley opened the door invited us in and informed us that we could look any where in the condo, but we could not go into the bedroom or bathroom because he had valuable things in the bedroom and he didn’t want us in there. He had 3 day to put away any valuables, but chose not to do so. I was speechless. I then told him that our client needed to have complete  access to the entire unit to make an informed decision in order to purchase the unit. He flat out refused to let us into the bedroom and bathroom. He told us to go out on the balcony and look through the sliding glass door at the bedroom and bathroom. He was rude and disrespectful. After leaving the condo the investor/client informed me that she liked the condo but did NOT want him as a tenant she would only purchase the condo if the tenant was gone because she did not want to deal with him as a tenant. My client lost that sale. We lost a total of 2 sales because of his bad attitude and his behavior.

After losing the second sale, Alexander being constantly late in paying the rent and his very nasty, ungrateful attitude. The landlord had enough and ask him to leave or he would be evicted. The landlord consulted with her lawyer and he informed her that she had more than enough grounds for an eviction.

Even after everything Alexander/Wesley put us through, I still felt sorry for him and ask the landlord not to evict him and ruin his credit, but to try and come to an agreement with him for an early lease termination. The landlord once again graciously agreed to a second agreement with Alex/Wesley to terminate his lease early. After much fan fair he eventually sign the early lease termination and agreed to move out of the condo on Nov 15th 2015.

On move out day we agreed to meet at 1pm for the final walk- thru. Alexander/Wesley was 1 ½ hour late for our appointment. After his late arrival he still had quite a few item still in the unit to move-out. Another 1 ½ later I finally took possession of the condo.

Wesley/Alex statement about leaving the unit immaculate is another one of his lies. Please see attach email where he acknowledged on Nov 20th 4:16pm “I will still honor my commitment and send over the cleaner.” He did not leave the unit professionally cleaned as promised in his lease termination agreement on move-out day. The unit was dirty. The new tenant couldn’t move in because the unit was dirty.

An argument ensued over other issues and the return of his deposit.. Alex/Wesley became aggressive grabbing the move-out sheet that he had sign out of my hand. I told him to get away from me. A by stander ask me if I needed help or should he call the police. I told him no and got into my car and drove off.

The following day we all started receiving harassing phone calls and emails from Alex/Wesley and his co-horts/thugs friends threatening me/us that we would be sorry if we didn’t return his deposit.. We now realize that Alexander followed through on his threats by posting lies about us and our company trying to ruin our reputation.

I tried to help Alexander/Wesley by returning his security deposit to him on the day of his final walk-thru because he informed me that he needed the money right away. I told him if he complied with the terms of his early lease termination agreement, we would return his deposit. This is not how we normally return security deposits. Florida law states that after a tenant moves out of a rental the landlord has 15 days to return the security deposit, if she/he is not making any claim to the security deposit, and 30 days if she/he is making a claim to the security deposit. I warned Wesley/Alex in advance that he must comply with the agreement in order to receive his deposit on move-out day. He did not comply so we followed the law.

We showed compassion and understanding toward Alexander because of the situation he “claim” to be going through. Every thing Alexander/Wesley experience was self inflicted. He need to be a man and accept responsibility for his actions. He demanded that because he could no longer pay his rent we should let him out of his lease and return his security deposit, without any consequences. Foolishly, we eventually did just that for him now he has the audacity to file a complaint against us. Despicable!! 

In conclusion as required by law a certified letter and check ($3300.00) was mailed out to Alexander Wesley Clarke on December 1st well within the 30 day that the law requires because the landlord was deducting $150.00 the cost to have the unit professionally cleaned from his security deposit.

We have contacted our lawyer and is taking legal action against Alexander Wesley Clarke for the complete lies he wrote in his complaint about us and, his attempt to ruin our company’s name and reputation. If we were racist as he claimed we would have NEVER rented the condo to him in the first place.

Our response is a truthful and factual description of the events leading up to Alexander Wesley Clarke lease termination.. Please see attach FACTS to backup our account of events, email correspondence between us and Alexander, contracts, etc.
