LBN just filed a judgement against me, the court date was set for 10-22-08 but they got the judgement on 9-22-08. I don't know what to do. If I have known about the 9-22 date I would have went. They never responded to my proof of validation of debt. They are rude. They will not make payment arrangements on this erroneous debt. I need help in getting this disputed. I had followed everything as you guys had stated, but due to the differing court dates, got screwed. Is there any hope??

I would contact the clerk of the court, in person if possible, to review the NOTIFICATION documents to determine HOW the court notified you of the Sept 22 court date.

You indicate that the court date was Oct 22. Are you sure about this? If Oct were the true original court date, then the court date must have been changed by the court and the court should have some documentation that indicates that you were NOTIFIED of the change. IF the documents do not indicate that the court notified you of the date change you have grounds to approach the court to have the judgment vacated and schedule a trial. You need to review the notification documents.

IF you were notified that the court date was Sept 22 (and NOT Oct 22) then you have a real problem-the judgment is in place and if you don't fulfill the judgment, you can expect some enforcement orders from the court at a later date. You should consider hiring an attorney.
