Cox Enterprises, Manheim of Central Caifornia is a vehicle auction company; and is going through downsizing due to the economy. But their employee plan is corrupt and I think illegal. They have notified employeee groups/teams of short and long-term employees, both full and part time, that they must now re-apply for the posiiton they currently hold. In effect, this is informing the employee that as of a certain date they are no longer employed; then in consideration of the new application for the same posiiton, they do not need to re-hire the particular employee. So far mid and lower management positions have been vacated including positions in transportation, marketing, dealer purchase inventory accounts, and incoming auto registry, and arbitration. They are merely informaing the employee that they must re-apply for the position. As stated above, many of the re-applications have not been approved.

I believe this is an illegal ploy, although I have not fully checked it out. They are intimidating the employees into the re-application process by simply telling them they must do this. In effect this is a willing "quit" by the employee of their current position. When they re-apply for their current position, then the company does not have to re-employ them because they are a new applicant. I believe this affects the employee's ability to obtain unemployment insurance payments and potects the company's account from being liable for the payments. They do not inform the employee of their rights in this matter, it is simpy done by coersion and the employee's lack of leal representation or knowledge. I think this process is not legal. I do not believe current employees are bound to quit and then re-apply. MANHEIM is one of the largest auto auctions in the world, with several locations in the U.S. and California. I think this is big-time fraud.
