I had a default judgement entered against me by Mary Jane Elliott, PC, of Novi, MI. She is representing Midland Credit Management, who bought a charged of debt from Aspire Visa card..all of which are crooked entities.

I had problems with the credit card company, because they were not able to explain to me the discrepancies with my account and I eventually closed it. It was charged off and later bought by Midland (probably for pennies on a dollar!). They in turn, hired the legal ofc in question, who I found sued me.

They obtained my parent's address and mailed the court documents there. I live in a DIFFERENT city and had not used that address in several years. I never received any of these documents to appear in court and a default order was issued against me. I did not learn of this until I saw it on my credit report and a "Writ for Garnishment" was issued to me from my employer. I filed an objection with court in that city and the judge did not even listen to anything that I had to say or any proof that I had.

So, Im stuck paying these people money that I do NOT owe and am stuck trying to find out how to fight against them. If anyone has any information PLEASE let me know! This type of unfair practice needs to end.

Your mother and or her staff routinely file false legal docs to collect money

I will suppose that you are her actual daughter, I feel for you, no one wants to think their mother would knowingly do something wrong. But I know for a fact she and her staff do routinely file false information to get liens against people. In my case I even called her office and told them I don't owe Midland Credit anything, and I don't live at that address, haven't for over 10 years. I sent a certified letter to them also. How did I find out they filed a false legal document to steal my money? When the state held up my income tax refund. What is the solution? I have to go to the court in person, or hire a lawyer to prove that I was improperly filed against. The court is 150 miles away, I can't afford an attorney and I'm a disabled veteran. THis year I will try again to get them to stop stealing my money with the aid and assistance of the state, but we can all guess how this will turn out. Wish your mom a Merry Christmas, card's in the mail.

I received my information from your mother's office, I did not go through the court system rather I made payment arrangements with your Mother's firm. I need you to know, that it is your mother's choice to take on these debts (she has 3 of mine, all credit cards and all were from a divorce waiting for settlement to pay off), we did not ask her to purchase these debts. She is also aware that these debts are most likely not going to be paid in full all at once because, let's admit it, if the person with the debt has not paid it off in one lump sum by now there are usually good reasons. She purchases these for pennies on the dollar, so if my debt is $6000 she probably paid around $100-200 for it, I have No problem paying your mother back for what she paid on my debt or even a little more, but to pay your mother the entire amount at this time is not an option I have. As a single mother, single income, I was recently laid off with no notice, I am owed 5 paychecks and just filed for unemployment for the first time in my life (I am almost 40). I have never relied on anyone to pay my bills and refuse to choose to pay your mother before i pay my light bill and heat...and my mortgage is 90 days behind... your mother is the least of my worries as a mother myself and one would think as a mother she would sympathize, I have proof of my life not just my word and i do not lie. I have called the office to try to make new arrangements and no one will do it, they just garnished my checking which had the check from my ex for child support in it, not earned wages (so that makes it illegal) she then put a hold on my unemployment income from the state, um, also illegal. now i have to go to court to file an objection and wait for a court date. tell me... does your mom care that my kids have to be fed at family and friends houses until this gets resolved because she took the grocery money? nope. does your mom care that I am currently seeking employment and that my actions did not cause my current situation? nope. does your mother care that it is out of my control? nope. has your mother garnished ALL of my state tax refunds for the last 3 years with my blessing to help pay this debt? yes. I missed a payment to your mom and the garnishments started, I have attempted to try to resolve this with your mother/her office and am told "too bad" & "we will continue garnishments until you send us a cashiers check for the payment in full" so now, you tell me ... how am i supposed to come up with that when she is taking anything and everything I have? I am asking for HUMAN understanding and compassion, tell me how much your mom spent on my debt and i will get it to her if she has not already collected enough from me to cover it. until then... back to court I go. So I wish you a very happy holiday, while you are toasting and enjoying your meal know that I will not be doing the same and the woman across the table from you is to blame. Know as you are opening your gifts that i have in some way helped pay for, that my kids are opening nothing for the first time in 18 years from their mother, as a human being you should be able to see that this is just not right, also ... if there was any compassion in your mother's body she would offer free consultations for credit repair and offer a list of free lawyers to aid in helping low-income families not harming the state and the debt issues... not the opposite. sorry you have to read all of this through forums such as this, I am sure you have amazing memories of growing up and of your mother, and you may want to learn to seperate that from her "job" because at home she may be a sweetheart, but in the real world she is rather ruthless and unkind.

Your mother doesn't care who she goes after, she is in the business of trying to profit from alleged debts that she buys from creditors. She is in it for the money and doesn't care about the defendants' innocence, nor does she investigate the facts or abide by the law. This is why she has had so many lawsuits and complaints filed against her.

This site is called "Ripoff Report.com", not "consolation.com". Nobody comes here looking for consolation, but to warn others of your mother's unlawful practices. The fact that you would google your mother to try to find these complaint websites so you can defend her is admirable, but YOU need to gain some "sense in the real world" and face the truth about your mother.

Apparently your mother is not very intelligent either because she hasn't taught you well enough to know that not paying a debt is not "stealing", different people find themselves in different situations of financial crisis, or are you not aware of the current economic status of Michigan?

Your mother is just like Kwame Kilpatrick, looks and all, and remember even Kwame had to pay and serve time. No one gets away with something forever, including your mother.
I have made it my personal mission to make sure of it.

I feel sorry for you and hope one day you wake up and grow up before it's too late and your mother takes you down with her.

What about the court?

So your parents didn't bother to notify you that they received a SUMMONS for you to appear in court-notifying you that a complaint had been filed and you were being sued?

You need to approach the court and make a motion to stay or vacate the judgment against you.

Be warned that you need to establish 2 points for the court to stay/vacate the judgment;

1. IMPROPER SERVICE. You need to establish that you were not properly served. You can prove this with the "proof of service" documents on file with the court.

AND

2. You must have an AFFIRMATIVE DEFENSE against the alleged debt. You have to be able to prove that the debt is not yours, is not valid, or was beyond the statute of limitations when they filed the original complaint against you.

I suggest you consult with an attorney.

pay your bills, my mother doesn't go after innocent people, and the fact that you would turn to the internet for consolation shows you have no sense in the real world. If you buy things on a credit card and don't pay the credit card company, that is in essence stealing, you know already that stealing is against the law, you SHOULD be in jail.
