MBF Leasing LLc Demanding Payment on Expired/Voidable Contract New York New York

MBF Leasing has sent a Final Demand letter to my significant other for a lease dated originally 11/2006. Her company closed and the equipment was returned , at the beginning of 2007. The bank account was debited a total of $322.00, without authorization after closure. When I call Louis Cucinota at MBF, to get the details, he first said there had only been two payments and tried to say that equipment was not returned. I advised him that we have copies of the return and he suddenly found the confirmation.

The statue of Limitations in New York is six years thus, this is expired! Louis did not want to admit to that and said this would only go away with a payment or settlement. I advised no service was provided after equipment was returned and that they had taken monies out of the account. He tried to convince me they did not. But admited that the above total was debited!

In conclusion, they will try to get you to pay for whatever they want by threatening legal action even though contract has expired. Stay clear of this company as they have a long record of similar actions listed in Ripoff Report. We are going to use all legal means to file Official Complaints with both the State of New York and the Federal Agency governing this company.
