Mr. Jernnigan approached me at a time that I was acquiring my business from a unethical partner and had to set up a new credit card company quickly to coincide with the closing date of the legal transfer of property to me . He sent in his nice, unassuming brother-in-law to make the initial contact. This guy was low-key and new at sales and inspired trust. However, once Mr. Jernnigan came on the scene to push me to sign up before I was ready, it was less comfortable and I should have trusted my instinct and walked away.

He promoted himself as a small business consultant and would be helping me out in other ways than just the CC sales. He told me my current credit card machine would be obsolete in less than one year. He told me that while the contract with MBF Leasing was for 4 years, HE would only require 3, and I stupidly believed him. He coached me to tell the MBF leasing agent that I understood it was for 4 years even though he was "only holding me to a 3-year commitment".

He looked at our previous CC statements and promised HIS rates would be much lower than our current company, but we ended up paying significantly MORE each month with him.

After he "pitched" a proposal to a new business neighbor, they looked him up found out about the questionable business practices. After finding out how I had been "taken", I tried to contact Mr. Jernigan, only to find his phone service had been disconnected. He had been coming around when he hoped to get other contracts in my shopping center, through me, but when that failed, he quit coming around anymore. I was ready to just pull the plug on their access to my account and simply default, but I spoke with a restaurant owner in my area that had done that, received a summons to go to New York and had to pay a LOT of money to get out of it all.

This guy seems to prey on small business owners, new to the "game". I tend to trust people and take them at their word and because I was trying to salvage my ownership of my business from a partner who proved to be fraudulent, and rushing to get things set up by our "Closing" date, I made a serious error in judgment and should have been more careful with whom I trusted.

I wish the North Carolina State Attorney General would go after this guy AND the companies he represents. It's hard enough for small businesses to survive without having to battle these kinds of people!

Penny,

I am sorry to hear that you have been preyed upon by an unscrupulous salesperson(s) in your area. The situation that is described in your case is not something that is new to business owners.  Sales people are pushy and over bearing and basically that is how they are.  They just want to sell.

You stated that you were in the process of buying out your unethical partner at the time that Mr. Jernnigan approached you with the deal.  One would think since you already had dealt with a dung bag, you should recognize another one at first site.

Why did you not follow your instincts as you stated in your letter? Was he a good looking fellow and did you think that something else was there? Penny it seems either you were slipping at the time you met him or you did not wear your waders.

I am sure that the paperwork that he presented to you had one of the following lines  NON-CANCELABLE LEASE  or CANCELABLE LEASE on the top of the page.  It is required by law that is stated whether or not if the lease is either of the two statuses.

He told you that the lease was for 4 years which was probably true since most of the leases I have seen are for that time frame.   It seems ironic that you would believe him with such a statement that he would only require a 3 year commitment when he already told you that the MBF Lease was 4 years. 

Did you read the paperwork Mr. Jernnigan presented to you?  Did you ask any questions concerning the fees that you could possibly be paying?  Just to let you know after you signed the paperwork, and before the leasing companies ACHs your account, they call and verify with you,  that you understand the paperwork you signed.

After the equipment is installed, the leasing company will call you again and ask you a series of questions prior to pulling funds from your account. The question would be similar to, "do you understand that is is a 48 month NON CANCELABLE LEASE", "do you understand that $XX is the amount that will be deducted from your checking account"? "Lastly do you have any questions about the lease"?

Now if you live in one of the few states that forbids NON-CANCELABLE LEASES, the paperwork would reflect that in plain sight.  I believe that those states with CANCELABLE LEASES gives the merchant 3 days to change their minds before the contract is consummated.

Your failure to handle your business should not be a legal issue at all.  It is your responsibility to make sure that you understand the documents in front of you.  If you do not understand the information, ask questions.  It is not against the law to ask questions.

In the future Penny, be a smart businesswoman and ask as many questions as possible.  If the Sales Rep cannot answer the questions, have him/her give you the number to the corporate office and ask those same questions of someone higher in the food chain.  Remember, you are only as dumb as the questions you did not ask.

Another Robert Jernigan/Vericomm ripoff

You need to start writing letters and calling and complaining to Wells Fargo's corporate HQ in Walnut, CA about Vericomm. Wells is who Vericomm uses to fund all of there transactions and they really do not like bad publicity! I would spam them in writing and via emails weekly as well as call them to tell them how badly Vericomm's reps lie! When you call them tell them you have a complaint about one of their merchant ISO organizations and need to be transferred to the head of that department. Do not shut your checking account down that is being billed for your current lease payment. If you do they will ruin your credit in two months and get a judgment against you. Mr Jernigan was paid $2,000.00 the day after he installed your machine because of the worthless lease he got you to sign. Good luck!
