Internet Sales pre-approved me, but did not give me the $500 off when I presented the Internet coupon - "we already put that in the deal."

Kirt in finance would NEVER treat "a guy" like he did me - or if he did, I'm sure he would get cold-cocked. Kirt started our lovely encounter by flinging papers across the desk, ORDERING me to sign. Most forms had blanks (were not yet filled in yet); one was completely blank and required initials to indicate I had received or been told a bunch of stuff I had not. I told Kirt I would sign that later and he showed he was miffed by snatching the form back. Then, he presented his typical "worksheet" showing how much my monthly payment would be if I chose the 2, 3 and 4-year used-vehicle extended warranty. I asked "does the vehicle have any manufacturer's warranty available?" Kirt, omnipotent perfect finance man that he is, stated "No, the Jeep has over 36,000 miles - you NEED to buy a warranty." I asked him why would sales tell me I was only worth $300/month payment, yet now finance suddenly thinks I am good for $600/month? He sneered and said I could get the 2 year plan, my monthly would only be $400. I took a paper from his stack and wrote my monthly budget out, showing him that it would be way too tight to add another $60 to my payment. We went round and round....Kirt the domineering master of car repairs nightmare scenarios, me worried that I was buying a car that would break down and leave me stuck with no wheels and a payment - and no warranty.

Kirt told me to get the warranty, keep it six months, take the car to a mechanic to get things all fixed, then cancel the warranty. He also threw in that I could re-finance the 5-year loan after six months at a very low rate, so all I had to do was tighten my belt for six months. It being late, knowing I had to go to my mom's to get her to sign some parpaers for the trade-in, I hadn't eaten dinner yet, the dealership A/C was broken and the stench was getting to me.....I acquiesced reluctantly to the warranty, already worried about my finances for the next five years instead of happy about my new truck.

At my mom's, the salesman took her check for my down payment but had no papers for her to sign (the trade was in her name only.) I had asked Kirt why I was signing forms that seemed more appropriate for mom to sign - that really antagonized him, tho, so when sales dude had no papers and called the wondrous Kirt to confirm, I shrugged it off, thankful I could now go eat dinner, at 9:00 pm.

Kirt next contacted me 12 days later - he got me financed, according to his nasty-sounding message which demanded that I come in to sign new papers. (former collector with hemmorhoids, is he?) I called Kirt back to find out what changes were made to require a new contract. He told me the payment changed a couple of dollars. I breathed a huge sigh of relief (I know their tricks). I went in, and Kirt looked fakely-stunned when he printed out the new contract. Apparently "someone" had required another $1,000 down payment! I told him I did not have it; he siad I could owe it to them. I told him I still would not have it, and I asked him to change my 1st payment due date to give me a little room to pay them at least part of it. (I am on permanent disability and get paid one time per month.) Kirt, psychic that he is, told me that "the Bank" demanded that the payment be due that day; it COULD NOT be changed. I asked him mto call; he refused and instead pulled out a promissory note and threw it at me. He told me to just sign it. The due date was blank (I was a contract manager before I went on disability). I asked him when the payment was due, he said "when we get it, I'll fill that in." So, I wrote "upon receipt" in the blank for the Due Date, and signed it. Kirt looked disgusted, threw the note to the side and did not bother to give me a copy. I asked him again if mom needed to sign a power of attorney or other forms for the trade; he angrily snipped something about his being a professional and that I should run along and let him worry about his job.

While relaxing that weekend, I read the owner's manual on "my new truck." Apparently Jeep (and Chrysler and Dodge) offer their 7 year/70,000 mile warranty to the second owner of the vehicle, for a $150 transfer fee. I called Jeep; yes, I was the second owner, and for $150 I could have the powertrain warranty. I was furious. Yes, Kirt had sold me a deluxe warranty, with deductibles, that would cover more than a powertrain, but I was not given a choice, and Kirt seemed to think that he was the consummate professional. Why did I finance $2,000 over five years at 13.95%? The truck is a 2004. How much warranty does it need? More than the cost of my health insurance? What are we insuring, Fort Knox? No, we are paying a commisison, is what I concluded. Well, Kirt and his new boss, Mark Stahl, treated me like garbage when I went in to cancel the warranty. Yelling, sneers, a blank cancellation form flung at me with a barked order to "FILL IT OPUT!" I did not even get a pen! Then, Kirt demanded "get your mother in here - I need her to sign papers." The guy has nerve. Then he left a nasty message for mom, and me, that night...we were not getting in to sign his papers fast enough, apparently. When mom and I went in, Kirt gave her the same treatment - he threw papers at her, all blank. Mom is 70; there was absolutely no need to penalize her for his oversight - the salesman was supposed to take her papers the first night....

I sent a letter of complaint to the staturoty agents for Mel Clayton Ford and Ford Motor Credit asking that the $2,000 warranty monies be applied immediately to the loan, and to rework the loan to lowere the monthly payments. I ccopied it to the BBB, Attorney GFeneral consumer complaints, Mel Clayton's GM, and GE Capital (the warranty administrator). GE Capital called three days later to tell me they gave Mel Clayton Ford the $2,000 back, and they apologized for the problem. Ford Motor credit wrote and said they'd apply the money to my loan and rework it once they got the money from Mel Clayton Ford. Let's see, Mel Clayton Ford got the $2,000 back on July 6. Today is July 23, and Ford Motor Credit still has not gotten the money . Mel Clayton Ford has not called me, wrote me, or responded to the BBB or AG. I guess they like their employess to act like asses. That was the third vehicle I bought from them; now I tell everyone to STAY AWAY FROM MEL CLAYTON FORD.

I do agree that car dealerships get several lawsuits a year wich sure most people realize is that they settle out of court but i have noticed that tracy has made a few mistakes that a intelligent purchaser would have not done and also being in the car business i realize that people do this all of the time....

FIRST AND BIGGEST MISTAKE.....
NEVER NEVER EVER SIGN A BLANK PIECE OF PAPER.

Second.
If a dealer asks you to resign and you are not satisfied with amounts or more down payment or term you have all right to not sign and you can be let out of the contract because the first one you signed the bank didnt obviously accept so you are signing it again APPROVING the changes you can say no hand them the keys and leave.

Third.
If buying a used vehicle do your research and do not buy the car the first day go home resear ch the one you liked and go to kbb or edmonds and get pricing information there.

from the other point.

If tracy is mentally unstable being a graduate from a real estate school i have learn what can make a legal contract NULL IN VOID!

1. If contract is being agreed and signed by a minor (under 18)

2. Making a legal binding contract with a person under the influence of illegal drugs,alchol, or prescriptions.

3. Contracts with the mentally unstable.

I understand where you're coming from; unfortunately, you are wrong, and I am right. She is psycho and in counseling. I feel for people with true disabilities. I feel nothing for people who use their "disability" to benefit themselves. Even though she got me fired I am still paying her income through social security.

To Tracy:
You seem to have the ability to slander characters at will, and yet when the truth about your ambiguous past is revealed, you have nothing more to say. I have to give you credit, this is the third dealership you have scammed and have not been penalized, arrested, or turned away.

Tracy knows exactly what she is doing in regards to driving a vehicle she signed for and then 'playing the crazy card'. She needs something to do besides spending her day trying to get something for free or someone fired. Since she is not able to make sane decisions on her purchases why is she allowed to control any money? The crazy bank that holds her money should be held responsible for any bills she aquires and then pay them back, such as down payment money she thinks she is getting away with not paying. She has gone a little too far in this complaint and I hope that she is sued for defamation of character by all of those mentioned.

Wow Tracy Stewart Does It Again !!!

This is the third auto dealer Tracy Stewart has written this same complaint about. My name is Mike and I worked for ABC Nissan. The reason I say I worked for them is the SAME LETTER got me fired. This woman is no longer working because she is mentally disabled and she goes into dealerships buys whatever she wants, drives it for a couple of months and then all of a sudden has a problem.

Now because she is "phyco" she gets free s**t or gets them to do stuff they would not usually do, why is that? Well a woman on the "disabled list" against a big bad dealership makes for good media. I have been looking for this letter to come up since I got fired from ABC Nissan. She sits at home and does nothing but plan how to mess up people's lives. The funny thing about my case was she claimed that she was in a "crazy phase" that lasted 4 weeks and it was long enough for her to buy a car a double her payment. Then she drove it around for a couple of months. When the new car wore off and it was time to make a payment. Oh NO it was the dealerships fault not mine. Now because we gave her a free car she must think that Mel Clayton will do the same. I BEG OF THEM NOT TO since this letter is almost the same she wrote us I know where this is going. Fight it, you all only sold a car. Do not keep messing up like we did. We made a HUGE mistake buying that loan back to make her go away.

Of course it was the Big Bad Car Dealerships fault. We had to buy back the loan from HSBC on that one because she liked a car but couldn't afford it.

You have to ask yourself why do so many local car dealers wind up in court wih their customers?

If car buyers went to the above URL FIRST before going to the car dealer of their choice to buy a car. If a car dealer has MANY LAW SUITS one needs to do some serious thinking as to which car dealer to buy a car from.

My big anger is with many in the media that are to be reporting news to PROTECT YOU from scams look the other way when it comes to car dealers. Go to any local TV station and local talk radio/ NEWS station such as KFYI 550 AM and other so called NEWS STATIONS will never do any reporting on car dealers.

I believe because they LOVE the BIG money they get from the very car dealers that RIP OFF their listeners. Many radio and TV stations want you to listen to them or watch their TV station, but when it comes to protecting you by reporting stories on scummy car dealers, THEY LOOK THE OTHER WAY, and say it's NOT NEWS YOU CAN USE!

I tryed to get 3TV to do a big story a few years ago. I was working with their "On your side" reporter Rich Skidmore. He told me that the story that I told him about and helped him put it together HAD NEWS written ALL OVER IT!

He told me that if they would not air the story, he was going to quit is job. He no longer works there, he told me he quit his job.

I might ask Rip Off Report's editor if he wants to set up a page so you can down load some of the recorded conversations Rich Skidmore and I had about the story 3TV did not want to inform you fine folks about.

TV 15 a local ABC station will go after small restaurants that are reported as being durty. But bring them some true trusting info about a local car dealer scam and NO WAY!

You have to think the way I do. I feel that if a car dealer ripped you off, the Rip OFF started with the Medai who got your attention to go to that rip Off car dealer. THE MEDIA!

If a local TV station or radio station got you excited and ready to RUN to a car dealer and you get Ripped OFF. You can thank the media for helping the deceptive car dealer find VICTIMS or PREY to Rip OFF!

If I was ripped off by a car dealer, I would post the name of the Radio station that ran the deceptive commercial. Maybe if the Radios or TV stations get listed in the Rip Off Reports, maybe they would start refusing to air some of the DECEPTIVE commercials that the dirty car dealers want to pay them BIG MONEY to air.

If not for the media, car dealers would have a MUCH harder time finding PREY to make them into VICTIMS.

Want to see if what I am saying is true? Go listen to Bruce Jacobs at 550 KFYI AM try to get him to talk about car dealer cams. He is on Monday -Friday from 5 AM to 8 AM. Call him up at 602-258-5394 and see just how fast Andrew Babenski parks your call in the trash can!
