If you are a contractor that has been solicited by Menemsha Development Group, Inc to perform any work on construction projects Do Not Sign a Contract or Perform any work for this Company.
The project managers for this company will lure you in by awarding you a contract then tell you that additional work will be paid through change orders. Even with on-site management from Manemsha giving instructions to keep moving forward with work and approving changed verbally on site, the project managers at the corporate offices that never set foot on the jobsite make every effort to deny changes after the required work has been performed.
Our company recently performed work for a General Contractor hired by Menemsha and we were instructed to modify fire sprinkler systems on several job sites. The General Contractor that hired us actually showed us a documented e-mail from the project manager at Menemsha specifically outlining how we would be paid by submitting the costs for the work via a change order.
The original bid that the General Contractor submitted to Menemsha included a $1500 allowance for the sprinkler work at each site but the project manager from Menemsha that awarded the contract told our GC that she had to remove the line item cost for the fire sprinkler work in order to keep the initial award cost down and instructed the GC that she would in fact pay all costs for such work through change orders once the work was completed. The GC has actually shown me this documentation.
Now several months has past since the work was completed and we have now been informed that she has denied the very change orders she said she was going to pay for, this after all of our work has already been completed. She referred back to the contract that included the scope of work description for the fire sprinkler work, but with a zero cost inclusion in the original contract award for such work. She now says that she never said she agreed to pay for such work via change orders even though we have documented evidence to the contrary. Our company is out over $5000 for the cost of this work and we are at a point where if we do not get paid immediately, we will be forced to file a lien and lawsuit against Menemsha and the actual property owner (Safeway) where the work was performed, or simply go back to each location and remove all of the components that we installed.
I understand that the GC whom hired us now has over $68,000 of outstanding balances owed to them by Menemsha for work that was completed as long as 5 months ago.
Menemsha has hired contractors through deceptive and dishonest practices and they should be held accountible in a court of law for such actions.
