On April 3, 2007 my son was in a vehicle driven by someone he recently met and the guys girlfriend. They pulled into a gas station and a patrol car pulled in behind them.
My sons friend took off because he said he had a warrant and was driving crazily on the wrong side of the street. The police chased them and he went into an apartment complex well ahead of the police.
They all jumped out and ran( I think my sons friend knew someone in the apts.) My son ran also and climbed over a wall to a different building.
The police caught him and sprayed him so much with pepper spray both before and AFTER being handcuffed, that a neighbor came out trying to help him by turning on her hose to spray him and stop the burning.
She was told to go in her house.
My son had to be taken to the hospital and treated for shortness of breath and burns caused by the spray. The police were given 2 prescriptions for him.
(We have never seen them)
He was questioned about where the other people went and charged with aggravated DUI and Felony flight.
I feel because they could not find the others ,they needed a scape goat.
My son was not the driver but, they don't care.
The other fellow surely isn't going to step forward and admit his guilt.
Unfortunetly, I found out that the vehicle was just recently bought and the title wasn't in this guys name yet.
I have major health problems and have to spend money that I can hardly afford to spend to hire an attorney to go to trial.
I am very afraid that my son will be found guilty because he cannot provide the others to the police. I know they were outright mean because he never got the prescriptions the Dr. wrote.

You need a public defender. If your income is as you say you are entitled to one.
Your son committed a felony. fleeing from a Police Officer and refusing orders to stop is a felony and he is lucky non lethal force was used. If he was pepper sprayed excessively as you indicate it is VERY likely he was refusing the officer's orders to lie on the ground and/or show his hands. He was most likely struggling or attempting to get away.
It is HIGHLY unlikely he was continuously pepper sprayed if he were submissive and on the ground, especially since you indicate the resident of the home witnessed the event. Pepper spray is VERY effective on a normal person and will cause enough irritation to the eyes and mucous membranes that they will willingly submit to avoid further spray. This may not be the case with someone intoxicated or under the influence of drugs (which I am not saying your son was).
There is almost NO reason a person would need a prescription for being pepper sprayed unless they have asthma or some other type breathing problem. At the least an ointment for the eyes might be offered.
The police can file any charges they wish. The only one they really have a chance at proving is felony flight. Unless they can prove he was driving it is likely the prosecutor will not even consider this charge. If he has no record the punishment will be minimal at best and will likely be pled out to a lessor charge.
All said, I am not certain your son is telling you the entire story. It is VERY common for family members to get a favorable side of the story in a situation such as this, only to find out later there was much more involved.

My son ran because he was frightened.
I am not saying he didnt do anything wrong at all.
What my complaint is that the police used excessive force,took him to the hospital,then didn't even bother to give us or anyone his prescriptions.
Also, because they didn't find the driver(my son DID give his name)
They charged my son with the DUI.
They told him about 4 hrs. into custody that they didn't find the others so they were going to give all the charges to him.
I do NOT believe that is fair.

The police did what they are supposed to do. Should they have let your son get away because you think it's not fair that they couldn't catch the others? You said:

Why won't he provide the others names to the police? It sounds like he got exactly what he deserves. Oh, yeah and tell your son that if he doesn't want to be pepper sprayed, then DON'T BREAK THE LAW. Regardless, you even admit he fled, and that's a felony!
