Micah Deapen, dba M D Construction, has been paid all of the money required under the contract but failed/refused to complete the project.  We paid him over $10,000 (with us providing the vast majority of the materials).  Micah accepted our hard earned money yet refuses to finish the work.  Micah has been paid money for projects he hasnt even started and has not returned the money.  Our house has been in shambles for over 3 months because of Micah.  Micah caused my wife to waste a significant amount of time waiting for him at the house.  Micah would not show up and would not give her the courtesy of letting her know he was not coming.  

Micah bid the project at approximately $8,500, with a project time of 24 days beginning August 1, 2012.  Micahs proposal requested 30% of the contract be paid up front with 25% paid at the midway point and 45% due upon completion of the project.   We accepted Micahs bid. We paid Micah a $3,000 deposit.  Almost immediately, he started missing days.  The days that Micah did show up he would generally arrive between 9:30 a.m. and 10:30 a.m., take a very long lunch break and be gone by 4:00 p.m. or so.  On the days he showed up I estimate that he averaged about a 5 hour work day at the house.  

Well before Micah was at the midpoint Micah requested the 20% midpoint progress payment.  Micah stated that times were tough for him and that he needed the money to pay his bills and feed his family.  At this point, I genuinely liked Micah and agreed to pay the 20% progress payment, even though it wasn't due, so Micah could feed his family.  Not long thereafter, Micah requested another progress payment.  I told him that I had paid all the money due under the contract and that the remainder was not due until the project was completed.  Micah said he understood but that he had no money and that without a progress payment he would have to take a couple of day jobs to get money to feed his family (and therefore would not be working at my house).  I paid him more money.  This same scenario continued for the last month and a half or so ($1,100 on October 4, $500 on October 13 and $600 on October 22).  Micah would say he needed money to live and threaten (sometimes implicitly, sometimes explicitly) to leave the job if I didn't pay him some money.  I continued to have a soft heart and continued to make progress payments not required by the contract (shame on me) so that Micah could feed his kids. By October 24, Micah had been paid the entirety of the contract but the job was still weeks away from being done.  In order to incentivize him to just get our house finished I offered to pay him a bonus upon the successful completion of the project.  Instead of working extra hours to get the project completed (that he had been paid 100% for) Micah continued to work part time hours (when he showed up).  Micah actually had the audacity to request that I pay him the completion bonus I offered to continue working on my house.  I declined to pay Micah the bonus but again said that I would pay it if he got the project completed.  I knew I was in a bad spot when I found myself having to incentivize my contractor, who had been completely paid, to finish the job by offering a bonus.    Instead of finishing the job he was paid in full to do which may have led to additional work, Micah chose to issue an after the fact change order and refused to show back up at the job until it was paid money hew wasn't due. 

 At this point I (finally) had enough, refused to pay the bogus change order and demanded that Micah finish the job he has been paid for. Micah indicated that he didn't have money to buy the remaining materials or gas money to get to my house.  Wanting the job completed, I offered to buy any necessary materials to complete the job (caulk, nails) from Home Depot directly and to give him gas money after each full day of work at the job.  We have now given Micah close to two weeks to finalize the work he was paid for but he continues to make excuses and fail to show up. 

I have never written a negative review on anyone else.  The two reviews I have previously posted, one for the gentleman who installed my irrigation system and one for the gentleman who detailed my car, were very positive (because they both did what they were paid to do and did it well).  Had I known that Micah was a person who would accept all the money under a contract yet not complete the work I would not have hired him.
