Michael C. OYoung Irvine Attorney- Beware of His Violent Behavior! CA State Bar #260953

Below I am including a copy of my complaint to the State Bar of California regarding the violent behavior of Irvine attorney Michael C. OYoung during a  recent deposition.  I feel it is important that other attorneys and potential clients are aware of the volatile nature of Michael C. OYoung. What I witnessed was disturbing and astonishing and I have never experienced such behavior in my 35 years of practicing law.  In order to protect the other innocent victims of Michael C. OYoungs violent
outburst on April 15, 2013, I have redacted their names to their initials. Anyone that reads this complaint would agree that Michael C. OYoung lacks the temperament and emotional maturity to be a licensed attorney in California or any other state. If you are considering hiring him or if you are an opposing counsel in a case involving Michael C. OYoung, it is important that you are aware of this disturbing incident.

Re:  Michael C. OYoung   CA State Bar # 260953

Gentlemen:

As a licensed attorney in Texas for over 35 years, I have never had the need to file a grievance against a fellow attorney.  Unfortunately, my recent experience with Orange County attorney Michael C. OYoung demands that I now do so. On April 15, 2013, I attended a deposition to assist another Orange County attorney, MR, in the conference room of MRs law offices in Irvine, CA. Mr. OYoung represents Plaintiff Thuy Huynh (aka Thuy Li) in her case #30-2012-00564239-CU-BC-CJC against MRs client, Defendant CM.

After a lunch break, the deposition was about to resume, when MR and I had a meet and confer conversation with Mr. OYoung concerning his failure/refusal to produce any evidence to support his clients unsubstantiated claims.  At the conclusion of the discussion, Mr. OYoung loudly referred to Defendant as that lunatic. Although CM was standing in the lobby outside the conference room, he overheard Mr. OYoungs sarcastic remark and, upon entering the conference
room, asked Mr. OYoung what did you just call me? Mr. OYoung replied I said you were a lunatic!.  CM ignored the provocation and returned to his seat.  Before questioning resumed, CM commented to his attorney, MR, that he felt Mr. OYoung was an incompetent boy, an obvious reference to Mr. OYoungs youth and inexperience.

At that point, Mr. OYoung jumped up from his seat across the table with his laptop computer raised over his head and charged towards CM yelling Im going to kick youre a** !. Seated between them, I stood up and blocked Mr. OYoungs path to CM  and Mr. OYoung tried to push me out of the way so he could hit CM with his computer. After I pushed back and said You need to sit down and calm down, Mr. OYoung launched his computer towards CMs head.  Fortunately, CM ducked and the computer crashed into the wall behind him, leaving a large gash in the wall.  My understanding from MR is that the conference room wall will cost at least $500 to repair.

After he threw his computer at CM, I yelled for the receptionist to call the Police, as I feared Mr. OYoung would do serious bodily harm to CM if I was unable to keep blocking him from getting at CM. Mr. OYoung then grabbed and twisted my wrist and began shoving me out of his way, saying Get out of my way ! Im going to kick his a**!.When he heard that the Police were being called and he could not push me out of his way to get to CM, Mr. OYoung retrieved his
computer from the floor, grabbed his briefcase, and shouted for his client , Thuy Huynh, to Come on were out of here, and as he was leaving the room, he yelled  F*** you! and made an obscene gesture with his middle finger. He then promptly fled from the scene before the police could arrive.

Two court reporters were also present in the conference room and witnessed the altercation. Police Officer JM and a fellow Police Officer from the Irvine Police Department responded to the 911 call, but Mr. OYoung and his client were nowhere to be found.  Officer JM interviewed and took statements from both Court Reporters, MR, CM and myself.  I will forward the Police Report as soon as it is available.  In the meantime, the pertinent information is:

Case No. 13-04656

Irvine Police Department

Three Irvine Police Officers followed up the next day to interview Mr. OYoung, but Mr. OYoung declined to cooperate and refused to answer any questions. The Irvine Police Crime Scene Photographer took pictures of my injured wrist and the gash left in the wall by Mr. OYoungs thrown computer.

In my 35 years of practicing law, and attending numerous depositions, I have never witnessed such a violent outburst of unprofessional (and criminal) behavior on the part of a fellow attorney. There is no doubt that Mr. OYoung intended to seriously injure CM when he threw his laptop at CMs head and threatened to kick his a**!.

I sincerely doubt that Mr. OYoung has the necessary temperament and emotional control to be a licensed attorney in California, or anywhere else. Mr. OYoung has let his personal relationship with his client turn into a personal vendetta against the defendant. He admitted in the meet and confer that he has no evidence but is continuing the case to exhaust CM financially. His lack of professional objectivity seriously calls into question whether he should immediately withdraw from this case. A psychological examination should be considered to ascertain why any attorney would react in such a vicious and violent manner.

I trust you will conduct a thorough investigation of Mr. OYoungs blatant acts of Unprofessional Conduct.

Please feel free to contact me with any questions.

Sincerely,

 David L. White

scribd.com/doc/267036997/Affidavit-to-Inspector-General-s-Office-U-S-Treasury-Department

AUTHOR: Justice 4 C.M. - (USA)

POSTED: Friday, May 29, 2015

The Office of Inspector General of the U.S. Treasury Department has opened an investigation. They are investigating why IRS investigators failed to investigate in 2012 when they were presented with evidence of Thuy Huynh’s tax crimes. Michael O'Young was Thuy Huynh's co-conspirator in harassing and terrorizing the witness that reported Huynh's criminal behavior.

This inquiry is expected to to lead to a criminal and/or civil investigation of Thuy Huynh for tax evasion.

On May 15, 2015, I was contacted by a Special Agent from the Office of Inspector General. On May 19th, 2015, that same Special Agent interviewed Michael O'Young's victim. As a result of that interview, the victim prepared a lengthy and detailed affidavit that spells out Thuy Huynh’s and Michael O'Young's criminal behavior.

The Inspector General has been presented with evidence that, in addition to tax evasion, Thuy Huynh actively sought to retaliate against the victim for his refusal to assist her in covering up her tax evasion and for his later reporting her tax crimes. Thuy Huynh stalked, harassed, and endangered the victim and made him fearful for his life – conduct that is a federal crime and is even more serious than tax evasion.

There is evidence that indicates Thuy Huynh actively sough to the victim seriously maimed or killed in retaliation for him bringing to light her tax crimes. This information is being presented to the FBI, the Department of Justice – including the U.S. Attorney for the Central District of California, and the State Attorney General of California. Affidavits are being sought from victim's friends and associates that witnessed Thuy Huynh's campaign of terror. Michael O'Young's active role in this campaign of terror is being brought to light.

It has been brought to the attention of federal law enforcement that Thuy Huynh’s current attorney has claimed in court filings that he forensically backed up all of her electronic devices, including phones and laptops, as well as her email and social media accounts (Facebook, Twitter). This evidence compiled by Huynh’s attorney will be of great assistance in any criminal and/or civil investigation.

Thuy Huynh’s attorneys have stated in court filings she is expected to spend $129,000 defending herself in the current civil lawsuit. It is believed Huynh is paying her attorneys with unreported income. If this is true, that money is potentially subject for forfeiture – the concept of “fruit from a poisonous tree”. The government wants its money and it will start by looking in the easiest places.

Numerous media outlets are being contacted about doing a story on this entire matter. Every effort is being made to hold Thuy Huynh accountable for her criminal behavior and for what she has done to victim. This is far from over for her.

Every effort is being made to shine a bright light on Michael O'Young's despicable and criminal behavior.

I went to school with Mike and I recently heard through the alumni grapevine that he has become a laughingstock and an embarassment.

I have never witnessed Mike act violent but he always seemed on the edge of blowing a gasket. Just too much bottled up rage at what he perceived as slights aginst him. When he was in school he carried himself with an air of unjustifiable arrogance and swagger when his skills were mediocre on his best day. I am sure his claims to be on his way to be a legendar courtroom brawler was just a self defense mechanism to mask his feelings of inadequacy. His claims largely fell on deaf ears as it was well known he could barely handle himself in moot court.

He was incredibly thin-skinned and would respond with crass quips and ad hominem attacks towards anyone that dared to offer him constructive criticism. He was an immature loser in school and it sounds like nothing has changed. I don't recall him being well-liked or respected by any of our classmates or faculty.

As someone that knew Mike during his formative years, I  would have no desire to hire him or be associated with him in any fashion. He lacks the maturity and emotional stability to be effective counsel.

P.
