My sole income is social security. There are supposed to be laws protecting it from any levy or garnishment. My total income annually is less than $10,000. I am not proud of this or trying to hide behind it. My income monthly is a pittance. Why is the bank changing my checks and bill payments. They are reordering and acting like I had no money. It is like the funds become theirs and they change everything around to make it look like you bounced checks when you never did. I know how to balance my checkbook. I know when I have money and when I do not. I do not like seeing $30 charges when I did in fact have the money. I closed my account and switched to a better place. Banks are on the way out. Go credit union or cash.

Are you all shills for Middlesex Bank?

AUTHOR: Me again - ()

POSTED: Friday, November 29, 2013

All of the responses seem to be claiming I somehow did something wrong.

If a bank holds my deposit to make it look like I have nothing and then takes it all in fees. What difference does it make how well I balance?

Yes I do balance my checkbook and switched to a non criminally based credit union. No issues, no fees and no drama.

I know this is Middlesex employees. Just like the yelp review I posted, miraculously vanished into the filtered page.

Now it is only two fake 5 star reviews.

And I understand the semantics of levy and garnishment. Either way federal law and Mass law are clear on this. Banks may not take these funds. The terms of agreement can say whatever but the law is still the law. Regardless of any stupid bank agreement or hidden clause.

Go to a bank or credit union where they care about customers. Middlesex Bank hates poor people, the elderly and disabled.

Nice try though!

If you live on this income do you keep a check register?? Balance your monthly bank statement?  How are you protected from spending more money than you have??

A bank fee is not a levy, a bank fee is not a garnishment.  Being on Social Security doesn't give you free reign to overdraft your checking account and avoid the bank fees.

They are not "reordering" your transactions to make it look like you have no money.  Because if you are not spending more than you have available it is impossible to reorder them in a way to make you negative.  You don't believe me try to get $3, $4, $5 to add up in such a way that they equal $13.

I am going to trust that you do balance your account and keep an accurate and current register.

But your problem is from spending money before it is available in your account.  You can not "assume" you can float a check for a day or two because you have a direct deposit coming in a couple of days.  With the shortened processing times checks that took as long as a week in the past, now could get processed as quickly as a day.  While you don't give a lot of details I bet that this is most(if not all) of your problem.  You need to find out from your bank the order they process transactions, that is do they add in your credits first or do they do the debits first?    If they do debits first you definatly must wait until your deposit posts before you spend the money.   Yes, this even means that if you have a deposit that posts on Friday, don't spend the money on Thursday because you think you are safe.  This is a recipe for disaster.

Keep in mind that if you do not keep more of a handle on your account the same thing will happen at your next bank..yes even a Credit Union.
