Mitchel N Kay Trying to collect 3rd party debt, when statue of limitations is up, and not licensed to operate in Calif New York New York

This bottom feeder is trying to collect a debt that was charged off in 2004 and is past the statue of limitations. Also this jerk is a 3rd party collection agency, and is trying to collect more than orginal debt.

I gave up my car in 2004 as I became unemployed. The orginial lender Americredit sold the vehicle and then charged it off 10K. At which time I was contacted by Cavalry Portfolio Services (a collection agency) At which time I informed them that I was unemployed. After that no futher attempts were made to collect this debt.

Then in Sept 2008 I received a call from this Mitchell N. Kay stating to be an attorney and they wanted to set up a payment plan for this debt 14+K. At which time I informed them to sent me someting in the mail. While awaiting a letter from them I researched this company and found out that they are not licensed in Calif. and the statue of limitations was up.

So I sent them a request for debt validation and they only sent me a copy of a fax copy showing my debt. They did not send me proof that they have the right to practice in CA, that the debt had not went past the statue of limitations, nor did they prove that they are not a third party collector.

If this company was the orginial collection agency it would not take more than 30 days for send me copies of the orginial purchase agreement.

So once more I will send them a letter requesting the proof I require, but in the mean time I will notify the ftc on their practice.
