MJS is a total scam and they have figured out a way to "legally" steal your home from you. They put a lien on my home and did a short sale without even notifying me. Then the had the audacity to tell me I could have my home back for the fee they paid, plus $10, 000.00. When I refused they had me and my family evicted.

I have a 2 year old and a 7 year old who I now have to find a home for. They have been doing this up the east coast.

Anyone interested in joining a class action lawsuit please reply to this. I already have an attorney ready.

I appreciate your reaponse but it went down exactly as I stated. They did a short sale and I am now evicted. My mortgage company told me there was nothing they could do throught this whole process.

 

And I promise you that this is what MJS does to people. Jud, who is the owner of MJS, told the old president of our "board" that this is what his company does. I assure you if you search for reviews of them I am not the only person this has happened to.

Impossible!

If in fact you owned the home, it would be impossible for the HOA to start, much less complete, a short sale of your home without your full cooperation.

All HOA's have the capacity to put a lien on your home if your HOA fees remain unpaid for a specified period of time.

And the HOA has the power to foreclose on the lien. 

The HOA can then evict you from the premises in order to either rent or sell the property to collect on their lien.

However, they can not do a short sale without you specifically providing all the documentation to the mortgage lien holder and authorization to conduct a short sale on your behalf.

Any purchaser of a HOA foreclosed property with a mortgage on it is buying the property subject to the pay off of that prior mortgage.

This entire process is very convoluted and complicated. Best to speak to a knowledgeable real estate attorney.

If your attorney suggested a class action suit - then get away from him now and find someone reputable and knowledgeable.

You don't need a class action suit. You need an attorney that can negotiate the HOA foreclosure payoff so you gain possession of your home again.
