May 23, 2008 I purchased 12 Micro sites from Modern Marketing Systems (MMS) for $2925.00. The contract we have with Modern Marketing System guaranteed that if these 12 micro sites did not generate, within 1 year, a total revenue amount equal to or above the purchase price ($2925.00) then (MMS) would refund us the difference from $2925.00 and any revenue earned at a 120% rate.  After the 1 year period we could request an audit of our sites to initiate this guarantee.  Our sites were up and running on June 30, 2008.

On June 30th 2009, I sent a certified letter to (MMS) requesting the audit be conducted and to active my guarantee for 120% refund for the revenue shortage, which would be the entire amount, since even though the sites did earn $27.34 I never received one penny of it.

(MMS) responded to me with a certified letter, stating that I had not paid my monthly hosting fees and that is why the sites did not earn any substantial revenue.  They offered me an $1196.50 refund if I signed up for an additional six months and paid a monthly hosting fee of $29.95 for these six months.

I then replied again on July 22, 2009, via certified mail, that I declined their offer and would like my full refund. I also cited to them that when I purchased the sites I was told by their sales representative that the monthly hosting fees were waived for the first year.  I also included a copy of an email I sent to them on 8/4/2008 asking why my micro sites were not generating revenue, and if there was ANY thing else that I should/needed to be doing to help these sites be successful.  If the monthly hosting fees were an issue and this is why the sites did not earn revenue, as they are now stating, then why didnt they advise me of this at that time?

As of this date I have not heard back from (MMS), I have not received any refund, and they do not return my phone calls or emails.  However they did charge my credit card $29.95 twice, for the July and Aug hosting fees for sites that are no longer active, and have not been since June 4th, 2009.  I have called the credit card processing company for these fees and have stopped any future charges.
