I have had the same problems that i see everyone else has had with emc on this website. it doesnt matter when you send in a payment, it will always get their late so you get a late fee.

Another problem I have been having with them for a little over a year now concerns my additional principal I have tried to pay. Each month I have tried to pay $100 in additional principal for the last 12 months. My house payment is $388 a month. I you add up the principal, interest and escrow I pay out of this each month there is $100 left over that I have told them several times I want applied as additional principal. One time in the last 12 months did they do it.

I have no idea where the $100 as gone each month. Their monthly statements shows it as "other". When i write them and ask them about it they send me a customer activity printout. This basically shows me the same information as the statement, just a different format.

I have called and asked about it and I have been told everything from it was applied to late charges, put in a suspense account, that is is still being applied to interest arrearagae that I paid off years ago, and most recently that every time i was 31 days late with a payment they had to send someone physically by my house and that they charged me $100 each time. Oh yeah I forgot they said it was applied to additional principal and I just couldn't add well enough to see it.

I am paying my loan in full with them this month. Hallelujah! Its going to be like getting a tooth pulled tht has been hurting for a long time. I am waiting to pay them in full becaluse the additional principal I have tried to pay comes to about $1300. I have told them I am not argueing with them about where it went. All I want to do is know where.

My last conversation with them on the phone ended up with them telling me that they cant access that type information on their computer and I have to fax my questions to their customer service department if I want help. When I did they sent me a payoff statement for an answer.

I have a question regarding my payoff staement. I asked them and couldnt get an answer. I have almost $500 on my payoff statememt under recoverable corporate advances that I owe emc. What are recoverable corporate advances? I had seen Corporate advance before on one of the customer account activity statements I had receive from them. It showed a $33,941.00 corporate advance adjustment. Does any one know what this might be.

One last question. On the customer activity statements it also showed part of my payments going toward something called property preservaton. It was not alot of money, around $10. But sometimes it would be every month for a few months then not for a couple of months then it would be back again.

Wish me luck paying them off. I know right now that I will need it.

The FTC [Federal Trade Commission] is investigating the so- called sub-prime mortgage market. It said the agency is trying to determine whether any lenders, brokers or companies that handle loan services such as payment collection violated consumer- protection laws. EMC Mortgage Is Under Investigation. It is very important for you to write 1 to 6 page letter to the FTC informing them of your problems with EMC; and let them know you have evidence to back up your claim. If more Homeowners would submit a complaint the better it will be for all America Homeowners in the future. FTC site: http://www.ftc.gov

Contact your State Governments, The President's Corporate Fraud Task Force, U.S. Department of Justice, Office of the Comptroller of the Currency Legal Department, Office of the Consumer Credit Commissioner, Securities and Exchange Commission , Senate Banking Commitee and Senate Permanent Subcommittee on Investigations. These are Government Agents who are investigating EMC Mortgage, the IRS/FBI is investigating some lawyers who works for this company. Send the same letter to all of the above. You may not be able to save your house now but, you may get something in the future if you stay on top of every government agent with your complaint & keep checking with them. We've fought in Federal Court 4 yrs. our hard earn money went down the drain with lawyer fees & posting bonds. We now have started submitting to FTC and all other government agents our story. Do the same. United We Stand!

I need someone to tell me where you can go to report this company. I find hard to believe that the things this company does are legal. There has to be a regulatory agency somewhere that they have to answer to. I would appreciate anything anyone can tell me.
