Last month, using paypal, I made a purchase using a credit card. By some freak accident, paypal charged my bank account and credit card at the same time. Since I didn't have any bank funds, and did not authorize the bank transaction, I contacted paypal and my bank right away. Paypal marked it to refund, and a few days later the bank as a courtesy removed the over-limit fee.

I thought that was the end of it, but paypal made yet another error. They can't process a refund until they first get the funds, and since funds were not available, a few days after that paypal made another request. This time costing me 42.00 in bank fees.

I called up the bank to complain, but they refused to remove it. I explained that I didn't authorize those transactions, and it was an error, and they told me if they get a fax from paypal explaining it was an error they will remove the charges.

So I contacted paypal, got them to send the fax, but the bank says they never got it. And then again, it was sent, but the bank says they never got it.

I told the bank I can come into the bank in person and prove it, but they said they will only remove the charge if they get a later from paypal. Or it seems, if they get a letter from pay and choose to admit they got the letter.

They explained to me that they can only process a dispute if they released money to the requesting company, but because no money was released to paypal they say they are not required to file a dispute.

But I most certainly would dispute the legality of holding me responsible for an over draft fee for a transaction I did not authorize. When I signed up with M&T bank, it was explained to me that I am not responsible for unauthorized transactions, they claim to have great fraud protection, but in reality, because on one technicality, if anyone even makes a request for money without my permission they want to hold me responsible.

It's only 42.00 this time, but it's gone on for over a month. What's it going to be next time? 100? 1000? Is there nothing that can be done to protect me? Why should anyone be responsible for something that they didn't do?

I suffer from stress-related disability and I can't handle this much more. Furthermore, being on a limited income, I need all of my money to pay bills. Now I am late on a few bills because my assets are basically being held from me.

This bank is certainly taking advantage of a situation ripping me off. I believe that since they got the fax twice and claim they didn't, and because they refuse to let me show them proof myself, they are just using this as a way to leech money away from their customers.

Paypal took care of what MandT would not

Ok, here is what ended up happening.

Paypal sent the Fax to the Bank, saying it was in error, and even though it was an error with the paypal systems, it was interpreted by the bank to be an error on my part.

For one, this infuriated me. When I could provide proof to the bank in person showing them how it wasn't my fault or even my authorization, and they would be denied should be against the law.

I called up paypal again to complain, explained to them what was going on, and they decided to instead just credit me the 42.00 in fees and to send a fax to the bank saying not only that it was paypal's error, but that paypal has paid me for it.

So this situation is over and dealt with, but doesn't make me feel any easier about the Bank as a whole. I have been with MandT Bank for more than 3 years, longer than any other bank, and this is the first such problem, but the fact that the bank is unwilling or unable to provide me protection from this kind of situation means that I cannot trust MandT bank in regards to fraud protection.

If anyone knows a bank that won't do this to me, please let me know. As soon as I find such a bank, I will for sure close all my accounts with MandT and never do business with them again.

On the other hand, if they themselves fix this policy, I'd consider staying with them since it shows they can, in the future, protect my financial interests.

MandT won't let me provide proof myself, and does not provide complete fraud protection

That's one of the first thing I asked the Bank, if I could bring in documentation myself and in person. They refused to permit me that right. They claim they must get it from Paypal Directly, as that is their policy.

In this case Paypal has sent them and keeps sending them faxes, but they claim they never get it.

What concerns me most, however, is this. What if some other company does it and refuses to send a fax, but I can otherwise prove to them that I did not authorize it? How can a bank deny me the right to provide proof of my claims?

I can send more that the fax they need. I can send them a full record of the paypal transaction in question. But they don't want it if it isn't directly from me.

They appear to have a policy where I am not responsible, if I can prove to them that I did not authorize it, but the trick is being able to prove it to them.

I even asked them directly. If another company did this, and they refuse to send a fax, but I could otherwise prove that I am not responsible, will I have to pay the fees? And they said I would have to.

Which means that while they advertise on their website, and I quote, "We provide market-leading fraud protection services" in reality, this is not true.

It was explained to me that if the unauthorized transaction resulted in an overdraft fee, and money was sent to paypal, I could file a dispute, and while the dispute was being filed any fees associated with that dispute would be waived. However, in the event that the same thing happens but instead the bank instead decides not to send money to the requesting company and instead chooses to charge me an over limit fee and insufficient funds fee they will not under any circumstance waive that fee if they don't get a letter from the requesting company directly stating it was in error.

I'm at wits end. I don't believe they didn't get the letter still. Something is wrong, and what makes me think something is wrong is that I am not permitted to come into the bank in person with proof.

Have Paypal send you the fax, and then you bring it to the bank.

That should clear it up.

Do you still have the initial disclosures provided to you from the bank? Or do they still mention zero liability on their website?

The Federal Reserve limits consumer's liability for errors like this to $50 or the actual error, whichever is less. But I know some banks publish it to zero. So it looks like it's below the $50 limit in this case, which it shouldn't be.
