Municipal Credit Service I was referred to Vivian from Municipal Credit Service to fix my credit. Vivian said she can fix my credit within 2-3 weeks for a total of $499.00, however she needed an initial fee of $150.00 to star Miami, Florida

I was referred to Vivian from Municipal Credit Service to fix my credit. Vivian said she can fix my credit within 2-3 weeks for a total of $499.00, however she needed an initial fee of $150.00 to start; which was deducted from my credit card. Vivian called me days later and asked for an additional payment in order to finish my credit report faster, so I gave her another $150.00 (credit card). Vivian called again and asked if I can pay-off the full amount; which was $199.00. I told her but next week I can. The next day she called me and said "would you like to pay $124" and I said okay fine! When I checked my credit card, Municipal Credit Service had deducted a total of $574.00! I did not authorize the last $150.00 BUT since they already took off that amount I let it go and said please credit me $75.00 and they kept giving me a hard time telling me that the $75.00 is an additional fee to protect my credit from theft. I disagreed and argued with them to credit me the $75.00 ASAP! Municipal Credit Service now has a total of $574.00 of my hard working money and my credit is not even fixed! They have a Spanish commercial that says "You don't pay anything until they fix your credit". My question is why did they collect all this money from me in one shot without even fixing my credit. I am completely worried that they will not fix my credit and stay with all my money ($574.00). Today, October 29th they finally agreed to credit me $75.00 but in 3 business days. I think they should give me back all my money until they prove and show me that my credit has been fixed. Please help.

It is not illegal, if the credit service organization has obtained a surety bond of $10,000 issued by a surety company admitted to do business in this state and has established a trust account at a federally insured bank or savings and loan association located in this state;

but shall deposit all money or other valuable consideration received in its trust account until the full and complete performance of the services it has agreed to perform for the buyer;

In Compliance with the Statute 817.7005 of the Florida Law [http://www.flsenate.gov/Laws/Statutes/2011/817.7005] Municipal Credit Service Corp has obtained a surety bond of $10,000 and established a trust account, all upfront fee received by Municipal Credit Service Corp are deposit in its trust account until the service agreed to perform for the buyer has been completed.

Credit Repair Organization

First know that there is nothing that these "Credit Repair" companies can do legally that you can not do for yourself for free.  It would be best for you to search and read up on the Fair Credit Reporting Act(FCRA) as to your rights.  This is the same thing that any legitimate company would do.

Now, as for your money.  Any company that provides Credit Repair Services must abide by the Credit Repair Organizations Act(CROA).  If the company does not follow the provisions the consumer(you) may have the legal right to sue them not only for the fees, but punitive damages as well as attorney and court fees as well.  Not to mention that the FTC may start to investigate them. 

One provision of these regulations are that they are not allowed to take any money before services are performed.  So by them charging your card they have violated the CROA and you most likely have legal action you can take against them.

The link below is from the FTC about the CROA which you should read over.  You may also want to consult with an attorney and then either retain the attorney to sue, or file for yourself in small claims court if they have done anything illegal.
