these people have to be stopped they have harrased me so bad,dont ever talk to them once because they will never let off.how they got me to respond fast was call my x husband from 16 years ago,how they got his cell number i will never know,they told him if i didnt call that day i would be picked up at work.well my x and me still being friends called me at work and told me this.me being very confused because i have had identity theft in the past.called the man who i never got a name as i was at work,told me i wrote them 3 hot checks,for a old debt i owed from 1992.and if i didnt give him the money that day he had already called the sherriffs.well me knowing i had never written a bad check,but still afraid told him i didnt have the 1,790 that he wanted that day.i asked what date and check numbers he couldnt give me that info he said at that time.well i said well i cant talk to you at this time.he then said well the police would be picking me up.i hung up crying called my bank they said i never had a bad check and to not give out any info to these people.well it is 2006 these people still calling i hang up the phone and now have call intercept for there automatic computer calls now they call from portfolio.which comes up on caller id i will not answer still leaving threatening calls.that they are giving me one more chance or this is going to become real serious.i have contacted consumer trade commision with no help.what else can i do.and they keep reporting to my credit agency and i dispute it and cannot get it off

Rebecca,

I see everyone else already gave you most of the good info, but I'll throw in my 2 cents anyway.

This is rule # 1! NEVER speak to ANY debt collector on the phone!! It will never do anything positive for you, and will almost always make things worse for you.

NCO is a bunch of JUNK DEBT BUYERS. They buy old debts like this for less than a penny on the dollar.

And, being in CA that debt from 1992 is past the statute of limitations for collections.

The only thing to do now is send the CEASE COMMUNICATIONS letter by certified mail, return reciept requested. Put the certified # on the letter itself, and keep a copy for your records. This is very important.

The only thing you never ignore is a summons. It is a very small chance they ever file a lawsuit. However, they can't win this one anyeay, so let them waste the time and money!

They CANNOT do anything to you. They just try to get you to respond to reel you in. Ignore them and go about your life, they will give up when they constantly get no response.

I have been in the same boat with another company who made threats similar to yours and even more vail threats - these threats are a violation of the Fair Credit Act and Steve can help you explain what you can do.

Check you state laws about one way tape recording to see if you can tape what they say to you.

I got a great attorney to handle my case and you may want to do a web search in your state to find legal services that handled this type of litigation. Also, check out Bud Hibbs website - he has some good information. Keep your chin up!

Regarding NCO, here is a letter that you should immediately send to them by certified mail with return receipt.

1. Replace > with your information.
2. Send it by certified mail with RETURN RECEIPT.
3. Immediately, file a complaint with the attorney general's office in your state.

I am writing in response to your constant phone calls! The latest call was last week, harassing my spouse, and on prior occasions, were at morning and/or inconvenient times. You are herby given NOTICE TO CEASE AND DESIST HARASSING ANYONE AT MY HOUSEHOLD. Furthermore, a copy of this notice will be filed with the State of > Office of the Attorney General.

Therefore, I demand that you stop calling me at home, at work, on my cell phone or at any other location!

In accordance with the federal FDCPA, now that you have received this "stop calling" letter, you may only contact me BY MAIL to inform me that you:

are terminating further collection efforts;
invoking specified remedies which are ordinarily invoked by you or your company; or
intend to invoke a specified remedy.

Be advised that I am well aware of my rights! For instance, I know that any future contact by you or your company violates the FDCPA and that since you already have my location information, calls made by you or your company to any 3rd party concerning me violates section 805(b)2 of the FDCPA.

Be advised that I am keeping accurate records of all correspondence from you and your company, including tape recording all phone calls. If you continue calling me I will pursue all available legal actions to stop you from harassing me and my family.

Stop and take a breath

First of all, you can't go to jail for a debt.

Next, ask them to verify that you owe any money to them (by mail, DON'T talk to them on the phone!). NCO is known for their crap, don't fall for it.

Keep watching your report for Steve (from Bradenton, fla) to answer, I'm sure that he'll calm your fears from these predators! In the meantime, don't sweat their threats, they are without merit.

I am not bringing any helpful advice to you Rebecca, just some emotional support....

Keep checking on this report, because I bet you anything that Steve B. in Florida will be in here offering you some sound advice for getting the help you need.
Don't fret, there are ways to get these piss-ants off your back.

NCO is right up there with the likes of Boyajian, United Collection Bureau, Bay Area Credit Services and a few others that push the limits in abusive collection practices.

Oh, Mr. Steve, (picture me taking a quick glance around cyberspace in search of him)......where for art thou?
I'm betting he will be checking in and find this report of yours Rebecca....

Meanwhile, get with your bank again and see if they will confirm in writing that you have never had a bad check. Log the calls and such, and keep your mind busy until you have the information you need to stop these butt-faces.

Don't let these bullies intimidate and get to you...they are puke stains....
