In July of 2006, I completed a live Ebay auction to purchase a set of 3 ct. emerald earrings that were being sold by Neimans Live. I waited 3 weeks for the items to arrive and then started emailing this company to ask them where my merchandise was. There was no response at all, but the earrings showed up after another week.

Upon receipt, one of the posts of the earrings was bent, making it so that the earring did not secure properly. I contacted Neimans through the only point of contact I could find - email - and after nearly another week they finally responded with an address that I could ship my item to and they would replace it for me.

I shipped out the earrings approximately 2 days after getting their information, and after another 10 days my shipment was returned to me marked "Return to Sender". Again I contacted them trying to reconfirm their address. It took 2 emails and another 4 days to get a response.

By this time I was in the process of moving, and the package did not get shipped out. Once I moved and unpacked all of my belongings and located this package, I emailed them again to see if I could still return it. I mentioned in my email that I just wanted to do a refund on them, as I didn't like the way they fit anyway. This time Neimans responded right away and said that they would accept the earrings back, and a credit would appear in my PayPal account within 15 days of them receiving my package.

This time I shipped out the earrings via UPS so I could put tracking on it. They received the package on September 28th, and it was signed for by someone with the last name of Andrews (thank God for UPS's email notifications!). At the 12 day mark I emailed again to check on the status of it. It took another 2 days for a response, but they said that the credit would appear within 15 days, and asked if I would provide them with the UPS tracking number so they could check on the status for me. I sent this to them, and this is the last I have heard from them.

I have emailed this company 3 times with no response now, and am currently out both my money ($415) and the earrings. I can't seem to find any phone numbers on the Internet to call them about this - instead I found this site with an issue from June from another customer that has been ripped off.

DO NOT DEAL WITH THIS COMPANY!!! It will bring you stress and a lighter pocket all the way around. If anyone who has been able to talk to them has a phone number so I can try please feel free to email me at mamashaman @ yahoo.com.

My next steps are to appeal this company trough Ebay and PayPal...hope I have better luck!

I didn't want to get into a he said/she said situation, and I gave a factual account as to what happened to me with this company. They automatically assume that I did something wrong, which I did not, and the communication with Customer Service is proving to be lacking over and over as proved by multiple accounts from other consumers.

When email is the only form of contact between a company and a consumer, then it is the Company's responsibility to stay on top of all the emails and respond. If this company did actually respond to emails within 48 hours, consumers would not get so upset and would not start research on the Internet and find places like this site. When they had both my money and the merchandise and weren't responding to emails, any reasonable person would start to panic, more so after seeing the previous reports on this company.

I have entered the complete email history below. Please note gaps of 5-7 days in many of the responses, as well as multiple contacts from me to this company just to get a response. The last contact I had with this company was on 10/10 until this rebuttal.

I also find it very ironic that nothing happened during 5 days of emails, yet my funds were returned to me in just over 1 hour of my last email linking other Ripoff Reports and my own post!

The package I sent the earrings in was the EXACT same package with the same address as used for the first time it was shipped - I simply overlayed a label over the "Return to Sender" and removed the postage. Their own packing slip, stapled to my emails per their request, was in that box. If it were the wrong address how did it get to them the second time? I won't even begin to presume how the packing slip was "lost".

This whole situation is making me very nervous. You all are not responding to my emails and now have both my money AND the earrings. It is also past your own notation of when the credit should apply.

If I do not hear from you with a specific time as to when my funds will be returned, I will report you to both PayPal and Ebay.

I have received these earrings and they are beautiful! However, one of the earrings (the one that had the sticker put on it) had a bent post. Refund Issued -- Customer cannot follow the most basic return instructions

In response to the complaint....customer states that we did not respond to her e-mail. We respond to all e-mails within 48 hours or less, not including holidays. All of our items arrive within 3 weeks or less. Her package arrived in less than 3 weeks, not beyond 3 weeks as the customer states below.

The return to sender issue was due to the customer putting the incorrect address on the package.

Almost 3 months later, the customer returns the items with no paperwork or information. That is the equivalent of purchasing an item at a department store and walking in with no receipt and handing the item to the salesperson and walking away expecting a refund. Once we could decipher who the return was from, we were able to issue the refund. She has been given a full refund via PayPal, not because she posted this complaint but because we were able to decipher who the "mystery" package was from.

If the customer would have followed the simple return instructions, none of this would have happened. This was a self-inflicted mistake.

Thank you Ripoff Report!!!

After I posted my situation, I emailed Neiman's Customer Service Center with a bit of a nastygram and included a link to the other report against their company from June. When I checked my email this morning I found that within an hour of my sending them that email they had refunded my money!!

I'm still out nearly $13 because instead of marking it through PayPal as a refund they sent it as a payment (costing me seller fees), but at least this is FINALLY taken care of.

Although my situation is resolved, I still definitely would say BUYER BEWARE on this company. Any company that you have to threaten repeatedly to get a resolution is not one anyone should deal with.
