Case Description: I saw thier site from Overstock and contacted them, and got so excited that I bought a pair of earrings from a company in the internet called "New England Diamond". They had a picture in their site which looked like real diamonds, white and see-through. I know that they described their stones as 13 which means that there are a lot of defects on the diamond which can be seen by the naked eye. That was okay with me, since I have seen a lot of I3 diamonds.

I mailed my check to them on March 15, 2008 and they deposited the check on March 20, I have copy of the check. But I received the earrings from them on April 8 already.

I was so shocked because they did not look a bit like the earrings they advertised on their site. The color was grey, and they looked like plastic pebbles with a chip on it.

So I returned it on April 9, 2008 - with a USPS return receipt to have proof that they got it back. I asked them to return my money, even if he kept a little bit of it for whatever expenses he might have had for mailing. But he said that he could not give me a refund because it was advertised as 13 diamonds. I have seen a lot of 13 diamonds and they do not look like this at all. They do not even look like diamonds. Aside from the fact that the picture advertised of their site for these diamonds is a far cry from the earrings they sent me.

So I trusted them, from their return policy, which I have attached with this letter, that if I was not happy with the earrings, that they would give me a refund. But they said that they were not going to give me a refund but instead send me another pair of their earrings, which I do not want at all. I do not want their earrings. I just want my money back.

Desired Resolution: I have emailed them so many times to give me a refund, and they have responded that they were not going to return my money.

Return Policy
Overstock is a new experience for us and we are a new experience for you. We want you to buy from us with as much confidence as possible therefore we are offering a 3 day inspection period once you have received your item. We take the time to individually grade each item before we list it therfore we have a 100% refund policy less shipping with NO restocking fee if for any reason your merchandise is delivered not exactly as described.
In order to receive a refund you must notify us within the 3 day period. All returns must be accompanied by original receipt and returned in new condition as it was sent. All returns must be received at our office within 7 days. All refund checks will be sent out within 10 business days via Business check. We are very accommodating and your satisfaction is important to us.

Please know that any issues will be handled with respect and professionalism. If there is ever a problem with your purchase from our company, please give us the opportunity to make it right for you. We understand the effect that negative and neutral feebacks have on buyers and sellers and feel that could and should always be avoided. I have been emailing them ever since , and they have stopped responding to me, but they have my $378.00 . And I found out that they have stopped selling in the Overstock site too. I cannot go after Overstock, since in my excitement, I went straight to the New England Company to buy my earrings. and I found out that they have stopped selling in Overstock, and their 800 number has already been cut off.

I THANK YOU IN ADVANCE FOR WHATEVER HELP YOU CAN GIVE ME. I ALREADY WROTE TO BBB , NH. AND THEY WERE NOT ABLE TO DO ANYTHING, SINCE THE COMPANY NEVER RESPONDED TO THEM. THANK YOU AGAIN.
