I received a forwarded letter in the mail last week from NMS Subscriptions. The letter contained an invoice for a four year subscription to ESPN Magazine for $113.00 with $10 going for shipping. I called the company's number listed on the invoice 888-334-7996 and spoke with Kathy. I told her I was unaware of making an order for renewal through NMS. That I did not recall why I was getting an invoice marked Past Due. She told me that I could lower the renewal to a one year subscription and that was all she could do for me.

I asked to speak to a superior at which time she stated she was the highest level I could speak with. At that time, she stated I could pay $25 and cancel my subscription. Not desiring to do that I asked if there was any other way. I was told she would check the tape of the supposed order in August and call me back later today or tomorrow.

This afternoon I received a voice message from Kathy of NMS Subscriptions. I returned her call and was told she had the tape of the order. On the tape it appears that it could have been my voice, but it could also be stated that it is not absolute and there would obviously be some reasonable doubt. The tape is of someone, I believe Kathy, calling me to make an order for renewal for ESPN magazine.

Prior to the taped call was a previously call in which I spoke with someone concerning renewal. We had a lengthy conversation in which I stated I was unsure if I wanted to renew at this time and did not want to pay with a credit card over the phone. I was told I could simply make the order and if I changed my mind I could cancel it with no harm or hassle. This would obviously not be the case.

I have later found out that there were only five days that an order may be cancelled and the invoice and/or paper work is not even provided within five days. What consumer would go to these lengths concerning a magazine subscription renewal?

After hearing the tape, I told Kathy that it sounded like that could have been or probably was me. I then stated I would just pay the $25 cancellation fee and be done with it. At this time, Kathy told me there was no such thing and that I could not do that. I responded that I was told that option was available on our original call earlier.

At this time, Kathy told me there was no such thing. She stated she spoke to millions of individuals a day and simply could not recall our conversation. I asked to hear the tape from the earlier call, since it appears I was taped making an order previously, but was told there was no such tape.

In the next five to ten minutes, Kathy and I argued concerning why I had to keep a one year subscription at such a high rate instead of simply canceling the order. Throughout all our conversations, Kathy continually interrupted and over spoke me. She began using heated and crude language as well as other cursing words. Please, remember the argument at this point is over $6.46.

Following our phone conversation, I was deeply concerned as I felt I had been swindled in some way. I stated that I had no interested in a one year renewal at such a high rate. Kathy threatened that I would be sent to collection. I asked why I was being threatened and she replied that it was a not a threat rather a fact. I queried how a magazine renewal could be sent to collection. I also stated how unprofessional and unethical the practices and business of NMS Subscriptions were.

As our debate continued, Kathy hung-up the phone as I was talking. I immediately called back at which time I was cursed at and hung-up on again. I called a third time for the same result. Finally, on the fourth call I was able to confirm how much I was supposed to send for the one year renewal so my credit would not be hurt. Following the calls, I was very worried about what had just occurred.

I felt like I had been cheated and swindled. I was told the tape of the order would be used to go to the collection service, which she called Galaxy Collection. I am unsure if there is some sort of affiliation between NMS and Galaxy.

Following the final conversation, I decided to be proactive and check out information on this company. I was told by Kathy that there was no e-mail or business office that I could find using the internet. She told me there was no way to find NMS.

I searched through the websites www.BadBusinessBureau.com and www.Rip-OffReport.com. I found a pair of recent complaints citing much of the same problems I had encountered. The company goes under various phone numbers, post office boxes, and names such as NMS Subscriptions, SKS Services, SKS Subscriptions, Services Unlimited Plus, Service Unlimited Plus, and Subscription Services. Their phone number is 1-888-334-7996. The articles are attached to this letter.

I also called ESPN Magazine to find out what I should do. I spoke to a customer service representative and her supervisor Cassandra. I was told by both individuals that I should not pay the bill; rather I should simply write cancel on the invoice and return it. I am very leery of what to do concerning this matter. I do not want my credit damaged on account of a botched and unfair renewal scheme. I would appreciate any assistant or correspondence you could provide. Thanks.

Just to update this listing...

In recent weeks, I have followed the FTC's instructions and sent a certified, return receipt letter to NMS. I have not heard from Galaxy Collection again. I have received some information from the Better Business Bureau in Arizona and Florida. Florida simply wanted some more information. Arizona sent me the reply from NMS. They state that they believe the money is owed and should be paid.

As I have seen from other postings concerning NMS, and their similarly named companies, it appears their actions are continuing throughout the country. I have checked with ESPN Magazine and my subsription is paid through 2005, thus I had no reason to renew. Furthermore, NMS presenting themselves as ESPN Magazine's subscription services further hinders their credibility.

If anything further occurs, I will post it.

This afternoon I contacted Galaxy Credit Corporation concerning what would happen if I was sent to collection there. I was told what my options would be. Ralph was the name of the individual I spoke with. He said I should simply pay the $31.46 and "chalk it up to experience instead of taking time and money fighting." After 30 minutes on the phone, I was convinced.

An hour later I got a call from Ralph at Galaxy. He stated that a collection was filed on behalf of NMS for the entire $113.00 amount. He stated he could settle for the sum of $75.00. I was shocked and asked how I this could happen when less than 24 hours I spoke with Kathy at NMS who told me to send a check for $31.46. This makes the second occasion I was proposed a settlement only to be reicended prematurely. Ralph told me that Kathy stated I was "cursed profusely at her." This is an extreme lie as I cursed on one occasion when I muttered "d**n" to myself and not at her. On the second call after I was hung-up on, Kathy cursed at me using "s**t" on two occasions. Of course, I doubt this was on tape. It appears NMS only tape records when it benefits them. I ended my conversation with Galaxy asking for a few days to mull my options as yet again I have threatened with credit harm. Simply unbelieveable. Oh, and NMS has signed over its rights to settle the claim to a third party, Galaxy, thus they contractually cannot speak with me. If they settled with me directly than they would owe Galaxy the remaining amount to $75.00.

At this point, the issue has moved from fradulant misrepresentation and unfair consumer practices to an issue of credit and collection fraud. I contacted the Better Business Bureau of Central/Northern Arizona. Basically, all the BBB does is file the complaint take statements from each side of the complaint (basically he said, she said) and then put the results in their file or website report. Who checks this? I was then referred to the Federal Trade Commission. I contacted the FTC via the web (www.ftc.gov) and phone (1-877-382-4357). I spoke with Wendy. I filed a complaint concerning the credit and collection practices of NMS. I was given instructions to send a letter outlining my complaint and issues to NMS and send it certified mail with return receipt. This will be done tomorrow. The FTC also recommended I contact the Florida Attorney General and my local Better Business Bureau. I have left a message with the Florida State Consumer Protection Agency (Florida Attorney General) and filed a formal complaint online. The Florida State Consumer Protection Agency phone number is 1-866-966-7226. It was past 5 p.m. before I could contact the local BBB in my area.

To summerize, complaints have now been filed with the Arizona Attorney General, Better Business Bureau of Central/Northern Arizona, Federal Trade Commission, and Florida State Consumer Protection Agency (Florida Attorney General). I will contact the local BBB tomorrow at 1-727-535-5522.

I certainly hope all the information I have been posting will be helpful to others either as a deterrent or aid in their pursuit of true consumer protection in the face of consumer malpractice.

NMS Services, NMS, and Galaxy Credit Corporation Reports from Better Business Bureau

NMS Subscriptions apparantly also uses or has used in the past the business names NMS Services and NMS. Seems that all these companies are the same. You will notice that each uses a Post Office Box in Glendale, Arizona.

I checked the Better Business Bureau through www.BBB.org and found that Glendale, Arizona is situated under the Better Business Bureau of Central/Northern Arizona located online at http://www.phoenix.bbb.org/.

I did not receive magazine subscription to Reader's Digest. Contacted the magazine directly - and they confirmed that SKS Magazine was a legitimate company to accept RD renewals. They gave me the SKS phone number. As of yet I have not gotten an answer when I called SKS.

SKS called my home and represented themselves as calling for Reader's Digest to get my renewal - seem to have details and know about my current subscription and how they would handle non-interrupted service for me. NOT!!! I have yet to get a Reader's Digest from the renewal done in Oct 2002. I have received some "freebie" magazines though not the ones mentioned in the package deal to renew. Some Deal!

Not only are we the consumer being ripped off, looks like some reputable magazines are also getting the bad end of this one.

Let's all continue to fight this one! Phoenix BBB has updated this company with a unfavorable report on there web site as of 3-11-2003.

Services Unlimited Plus not Affiliated???

I have been continuing to search for information concerning NMS Subscriptions. Using other Rip-Off Reports, I found a new phone number for Services Unlimited Plus at 1-800-536-4704. I called the number and spoke with Velda, who is the same individual mentioned in so many other Rip-Off Reports.

I asked Velda if SUP was affiliated with NMS Subscriptions. She stated "no." I then asked if she knew of NMS. She stated that SUP used to do customer service for them, but have not in quite some time. She was unaware if the same owners are still in charge of NMS or anything else.

As I explained my story to her concerning NMS, she seemed shocked that they could charge or use actual collection services to hurt my credit. She advised, much like the customer service representative and supervisor with ESPN Magazine, that I simply try writing cancel on the invoice and returning it.

I have faxed a letter, copies of two Rip-Off Reports on NMS Subscriptions, and a copy of my invoice to Cassandra at ESPN Magazine. I will keep everyone posted as I continue to gather information concerning NMS Subscriptions.
