I have declined to accept the free bottle of LeanLifePM, as it was originally ordered 10/24/2005 and it did not arrive until Monday, November 7, 2005.

Paying $6.95 for such a small bottle should have warranted a faster shipment than the two weeks it to arrive at my house.

Furthermore, you should not have withdrawn $99.90 from my MasterCard without letting me enjoy the free sample bottle for an ADDITIONAL TWO WEEKS.

You were too quick to get the funds before I was even able to glean any benefits of using the sample bottle.

I demand a return of the $6.95 shipping charges PLUS the $99.90 fee you withdrew on the same day I received the free sample - November 7, 2005. You shall pay me $106.85.

Remit the funds to the same MasterCard account from which you withdrew the funds.

I refuse to participate any further in the AutoShip program.

I have sent the sample bottle and the enclosed papers to your Ontario, CA address ( USPS.com Priority Mail Tracking Number 0304 3490 0001 1775 2437), noting that that is where the shipment originated. You only have a PO Box in Utah and I sent only papers to that address.

Your company does NOT provide an accessible 1-800 number that is staffed with live operators. I would suggest that you would get back to me faster than Steve's phone call on Friday. Steve left a phone message on my answering machine while I was at work. I had called a full 4 days before that.

NovaPointe was too quick to get $99.90 for "shipment program" for LeanLifePM before I was even able to reap any benefits of using a sample bottle.

Describe your problem with Nova Pointe, LLC (1500 characters maximum)*:
I do not accept free bottle of LeanLifePM, originally ordered 10/24/05 (did not arrive until 11/07/05). Paying $6.95 shipment fee should have warranted faster shipment than 2 weeks. (US Priority Mail is faster and cheaper!) NovaPointe ("the co.") should not have withdrawn $99.90 from MasterCard without letting me enjoy the free sample bottle - the co. should have waited four to six weeks before making that withdrawal, because I had no time to enjoy the free sample before the co. made the $99.90 withdrawal. Then there should follow consumer choice to continue receiving LeanLife upon satisfaction. The co. does NOT provide an accessible 1-800 number that is staffed with live operators. Its Utah "call center" should've been back to me faster than Steve's phone call on 11-11-05. I had called full 4 days before that. If NovaPointe's website boasts of "proven innovation" (using FulleCom) for OTHER web call centers @ OTHER companies, then it should use that same technology/knowhow when it distributes its OWN products such as LeanLifePM, because NONE of "innovation" is on display when one tries to call 909-947-2710 or 909-930-3087. WHERE are the "shopping cart technologies" or "fulfillment & distribution services" mentioned in the company's media kit when someone orders products such as LeanLifePM? In short, NovaPointe had a chance to put its own technology at work instead of this travesty. WHERE are "TERMS and CONDITIONS" for LeanLifePM at www.novapointe.com? They should be prominent!

What would you like Nova Pointe, LLC to do? (500 characters maximum)*:
It must return the $6.95 shipping charges for the sample bottle, as I have sent it back to CA addr. - cheaper w/Priority Mail (only $3.85 and lot faster than 2 weeks!) -- PLUS NovaPointe must also return the $99.90 fee withdrawn on the same day I received the free sample - 11/07/2005. The total fees taken from my MasterCard were $106.85. It should answer emails sent to customercare@leanlifepm.com; it should answer long-distance phone call messages that were left in a timely & efficient manner.

PS Does NovaPointe always make it a point to make sure to withdraw $99.90 JUST AS the customer receives the sample bottle? What a scam!!!! That's not a valid trial period! The trial bottle MUST be shipped, the customer must open and use it, and if teh bottle has been consumes, then and only then must the customer decide to participate in the Autoship program!

Where are the terms and conditions posted BESIDES at the point of sale? They are NOT in the invoice that is emailed; the terms are NOT at leanlifepm.com not are they at novapointe.com!

Probably a way to get your LeanLife $$$ back...

... is to ask Joseph J. Gioeli, a rhythym guitarist, for the money in person when he next plays at a Hardline concert. He's apparently in the band. I did a search at Dun and Bradstreet's Million Dollar Directory online, and found that two of the executives who are in charge of NovaPointe, LLC were Joe and Adrienne Gioeli. Well, I did search in Google for Adrienne and found that she contributes to a Hardline fan site, and tehsite refers to her as Joe's wife. Here's Joey's page: http://www.doubleeclipse.com/joey.html. You also might find him at an airport near San Bernardino County, CA because he likes flying. Now at least we know where he can get served court papers if he continues NOT to listen to his LeanLifePM customers.

I had filled out an unauthorized use of an ATM card form with my bank. I received my $99.90 back on December 12.

Terms and conditions at Leanlifepm.com have been miraculously found! ..... how can that be?.... They tell you how to quit the AutoShip program and they also provide support and health questions email addresses. But will it work? The terms and condistions state that LeanLifePM will never refund the autoship program, although it seems to have refunded the $6.95 for teh sample bottle. I guess I will try to get a refund of the $99.90 or die trying :-)
