My wife and I were on our honeymoon in July of 2005 and went to a timeshare tour. After our presentation we were not interested in buying a timeshare. At that point Suzy Mayer the sales manager lowered the price and threw in a cruise that was 4 nights/5days and you could take up to 4 people on it.



The offer was not included in the contract, but written notice was given to us promising a cruise voucher within a few weeks. All the letter explained was that we were getting a cruise but it did not say for how long or how many people.

When the voucher arrived it was for 2 people and three nights. Not what we would have settled for, and if the original letter had stated what the cruise really was, I would have either not signed or revoked the contract on the spot.

At first we thought this must have been a mistake. Suzy seemed like a nice person and doing such a thing was fraud - a criminal and civil violation. We called and left message after message. She didn't even have the courtesy to return our phone calls.

We were finally told by the lady who handles the real estate end of it that there was no such thing as a 5 day, 4 person cruise. Boy were we wrong, at the time of the sale Suzy was all hugs and backrubs now she won't even return our calls. The worst part it is was that we didn't even know we got ripped off until after the 10 day timeshare cancellation period had ended. I am now fighting to get every cent of my money back.

I have filed a complaint with the Florida professional standards office and reported this violation and have been waiting for a response to what they have determined. Whether they can prove fraud is one thing, but if they continue to allow Oak Plantation to give out "Vague" inducement letters is something else.

From a business end, this is the sleaziest thing I have ever had done to me. It is more about the principle than the money. One way or another I hope to find Justice.

I am also a victim and have a ripoff report, as well as a BBB complaint against this company. I am trying to start a class action suit, but I need numbers. What I am doing right now is trying to gather as many victims as possible, so it is better for us. I have already spoken to a few attorneys. Bruce, I feel sorry for your experience. I have seen this many times. You will not get any help through legal channels. The key word is 'borderline'. They have been over this with attorneys and they know they can get away with it. Barely. My advise? Start a blog. That's a website that works both ways. You can speak your peace and your readers can comment. Every day. Communication is the key to organization. And organization will develope an equitable solution. Many heads are better than one. People in your position wish they could band together. Give them and yourself a way. A Weblog, or blog.

Not the government, not the courts, not the police, not the timeshare industry and not the Attorney General or other Florida authorities are going to hold Oak Plantation to account. Mark my words- I WILL!

Oak Plantation RIP-OFF Resort- anOrlando/Kissimmee Florida Timeshare



Since I first posted my RIP-OFF report, I spoke to two other individuals who were lied to by Suzy, except they were promised a week long cruise. And when they tried to use this FREE three day cruise that they had been given, it was going to cost them $700 in hidden fees- more that what it would cost to buy one on the internet. This is just the start of the people I have found, and I expect the list to grow larger in the near future. I know there are others out there and I am going to find them and then we are going to collectively and publicly redress our grievance, not only against Oak Plantation but against the whole timeshare industry in Orlando. My goal is to get enough victims together and collectively put a billboard up outside the Orlando Airport warning all tourists of the pitfalls of buying a timeshare in the Orlando area and how they are a borderline scam. If I find 100 Victims and they contribute $20 it would pay for 1 month during the busiest timeshare season. The more victims I find the cheaper the cost.



Timeshare victims in Orlando are a dime a dozen, and will be very easy to find.



Last week, I received my decision from the Florida Department of Business and Professional Regulation regarding my timeshare complaint and due to the fact I did not have written documentation supporting my claim, there is nothing they can do. What upsets me is not the fact that they could not prove the misrepresentation, but the fact that a state regulator allows entities to operate in such a dubious capacity. What Oak Plantation does is give you a vague promise, not listed in the contract and when you call them on it, there is an absence of hard evidence to reverse your grievance.



Timeshare resorts are notorious for telling lies, lies, lies and then hiding behind the contract when you want redress. Remember, IF IT IS NOT LISTED IN THE CONTRACT, YOU CANNOT CLAIM BREACH OF CONTRACT. Giving out vague inducements should now scream RIP-OFF! To anyone who knows anything about how the timeshare industry operates.



One thing I found particularly hilarious about the whole process was that I stayed at the resort for 6 nights after signing and the company had the gall to tell the timeshare regulator that each night was worth $339 per night with no housekeeping, when you can go to their website and book for $139 and get housekeeping. Had I not been lied to I would not have signed anything or stayed there. At the time we had missed our cruise and travel insurance was picking up the tab for all accommodation. I would have been more than happy to pay. Where I believe there is fraud involved, I don't feel I owe the resort one penny for this accommodation as part of any settlement. They should be paying me for my stress and frustration.



What I also found amusing was when I left the resort; I gave them a thank you postcard as I enjoyed my stay and how I looked forward to seeing them again. (Done before I knew I had been RIPPED OFF) The resort photocopied this and gave it to the investigator, like this was an admission of guilt. They thought they had me "over a barrel" or something. I am sorry, but I just think it is just sleazy when graciousness is used against you. I want my money back not because of the resort itself, but because of the RIP-OFF tactics that were used in the transaction.



Not only was the cruise was a lie but everything from how were told money could be made renting our timeshare, to its value as a real estate investment (not worth 20% of their asking price on resale market); to what a great week we had to trade on the interval exchange network. The truth is that Orlando is overbuilt, the timeshare's do not keep their value, are difficult to resell and because 1/3 of all US timeshares are in this area, trading to other places is difficult. No wonder I have seen Orlando area timeshares selling on eBay for $1.



Another annoying thing was the special 2004 extra hurricane clean up/damage charge that was added to my 2006 annual assessment. This was not added onto my assessment quote in the contract, nor was I told there was such a fee.

Does this place not have decent insurance? I am afraid to think what the timeshare owner would have to pay if the place was completely destroyed.



This hurricane was an event that happened BEFORE my purchase in July 2005, yet we were not told of any such fee's and are on the hook to pay them. The worst part is the Florida Division of Business and Professional Regulation allows this sleazy practice (among many) to go on.



This whole experience has proven to me that the laws do not protect victims, they protect those who RIP-OFF victims. The Florida system is useless and broken and I believe it is now time as a responsible person to use the first amendment to alert the public about these kinds of deceptive sales practices. Not the government, not the courts, not the police, not the timeshare industry and not the Attorney General or other Florida authorities are going to hold Oak Plantation to account. Mark my words-I WILL!
