Michigan Law Statue MCL 559.208 (1) provides that a condominium assessment lien does not have priority over "sums unpaid on a first mortgage". This is affirmed by the Michigan Court of Appeals, Oak Park v Cathey, et, al, Case No. 08-093850, Mich Ct. App, December 9, 2010.  Continue Reading. The Shiawassee Condominium Association (Southfield, MI) on 11/02/2010 through its attorney, Jeffrey Vollmer (Wegner & Associates, P.C.) foreclosed on Unit 108 addressed at 25340 Shiawassee. Unit 108 before, on and since 11/02/2011 was/is attached to a mortgage via Chase Bank. According to correspondence (11/15/2010) signed by Vollmer, "the Shiawassee Condominium Association" on 11/02/2010 foreclosed on Unit 108 and purchased it. Continue Reading. The best is yet to come. The condominium association foreclosed on Unit 108 WITHOUT assignment of the mortgage; this is a VIOLATION OF Michigan law statue MCL 600.3204.  As of 06/02/2011, The Shiawassee Condominium Association lien ceased to exist. The mortgage lien via Chase Bank , however, remained in tact. The Shiawassee Condo Assoc did not purchase the mortgage and did not purchase the unit. Chase Bank was/is the first lien holder of Unit 108. Sums on the mortage was/is UNPAID. Laugh. Go ahead and laugh. Laugh. Laugh. Laugh. A condominium assessment lien does not have priority over sums unpaid on a first mortgage. The Shiawassee Condominium Assoication through its attorney Jeffrey Vollmer (Wegner & Associates, P.C.) entered into violation of Michigan law statue MCL 600.3204. Continue Reading. The best is yet to come. The Shiawassee Condo Assoc via Jeffrey Vollmer named itself "mortagee" in the SHEFIFF'S DEED. Oh! Oh My God. The mortgagee before, on and since 11/02/2011 is Chase Bank not the Shiawassee Condo Assoc. Laugh. Go ahead and laugh. Laugh, Laugh, Laugh. The Sheriffs deed presented to Oakland County (Michigan) is not truthful, a FALSIFIED DOCUMENT. The Shiawassee Condo Assoc. has possession of the property and a non-truthful sherriff deed. It's ok. It doesn't matter. Chase Bank is still the 1st lien holder/mortgagee. Laugh. Go ahead and Laugh. Laugh, laugh, laugh. Shiawassee cannot sell that property but must pay taxes. They must indeed pay taxes though it, Unit 108 belongs to Chase Bank.
