My mom, whom is disabled (diagnosed with Dimentia) and lives in a care facility, receive a notice from the DMV, around December 2010, that her license has been suspended due to a vehicle violation and unpaid ticket. Just for information purposes, my mom hasn't driven a vehicle since 2004, when she was dianosed with Dimentia and has a Identification Card with the DMV (not a driver's license). A lot of places require a valid government issue photo id.
After receiving the notice, my mom filed a request and received paperwork from the Licensing Operations Divsion of the DMV. According to the DMV, a citation for 12500AVC, 40508AVC, 16028AVC and 405095VC where commited on July 26th, 2010 in Alameda County and her license was suspended as a result (of course she doesn't have a driver's license, just an Identification Card). She then filed a police report with the San Bernardino County Police Department (where she resides) for identity theft, since she hasn't been in or near Alameda County in at least 10 years (if not longer). My mom also has witnesses, such as the care facility care taker; that she was at the care facility on July, 26th 2010.
My dad contacted the Oakland Superior Court (510-268-7673, this number is no longer good) and was instructed by the clerk to come to the court house in person. My mom is located 900 miles south of Oakland, so that wasn't going to happen. None of us can afford that trip. My dad explained the situation to the clerk and the clerk then instructed my dad to mail in a brief summary of what he told her happend, a copy of an affidavit signed by my mom and a copy of the police report and it would be taken care of. So, my dad did just that. Mind you we still to this day have never received anything from the Alameda Court. Not a copy of the original citation, a notice of judgement, absolutely nothing! If the court is mailing anything, we have no idea where.
We thought this case was resolved, but on 05/31/2013 (yes, 2-1/2 years later), my mom received a demand for payment from the FTB that claims she owes $300 to the Alameda Court. I (her son), have tried contacting the traiffic division of the Oakland Superior Court house at their new number (510-627-4701) multiple times, only to listen to a voice recording on the 20 different ways I can pay. No one, so far, has ever answered the phone. I've been on the phone almost an hour each time without ever talking to anyone.
So, this basically is a racket. The Oakland Court procutes the wrong person, then you can't ever get a hold of them to find out a way to rectify the situation, unless you can afford to travel 900 miles there. So in other words, it's just like their phone recording. Don't talk to us, just pay!
My next step at this point in time, is to mail a recertified letter, yet again with the affidavit, letter of sumary of what happened, a copy of the police report and a demand letter to the court to respond. Problem is, since I cant get a hold of anyone their, so dunno who to address it to. It's obvious, someone at the Oakland Court house didn't to their job or the court completely ignored it, with the packet my dad mailed in.
If this fails, then I plan on contacting the news, probably Bogy and see if he can make any progress. So far, the Oakland Superior Court house has been a complete waste of time and is only interested in money, not justice. It's also painfully obvious the police officer who wrote the citation didn't bother to do his/her job and verify the person using CLETS (their vehicle DMV linked computer system).
This whole ordeal feels more like a screw up by both the Alameda police department and Superior Court. Rather then correct the problem, lets sweep it under the rug and push it through anyway. After all, it's all about the money, not justice. Don't believe me? Just listen to their automated message at 510-627-4701....pay, pay, pay and don't forget to pay.
