Our experience with Ocwen Federal Bank goes as follows:

We purchased our home on July 22, 2002 and Grren Point Mortgage was the mortgage company whom we had our mortgage with. In October of 2002 our mortgage was transferred to Ocwen Federal Bank and we were never notified about the transfer so I called Green Point Mortgage. Anyway the nightmare began with Ocwen. I had send them my October, November and December payments and they were retuened to me because they could not find our mortgage account number. Then after fighting with them for months they found my account number and now was 3 months late.

They began charging me with late fees, inspection report, and escrow fees. After that we paid them up to date including all the late fees, escrow fees and inspection report too! For a while there I thought we were doing good and then I received a letter from Ocwen (July 2003)asking me for my homeowners insurance policy so I had faxed over to them and still no good enough. They went ahead and purchased homeowners insurance on their behalf and they charged me $940.00 for a whole and when I told them I already had insurance they did not want to hear about it.

From there they told me that they were going to forclose on my house because I was not making my monthly mortgage payment and we know that was not true. When I received my monthly statement I saw that they had charged me so many different fees that my mortgage went up about $100.00 more than I was paying already. Our mortgage went so high that I could not afford to pay it any more so I had to file Bankruptcy Chapter 13 so that I can save my home from being forclosed. And now I still get harrassed from Ocwen all the time for payment and late fees.

My husband and I refinanced our home that we have lived in for 10 years in July of 2002 with WMC Mortgage. In October 2002, our loan was transferred to Ocwen and like you, our nightmare began.

I was notified in October by WMC that my loan was transfered to Ocwen and the only contact information that I was given by WMC was a name and phone number.

In October 2002, I received numerous phone calls from Ocwen demanding that I make my October payment to them. I informed them that the payment had already been made to WMC. Also, I had not received any notification from Ocwen regarding the transfer and where to send payments to.

In November 2002, I continued to receive numerous calls on a daily basis from Ocwen demanding payment for both October and November. I informed them that I had already made my payment for October to WMC and that I would need an address to send Novembers payment. I was told by their "knowledgeable" representative that they could not give me an address because they did not know which office was going to service my loan. I finally gave them a check by phone just to stop the harrassing phone calls. At this time, I still had not received notification that Ocwen would be servicing my loan or an address to send payments to.

In December 2002, I was still receiving the usual 5-6 phone calls per day until I received a foreclosre notice. Within hours of showing the notice to my husband, he had a heart attack. By the end of the month I contacted Ocwen. I was informed that they had received my October and November payment but I was late for December. Due to medical reasons, I informed the representative that the payment would be made in January and that the payment would include only a partical payment for January. The representative said that would not be a problem and that the balance of Januarys payment could be spread out over the next six months. Still no notification from Ocwen regarding transfer only a foreclosure notice from Moss, Coddillis that was actually Ocwen.

In January 2003, I received another foreclosure notice from Moss, Coddillis, actually Ocwen. I contacted Ocwen to find out why. I was informed that I had not made any payments on my mortgage and that if I did not pay the more than $3500.00 they would foreclose on my home. I was also informed that they would not except anything less than what they were requesting. This month, I finally received notification from Ocwen in the form of a statement. Of course nothing on this statement reflected correct information.

In June 2003, my husband and I filed Chapter 13 to keep them from foreclosing. In the Chapter 13, the arrearages that Ocwen claimed I owed was now $10328.00. No explanation of how they arrived at that amount.

In December 2003, my husband and I had the Chapter 13 dismissed. We did not want to continue with the bankruptcy. Bad move because in April 2004, Ocwen began foreclosure proceedings again and I could not protect myself with Chapter 13 and instead had to sign a forbearance agreement to keep my home. This agreement was signed in May of 2004. Now my arrearages are $14070.00.

Since January of 2003, I have requested that they provide me with the detail of all the arrearages they are claiming. I want to know the amounts and dates of every month I was "supposedly late" and the dates and amounts of all fees. I finally received that yesterday, two years later, and it does not make since. I signed the forbearance in May of 2004 but all of the arrearages are for dates after the forbearance was signed. The fees alone total almost $5000.00.

Over the past year, I have paid very close attention to what is being reported on my credit report by Ocwen and the information they post on their website on my loan activity. I have found a great deal of discrepencies. Also, the information that they are reporting to the credit bureaus and their responses to my letters are very inconsistant with the timing of when the loan was transfered to them. Please pay close attention to these things and continue to demand from them the dates and amounts that they are charging you. In the mean time contact a good real estate attorney if you have to.
