After refinancing my mortgage,Decision One sold my note to Ocwen FSB. I have never been late with a payment, much less missed one, until i met Ocwen. I made the Oct. 2004 payment using their internet site. I got a call from India (a branch office I assume) stating that they couldn't process my payment due to the account I paid from doesn't exist. So I made a check by phone payment to cover it. All is well. WRONG!!
The Nov. 2004 payment was made via internet on 11/04/2004. As of this date it has yet to be drafted from my account. On 11/11/2004 i called the "customer service" number waited 19 minutes, talked to the India branch again. his advice: "Wait till the 13th or 14th, call us again. If it's still not drafted, make a check by phone payment." Ok no help what so ever. I just know in my heart I did type my account info correctly, I do all of my bill pays and a large amount of shopping online, and have never had that happen.
How do I become a member of the lawsuit? Decision One sells a lot to Ocwen, perhaps they too should be in court.

Bank One Suggestions

My bank, Bank One, in Chicago has told me to use their online payment service, so when they send the checks to Ocwen there will be a trail. If Ocwen says my payment was late, I can call Bank One and they will dispute it with Ocwen. I like this scenario in that I can get a banking institution (Bank One) to deal with Ocwen, the other institution. I do not know what the result will be, however, it does give some type of equal footing with Ocwen and would hopefully level the battlefield. They also suggested wiring the money from Bank One to Ocwen. Again they would be unable to say it was late without getting Bank One involved. Hope this helps.

On Friday Nov. 12, Ocwen sent me a notice saying they have no record of hazard insurance for my house, and asked me to have my insurance agent fax them a copy of proof of hazard insurance for their records. Saturday morning it was faxed to them from my State Farm Agent. I told him about Ocwen, and the first words out of his mouth was "forced insurance". I also ended up calling Ocwen (the India branch) and they still had no record of my internet payment, so i ended up doing a check by phone so my payment wouldn't be late. Of course the India branch promised there would not be a duplicate draft of the payment. Well we will just wait and see. I also went to my bank, Bank One, and they had some good suggestions for me as well as how to protect myself.

John,
If read a few of the other complaints posted here and else where you will find that it gets much worse. Many are forced to sell their homes, or refinance if Ocwen hasn't already distroyed their credit rating by posting false information. Unfortunately, there are even more that lose their homes to Ocwen's foreclosure mill. Even people like yourself who have never been late on a payment. I know I had to sell my home just a few months after they took over the servicing of my loan.
