Ocwen Loan Servicing, LLC Will not honor our exisiting approval for Deed-in-lieu with the previous Servicer. West Palm Beach, Florida

Ocwen Loan took over our mortagage account in November of 2011 from Litton Loan. We had previously been awaiting the final closing of our deed-in-lieu from Litton. I called to check on the status with our contact person and discovered that Litton no longer existed. Their letter to me after I made contact states that if we were previously approved for a deed-in-lieu with our previous servicer, that they would honor this as long as we still qualified.

Upon contacting Ocwen to find out the status of our deed-in-lieu, I was told that there was no record of this and that I was offered a Loan Modification months earlier but due to no response from me this was cancelled. I explained that I had never received anything from them at all and wasn't even notified of Ocwen acquiring my loan. I explained that I wasn't living in the home any longer and Litton had the contact information for me as well as had been doing all contact through my email address.

With Litton, after several months of having our home on the market for Short Sale, we were told that we must submit a letter for deed-in-lieu request and include a vacate date. So we moved out 2 weeks after the letter was submitted for convience. Now we see that we moved out for nothing and cannot afford to  now move back and modify the loan. We also received several update emails from our contact person at Litton explaining what was next and/or what documents were needed. All contact emails have been saved.

Ocwen will not discuss anything with me or answer my questions when I call. They only want to schedule an appointment for a representative to call me back. Sometimes 2-3 weeks away. When they call back they are unable to assist or finalize any problem. They then just schedule a follow up call in 2-4 weeks.

Ocwen did tell us we could try another short sale but the packet that was sent was only to be sent in when we had a buyer and they continuely told my real estate agent that we must return the packet before they were cooperate with him. I spoke with our representative during a "scheduled call" and he confirmed after a long hold, that we "did not need to return the form until we had an offer on the home". My real estate agent quit trying after 2 months and transferred our home to a collegue who specializes in short sales and also had had some similar dealings with Ocwen. This real estate agent gave up after several weeks and again my home was never any placed on the market due to lack of cooperation from Ocwen.

I then called Ocwen and "begged" for them to just honor the Deed-in-Lieu and let me finish this in peace. I have yet to receive any forms, packages, or letters from them. Only "scheduled calls" that tell me that they will schedule an interior inspection before approving the deed-in-lieu request. During this time we have accumulated $10,000+ more fees and payments due to being dragged along. When we were to finalize with Litton we were only behide the few months but Owen has dragged this out to a year and half of debt.
